HOURS OF WORK AND ROSTERING.
(1) Changes to roster arrangements will be determined at the workplace level in accordance with Clause 28 – Flexibility in Hours and Rostering of this Agreement unless otherwise provided in this clause. Ordinary Hours
(2) The ordinary hours of work will be an average of 38 per week. The actual hours worked will be 40 per week or 80 per fortnight with:
(a) two hours of each week’s work accruing as an entitlement to a maximum of 12 accrued days off (ADOs) in each 12 month period in the case of hospital nurses; or
(b) with 0.4 of an hour per day accruing as an entitlement to take the twentieth day in each cycle as an accrued day off in conjunction with other days off for nurses working in either a hospital or community setting; or
(c) by any other arrangement as agreed between the Employer and the employee. Accrued Days Off (ADOs)
(3) ADOs will be taken in accordance with the following paragraphs:
(a) ADOs for Full Time employees:
(i) Employees will be given an opportunity to take ADOs within 28 days of completing each accrual cycle.
(ii) A roster for ADOs will be posted at least four weeks before the time it comes into operation. A roster for ADOs may allow an employee to take ADOs before they become due. Notwithstanding the provisions of this clause, ADOs may be cleared as mutually agreed between the Employer and the employee.
(iii) The Employer may roster the employee off duty for up to 12 single ADOs for each 12 monthly period.
(iv) Where an employee has been given the opportunity to take the ADO in accordance with subclause (3)(a)(i) of this clause as a whole shift and has declined, and that employee has 12 such ADOs accumulated, the Employer may pay the employee the monetary equivalent of the 12 ADOs.
(b) ADOs for Part Time employees Part time employees will accrue and will be entitled to ADOs on the same basis as full-time employees provided that the part time employee works 41 hours or more per fortnight. The Employer will advise part time employees who work 41 hours or more per fortnight that they are to be entitled to ADOs in accordance with this clause.
(4) An Employer and an employee may by agreement substitute the ADO/s the employee is to take for another day(s) in which case the ADO/s will become an ordinary working day. Payment for ADOs – Paid as Earned Method

HOURS OF WORK AND ROSTERING. 4.1 The ordinary hours of work shall be 40 per week and not more than eight per day between 7 am and 5.30 pm, Monday to Friday. Each daily duty shall be continuous except for meal periods and rest breaks.
4.2 The normal working week shall commence on Monday at the normal starting time of the employing District Health Board as determined by that District Health Board.
4.3 Except as provided for in clause 4.4, rosters will be notified to those involved not less than 28 days prior to the commencement of the roster; provided that less notice may be given for services where unpredictable changes in service demands make this impracticable. The affected RMOs will be consulted at the earliest possible opportunity.
4.4 Except for working weekends, the notice provisions for relievers is 14 days, noting the provisions of clause 16.

4.5 The parties acknowledge the mutual interest and benefits of providing rosters that set working patterns for a reasonable period of time into the future. It is agreed that DHBs will post rosters covering a minimum of three months of duties, and ideally for the entire length of the respective run.
4.6 Services and RMO units are encouraged to engage with RMOs prior to roster publication to optimise appropriate leave allocation in line with best practice leave allocation guidelines (Appendix 3).
4.7 Where the allocation of clinical duties to published rosters is undertaken by a registrar, the employer will provide sufficient time during working hours for those duties to be undertaken. A Registrar who is designated as responsible for writing, managing, and publishing their roster on behalf of the service, and who does not have this role otherwise recognised or compensated, shall be paid an allowance equivalent to one hour at the appropriate additional duty (0800-2200) rate per week in recognition of the time spent undertaking these activities. It is an expectation that the Registrar in receipt of this payment is meeting the expectations of timeliness of roster publication (as per clause 4.3) and supporting the effective, efficient, and equitable rostering of RMO duties within the service.
4.8 The parties acknowledge the importance from a service quality and from an audit/risk perspective for Registrars to have sufficient time in their working week to complete administrative work associated with their clinical duties and service development.
HOURS OF WORK AND ROSTERING. Employees are to ordinarily work their FTE in accordance with the roster(s) of the employer, provided that daily periods of work shall be continuous (excluding meal periods and rest breaks) and shall be rostered during the employer’s normal hours of business. The specific hours and days that each employee works or will be rostered to work shall be mutually agreed upon before the employee commences their employment, or changed through mutual agreement after commencement, taking into consideration their personal circumstances, business needs, and all other relevant factors. Employees are entitled to 2 consecutive rostered days off per week, except where otherwise mutually agreed. Rosters will be notified not less than 20 working days prior to the commencement of the roster and show duties for a minimum 8-week period. Less notice may be given in exceptional circumstances.
HOURS OF WORK AND ROSTERING. 10.1 Ordinary hours of work will be an average of 38 hours per week.
10.2 Ordinary hours of work will be worked as rostered, between 0600 hours and 1800 hours Monday to Friday, in 5 consecutive shifts of 7 hours and 36 minutes (exclusive of meal breaks).
10.3 The roster will be established and maintained by the employer in accordance with the operational requirements of the employer after consultation with the employees to whom the rosters apply.
10.4 The roster will be posted on each occasion at least 48 hours before it comes into operation, in a convenient place where it can be readily seen by the employees concerned.
10.5 Rostered work outside of the ordinary hours of work will attract the relevant shift penalties. Unrostered work will attract the relevant overtime provisions.
HOURS OF WORK AND ROSTERING. Employees will be required to work hours as advised to them by the Company. This may include reasonable additional hours over and above 38 hours per week. Payment for working additional hours is included in an employee’s remuneration. Employees will be advised of their specific hours and roster requirements on commencement of employment, and thereafter periodically should these requirements change. Each employee will receive a letter of appointment specifying the particular hours’ arrangement relating to their role. Should an employee move to another position within the Company, they will receive written advice should this hours’ arrangement differ for the new role. The description of hours will include the days of the week that may be worked by an employee and the standard hours per day/shift. In addition, employees will be advised by their supervisors of the expected start and finishing time for each day or rostered shift. Hours of work will be managed to ensure safe working practices and the avoidance of fatigue. Standard daily hours will not exceed 10 hours per day for employees working Monday to Friday and will not exceed 12 hours per day for employees working on a roster. Roster patterns will be determined by the Company to accommodate a 24 hour 7 day a week operation. The Company may alter an employee’s hours as required to meet its business needs and will provide advice in writing should this be the case. An employee’s remuneration may be adjusted if their hours of work are changed. Rostered employees may also be required to work shift work on a set or rotating basis and may be required to change shifts due to work requirements from time to time. Employees are required to remain flexible to the degree that work schedules and rosters are dictated by the work site.
HOURS OF WORK AND ROSTERING. 14.1 The ordinary hours of work will be an average of thirty five (35) hours per week over the roster cycle.
14.2 The Company can determine the working arrangements to be worked including the types of rosters to be worked, hours of work, shift length, shift start and finish times.
14.3 Employees may be required to work rosters that enable coverage over a 24 hour period, 7 days per week, subject to industry Fatigue Guidelines.
14.4 Shift lengths may be up to 12.67 hours in duration.
14.5 The Company will provide an Employee with 7 days’ notice of a change in their roster unless a shorter period is agreed.
14.6 Work will be arranged so that an Employee has ten (10) consecutive hours off between work on successive days.
14.7 The Company is required to provide notification of a cancelled shift, to the affected Employee, at least two (2) hours’ prior to the rostered shift starting time. This includes both rostered and unrostered overtime shifts. In situations where the Company has not provided notification Casual Employees will be paid a minimum of four (4) hours as if they were at work. Employees, other than casuals, will be paid in accordance with clause 22.2.2.
14.8 The company will not change the start time of the shifts for casuals on these days to avoid the payment referred to in this clause.
14.9 Where an employee is required to attend a safety talk, as advised by the Company, employees will be paid at double time for the duration of the safety talk. Safety talks are contained to a limit of 15 minutes in duration.
14.10 Employees participating in Order 43 Medicals outside their rostered hours will be paid for the time of attendance at the rate of double time for the full duration of the appointment with a minimum payment of 2 hours. For clarity, travel time to and from the medical appointment is not paid.

HOURS OF WORK AND ROSTERING. 21.1 The ordinary hours of work for a full-time employee will 38 hours per week and may be averaged over a period of a fortnight.
21.2 The span of hours in which an Employee may work their ordinary hours is 6am to 6pm Monday to Sunday.
21.3 Where work is carried out on weekends, payment will be paid at a rate of time and a half (150%) on Saturdays and double time (200%) on Sundays.
21.4 An employee who works their ordinary hours in a shift which finishes after 6.00 pm and at or before 12.00 midnight Monday to Friday, will be paid an allowance of 15% of their ordinary rate for the whole of the shift.
21.5 An employee who works their ordinary hours in a shift which finishes after 12.00 midnight and or before 8.00 am Monday to Friday, will be paid an allowance of 30% of their ordinary rate of pay for the whole of the shift.
21.6 A full-time or part-time employee who works their ordinary hours on a public holiday, will be paid at the rate of double time and a half (250%) of their ordinary rate of pay for the whole of the shift.
21.7 A casual employee who works on a public holiday, will be paid at the rate of pay of double time and a half (250%) without 25% casual loading for the whole of the shift.
21.8 The actual starting and finishing time will be determined by the employer and any shift will be a minimum of 2 hours.
21.9 A maximum of ten (10) hours may be worked in any one day between the times specified in Clause 21.2.
