Powers and Duties of the Commission. (a) The commission shall adopt a seal and suitable bylaws governing its management and procedure. (b) The commission has the power to contract and to be contracted with, and to sue and to be sued. (c) The commission may receive for any of its purposes and functions any contributions or moneys appropriated by counties or cities and may solicit and receive any and all donations, and grants of money, equipment, supplies, materials and services from any state or the United States or any agency thereof, or from any institution, foundation, organization, person, firm or corporation, and may utilize and dispose of the same. (d) Upon receipt of recommendations from the advisory committee provided in subsection (g), the commission may provide donations, contributions and grants or other support, financial or otherwise, for or in aid of cultural organizations, facilities or activities in counties which are part of the district. In determining whether to provide any such support the commission shall consider the following factors: (1) Economic impact upon the district; (2) cultural benefit to citizens of the district and to the general public; (3) contribution to the quality of life and popular image of the district; (4) contribution to the geographical balance of cultural facilities and activities within and outside the district; (5) the breadth of popular appeal within and outside the district; (6) the needs of the community as identified in an objective cultural needs assessment study of the metropolitan area; and (7) any other factor deemed appropriate by the commission. (e) The commission may own and acquire by gift, purchase, lease or devise cultural facilities within the territory of the district. The commission may plan, construct, operate and maintain and contract for the operation and maintenance of cultural facilities within the territory of the district. The commission may sell, lease or otherwise dispose of cultural facilities within the territory of the district. (f) At any time following five years from and after the creation of the metropolitan cultural district as provided in paragraph (1) of subsection (d) of article IV, the commission, may borrow moneys for the planning, construction, equipping, operation, maintenance, repair, extension, expansion, or improvement of any cultural facility and, in that regard, the commission at such time may: (1) Issue notes, bonds or other instruments in writing of the commission in evidence of the sum or sums to be...
Powers and Duties of the Commission. Section 1. The powers and duties of the Commission shall include the powers set forth in this Article. Section 2. The Commission may make such contracts, grants, and take such other action as it deems necessary and appropriate to accomplish the general purposes of the organization. The Commission may not contract for the purchase of real estate without the prior authorization of the Member municipalities. Any purchase or contracts made shall conform to the requirements applicable to Minnesota statutory cities. Section 3. The Commission shall assume all authority and undertake all tasks necessary to coordinate, administer, and enforce the Franchise of each Member except for that authority and those tasks specifically retained by a Member. Section 4. The Commission shall continually review the operation and performance of the cable communications system of the Membersand prepare annual reports as required by the Minnesota Cable Communications Board and the FCC. Section 0. Xx the extent allowed by applicable law, Tthe Commission shall undertake all procedures necessary to maintain uniform rates and to handle applications for changes in rates for the services provided by the Grantee. Section 6. The Commission may provide for the prosecution, defense, or other participation in actions or proceedings at law in which it may have an interest, and may employ counsel for that purpose. It may employ such other persons as it deems necessary to accomplish its powers and duties. Such employees may be on a full-time, part-time or consulting basis, as the Commission determines, and the Commission may make any required employer contributions which local governmental units are authorized or required to make by law. The Commission may conduct such research and investigation and take such action as it deems necessary, including participation and appearance in proceedings of State and Federal regulatory, legislative or administrative bodies, on any matter related to or affecting cable communication rates, franchises, or levels of service. Section 8. The Commission may obtain from Grantee and from any other source, such information relating to rates, costs and service levels as any Member is entitled to obtain from Grantee or others. Powers and Duties of the Commission. The Commission, insofar as is permitted by law, shall have the following powers and duties: 3.1 The overall responsibility for and supervision of the construction, operation, maintenance, management, and repayment of indebtedness incurred for the BPWS. Make connections or issue permits for connecting subject to the approval of the Member Municipality in which the connection is to be made; 3.1.4 Provide for the enforcement of its rules and regulations; 3.1.5 In the event of breaks in lines (whether in lines included in the BPWS or lines served by the BPWS) be empowered to shut off water to all or any part of a Member Municipality pending completion of appropriate repairs by the Commission or by the Member Municipality involved to the satisfaction of the Commission; 3.2 To hire its own personnel or in lieu thereof to contract with any of the Member Municipalities or any other municipality or governmental agency or political subdivision for provision of personnel services, use of equipment, use of supplies, etc., and the costs of such contract shall be included in the cost of the operation of the BPWS that shall be assessable against the Member Municipalities in the manne...

Powers and Duties of the Commission. (a) The Commission has the powers and duties to establish a program pursuant to Minnesota Statutes Section 473.384 and/or Minnesota Statutes Section 473.388 in order to (i) provide public transit service; and (ii) contract to provide transit and transit planning services to entities as approved by the Commission. The Commission shall have all powers necessary to discharge its duties. The Chief Executive Officer/General Manager shall perform such other duties and functions as may be required from time to time by the Board. Irrespective of the civil service, personnel or other merit system laws of any of the compacting states, the Commission in its bylaws shall provide for the personnel policies and programs of the Compact. The Commission shall submit a budget to the governor and legislature of each compacting state at such time and for such period as may be required. The budget shall contain specific recommendations of the amount or amounts to be appropriated by each of the compacting states. The Commission shall report annually to the legislatures and governors of the compacting states, to the Midwestern Governors' Conference and to the Midwestern Legislative Conference of the Council of State Governments concerning the activities of the Commission during the preceding year. Such reports shall also embody any recommendations that may have been adopted by the Commission. The Commission may borrow, accept, or contract for the services of personnel from any state or the United States or any subdivision or agency, from any interstate agency, or from any institution, foundation, person, firm or corporation. The Commission may accept for any of its purposes and functions under the Compact any and all donations and grants of money, equipment, supplies, materials and services (conditional or otherwise) from any state or the United States or any subdivision or agency thereof, or interstate agency, or from any institution, foundation, person, firm, or corporation, and may receive, utilize and dispose of the same. The Commission may enter into agreements with any other interstate education organizations or agencies and with higher education institutions located in non-member states and with any of the various states of these United States to provide adequate programs and services in higher education for the citizens of the respective compacting states.
