OHA RESPONSIBILITIES. The specific services to be provided by OHA under this MOU are as follows: 1. OHA will license a secure, online database known as Oregon Compass. This website enables electronic program registration, data collection/submission, scheduling, and reporting. OHA will provide the approved Delivery Organization representative(s) designated in Appendix B with access to Oregon Compass data entry tools and access to view and report Delivery Organization data. 2. OHA will provide the Delivery Organization with guidance regarding performance indicators for OHA-approved programs, and will invite Delivery Organization representatives to join in periodic, optional meetings via phone or webinar for training on the use of Oregon Compass for quality assurance purposes. 3. OHA will monitor Oregon Compass use and functions. As needed and as possible given funding constraints, OHA will track emerging Delivery Organization needs and request changes or additions to the Oregon Compass vendor to enhance effectiveness of the Compass program (e.g., add additional evidence-based programs, or add data elements or functions to meet Delivery Organization and OHA needs).
OHA RESPONSIBILITIES. OHA hereby delegates authority to administer the following programs to the LPHA: • The Tourist Facility programs in accordance with 446.425. • The Pool/Spa program in ORS 448.005 to 448.090 except for plan review and approval under ORS 448.030 and except for the authority to issue variances under ORS 448.037; and • The restaurant, bed and breakfast facility, commissary, mobile unit and vending machine licensing programs to the LPHA in accordance with ORS 624.510. To enable LPHA to carry out its delegated duties under this agreement, OHA shall: 7.1 Provide training to LPHA staff including at least one annual conference relating to the Food, Pool/Spa and Tourist Facilities programs and one virtual or in-person regional meeting. OHA will cover the costs for these meetings such as registration, room rental, food and beverages, and speaker fees but will not cover LPHA staff travel expenses (e.g. lodging, mileage, per diem beyond meals provided, etc.). 7.2 Provide a statewide licensing and inspection software application for use by LPHAs. OHA will provide support and technical assistance to users of the system. OHA will develop a communication protocol to provide direction on how to request support and technical assistance from contract vendors or FIPP staff. 7.3 Provide at no cost, printed materials required in statute or rule that are necessary to implement the programs and are listed on OHA General Requisition for 34-00A, such as but not limited to handwashing placards, compliance stickers, inspection forms, closure orders and license applications. OHA will consult with the Conference of Local Health Officials (CLHO) or its designee to determine additional printing needs. 7.4 Ensure access to electronic versions of the administrative rules, food handlers manuals and other educational materials. 7.5 Work with CLHO or its designee, using the Four-Factor Analysis adopted by the federal Department of Health and Human Services to determine which forms and documents need to be translated, and which forms and documents will be provided to the LPHA in printed form. In addition to CLHO, work with XXXXX using the following Four Factor analysis to determine which forms and documents need to be translated into other languages and applicable timelines. OHA RESPONSIBILITIES i) OHA shall be responsible for repair of the unit within a reasonable period of time. If the damage was caused by Tenant, household members, or guests, the reasonable cost of the repairs shall be charged to Tenant; ii) If repairs cannot be made within a reasonable time, OHA shall offer the Tenant standard alternative accommodations, if available; iii) In the event repairs cannot be made by OHA and alternative accommodations are unavailable, then rent shall be abated in proportion to the seriousness of the damage and loss in value as a dwelling. No abatement of rent shall occur if Tenant rejects alternative accommodations or if the damage was caused by Tenant, household members or guests; iv) If OHA determines that the dwelling unit is unlivable because of imminent danger to the life, health, and safety of Tenant, and alternative accommodations are refused by Tenant, this Lease shall be terminated. v) If the dwelling unit damage creates conditions that might expose the Tenants to lead-based paint hazards, OHA shall take additional steps to ensure their safety while repairs are being made. Additionally, if OHA relocates the family due to any type of damage, and lead-based paint hazards were being controlled in the family's unit prior to the damage, the temporary unit shall be free of lead-based paint hazards.

OHA RESPONSIBILITIES. 1. OHA will establish procedures to assure, and will provide for, prompt reimbursement of Vendors through normal banking channels for all valid eWIC transactions. 2. As part of the redemption procedure, OHA may make price adjustments to the requested amount on eligible WIC foods to ensure compliance with the competitive pricing selection criteria. OHA may deny payment to the Vendor for improper eWIC transactions, may offset future payments to the Vendor, or require and receive reimbursement from the Vendor for the amounts paid by OHA to the Vendor on improper eWIC transactions and for unsubstantiated quantities of WIC food items. In addition to denying payment or assessing a claim for reimbursement, OHA may sanction the Vendor for overcharges and other errors in accordance with OAR 333-054-0050. 3. When OHA determines that the Vendor has committed a violation that affects payment to the Vendor, OHA will delay payment or establish a claim. OHA may delay payment or establish a claim in the amount of the full purchase of each eWIC transaction that contained the Vendor overcharge or other error. The Vendor shall have an opportunity to provide justification or correction when OHA denies reimbursement for an eWIC transaction or requests payment for an improper eWIC transaction. 4. OHA shall research and provide a response within 10 business days of the receipt of the notification of a payment dispute from a Vendor. 5. All payment disputes shall be resolved within 45 business days of the first notification by either party. Resolution of a dispute completed within the dispute timeframe is final or the initiating party shall be deemed entitled to the claim and the disputed item will be settled 6. OHA will provide the Vendor with training and information on WIC foods, procedures and policies. 7. OHA will notify Vendors of changes to Federal or State statutes, rules, regulations, policies, or procedures governing the WIC Program before the changes are implemented. OHA will provide as much notice as possible. 8. OHA must notify a Vendor in writing when an investigation reveals an initial incidence of a violation for which a pattern of incidences must be established in order to impose a sanction, before another such incidence is documented, unless OHA determines, in its discretion, on a case-by-case basis, that notifying the vendor would compromise an investigation. 9. You are solely responsible for reviewing any default or automated settings and configuring applicable settings to meet all legal, regulatory and other requirements applicable to your business. You will provide NCR Voyix access to your network, system, data, and relevant information as reasonably required to perform the Service. NCR Voyix is entitled to rely upon Customer Instructions.   • COUNTY’S RESPONSIBILITIES A. A County program liaison will monitor the submission of all correspondence required in this Agreement, including, but not limited to: 1. Quarterly Treatment Reports; 2. Financial reports such as annual budgets, cost allocation plans, and cost reports; 3. Incident reports; 4. Outcome data; 5. Monthly XXXXX Reports 6. Other requested reports B. A County program liaison may visit Contractor during the contract term. The visits shall be for the purpose of reviewing any aspect of Contractor’s program operations. The visit may include, but is not limited to: 1. Review all pertinent participant records. 2. Conduct appropriate interviews/discussions with participants served by Contractor. 3. Review and monitor all correspondence and reports submitted by Contractor related to Contractor’s services provided under this Agreement. 4. Meet with appropriate program management and operations staff. 5. Conduct site visit(s) to Contractor’s program(s) at least once during the term of the Agreement to review all aspects of program operations. Site visit(s) may include a review of Contractor’s programmatic and fiscal documentation related to required reports on services specified in the Exhibits. a. Provide a written site review report documenting areas of compliance and any necessary corrective action(s) required. 6. A County program liaison may attend an organized activity of a selected component or selected components of Contractor’s program(s) at least once during the contract term. C. AODS will conduct periodic mandatory treatment provider meetings with representatives of all contracted service providers and appropriate staff. D. Provide ongoing technical assistance as needed. E. AODS shall act as intermediary on behalf of each contracted alcohol and drug service provider in the submission of the California Outcomes Measurement System (CalOMS) data submissions to the State of California. I. GENERAL ADMINISTRATIVE REQUIREMENTS A. Attend each of the following meetings: 1. Contractor shall attend periodic mandatory meetings; and 2. Drug and Alcohol Information System for You (DAISY) User Group meeting. 3. Other meetings as required by the County B. Contractor shall acknowledge the San Mateo County Alcohol and Other Drug Services (AODS) and/or the County of San Mateo as a funding source on newly developed promotional materials. C. Subcontracting requirements: 1. Pursuant to paragraph 12 of the body of this Agreement, Contractor may subcontract for provision of services described in this Agreement with written approval of the Director of the Human Services Agency or her designee. If Contractor subcontracts for any services under this Agreement, Contractor will guarantee that any and all subcontractors have and maintain the same level of insurance coverage required of the Contractor under this Agreement. Contractor and County will be listed as additional insured on all applicable insurance of subcontractor.

  • Specific Responsibilities Without limiting the responsibilities of the Manager, the Manager will: 1. Keep and maintain the financial accounts and records of the Fund and provide the Trust with certain reports, as needed or requested by the Fund. 9. Provide officers for the Trust as requested by the Trust’s Board of Trustees. 10. Perform fund accounting services for the Fund as set forth in EXHIBIT B: FUND ACCOUNTING FUNCTIONS. 11. Generally assist in all aspects of the operations of the Fund.

  • CITY’S RESPONSIBILITIES 2.1. The CITY shall designate in writing a project coordinator to act as the CITY's representative with respect to the services to be rendered under this Agreement (the "Project Coordinator"). The Project Coordinator shall have authority to transmit instructions, receive information, interpret and define the CITY's policies and decisions with respect to the CONTRACTOR's services for the Project. However, the Project Coordinator is not authorized to issue any verbal or written orders or instructions to the CONTRACTOR that would have the effect, or be interpreted to have the effect, of modifying or changing in any way whatever: (a) The scope of services to be provided and performed by the CONTRACTOR; (b) The time the CONTRACTOR is obligated to commence and complete all such services; or (c) The amount of compensation the CITY is obligated or committed to pay the CONTRACTOR. Any such modifications or changes ((a) (b) or (c)) shall only be made by or upon the authorization of the CITY’s city manager as authorized by city council in the enabling legislation or in the CITY’s procurement policies. 2.2. The Project Coordinator shall: (a) Review and make appropriate recommendations on all requests submitted by the CONTRACTOR for payment for services and work provided and performed in accordance with this Agreement; (b) Arrange for access to and make all provisions for the CONTRACTOR to enter the Project site to perform the services to be provided by the CONTRACTOR under this Agreement; and (c) Provide notice to the CONTRACTOR of any deficiencies or defects discovered by the CITY with respect to the services to be rendered by the CONTRACTOR hereunder. 2.3. The CONTRACTOR acknowledges that access to the Project Site, to be arranged by the CITY for the CONTRACTOR, may be provided during times that are not the normal business hours of the CONTRACTOR.

  • Other Responsibilities The Responsibility factors also take account of any responsibility the jobholder may have through the provision of advice and guidance on policies and procedures, research or the adaptation or development of existing or new policies and procedures. An assessment tool has been developed to help ensure that advisory, policy and similar ‘hands off’ responsibilities, such as research or democratic services, are correctly measured and allocated to the appropriate Responsibility factor. It is recommended that jobs are first evaluated on their ‘hands on’ responsibilities under each Responsibility factor and that an assessment is then made of the level of advisory/policy responsibilities and the factor to which it should be allocated.

  • Company Responsibilities In the case of a piggyback registration of Warrant Shares, the Company shall use its best efforts to keep the Holder advised in writing as to the initiation, effectiveness and completion of such registration. At its expense the Company shall: (a) prepare and file a registration statement (and such amendments and supplements thereto) with respect to such Registrable Securities and use its best efforts to cause such registration statement to become and remain effective for a period of 180 days or until the Holder or Holders have completed the distribution described in the registration statement relating thereto, whichever first occurs; (b) furnish such number of copies of a Prospectus in conformity with the requirements of applicable law, and such other documents incident thereto as a Holder from time to time may reasonably request; and (c) use every reasonable effort to register or qualify the Registrable Securities covered by such registration statement under the state Blue Sky laws of such jurisdictions as the Company's Board of Directors may reasonably determine, and do any and all other acts and things which may be necessary under said Blue Sky laws to enable the sellers of the Registrable Securities to consummate the public sale or other disposition of the Registrable Securities owned by them in such jurisdictions, except that the Company shall not for any purpose be required to qualify to do business as a foreign corporation in any jurisdiction wherein the Registrable Securities are so qualified.
