Professional Council. (A) A physician’s professional council may be organized at a state institution or facility employing more than ten employees, or in the case of Public Health Departments, such councils shall be comprised of up to six physicians in the district. The purpose of the council is to advise the Medical Director or administrator regarding medical policies that govern the institution or facility. The council may meet on a monthly basis at the convenience of the members, provided there is a written agenda prepared in advance and such meetings do not conflict with the council membersprimary responsibilities or emergencies. Attendance at such meetings will be with pay. Such professional council shall exist in addition to any other committee or group within the institution or facility. (B) The council shall consist of no more than six members and not more than one council member may be selected from the same location or work unit. A chairperson will be elected annually from the council members.

Professional Council. 12.1 The Board and the Association recognize that they have a common responsibility beyond their collective bargaining relationship to further the collaborative work of the District. 12.2 In recognition of the Association's interest and professional expertise in educational matters Professional Council will be maintained. 12.3 The Professional Council shall be composed of the President, two, (2) members of the Association appointed by the President, the Superintendent or designee, and two (2) persons designated by the Superintendent. The composition of professional council may be altered by mutual agreement. 12.4 The Professional Council shall meet at the request of the Association President or the Superintendent to discuss and study subjects of concern. 12.5 The Professional Council may recommend the appointment of committees composed of teachers and administrators to study and report on agreed subjects. On completion of the study and a report to the Council on the subject assigned to it, each committee shall be considered dissolved, and once dissolved, no committee shall be reactivated except by mutual consent of the members of the Professional Council. 12.6 The clerical expenses of the Professional Council and its subcommittees shall be shared equally by the Association and the Board. 12.7 Association representatives on the Professional Council may, at Board and Association request, be released from school duties for meetings on the Professional Council without loss of salary or leave days. Members of subcommittees may also be excused at Board and Association request without loss of salary or leave days under the same conditions. Cost of replacement teachers shall be shared equally. 12.8 The Association and the Superintendent or designee shall prepare a mutually agreed upon agenda in advance of the meeting.

The Professional Council shall be composed of the UniServ Director and four (4) members appointed by the Board of Directors of the Association, at least one (1) of whom was a member of the team who negotiated this Contract, the Superintendent and four (4) persons designated by him/her. B. The Professional Council shall meet when requested by either party to discuss and study subjects relating to the school system. C. The Professional Council is empowered to appoint and arrange meetings for committees composed of teachers and administrators to study and report. Upon completion of its study and report on the subject assigned to it, each committee shall be considered dissolved. D. The clerical expenses of the Professional Council and its sub-committees shall be paid by the Board. E. Association representatives on the Professional Council shall be released from school duties for meetings of the Professional Council without loss of salary to hold such meetings during the school day. F. The Professional Council shall have the authority to amend the student teaching program plan including distribution of student teacher monies. G. The Professional Council shall be empowered to approve in-service training programs operated by the Board for salary credit. H. The Professional Council shall act as a negotiating committee, which shall review the administration of the Agreement. Should mutually acceptable amendments be agreed upon, then these amendments shall be subject to ratification by the Board and the Association. The Professional Council shall be empowered to effect relief to resolve special problems pending ratification by the Association Representative Assembly and the Board. In no way is this intended to bypass the grievance procedure.

In addition, the parties shall mutually agree on a seventh (7th) member to Professional Council. 3. Each party shall submit to the other, at least one (1) week in advance, when possible, an agenda covering what they wish to discuss. 4. Should such a meeting result in a mutually acceptable amendment to this Agreement, then the amendment shall be subject to ratification by the Board and the Association. The Professional Council shall be empowered to effect relief to resolve special problems pending ratification.

Any proposed change in assignment, outside of the contractual bidding process, shall be approved by Professional Council. 6. The following terms and conditions will be followed in the event that an irreconcilable situation arises concerning a paraprofessional position. a. The irreconcilable situation has been ongoing, established and referred to the JPA Professional Council. b. Application for relief may be made by either the building administrator and/or the paraprofessional involved to the JPA Professional Council. c. The relief must be recommended by the Professional Council and approved by the paraprofessional, Assistant Superintendent for Human Resources & Secondary Curriculum, and the Association President. d. The paraprofessional will be placed on voluntary displacement allowing the position to be posted. The posting will state that it is a voluntary displacement under Article II - C, 6. e. The senior bidder and the displaced paraprofessional will exchange positions with the exception that the displaced paraprofessional has the right to refuse a position with fewer hours than the one he/she has vacated. f. In the event that there is no bidder or that the senior bidder(s) have invoked their right of return during a trial period under Article IX - F, there will be a written plan put in place prior to the return of the displaced paraprofessional to the original position. This plan shall be subject to the approval of the JPA Professional Council.
Professional Council. The Council’s purpose is to isolate and define problems relating to the school system and to provide increased communications among the Board, Administration, and the NTA. The party indicating a need for the meeting shall prepare the agenda and provide the information for discussion.
Professional Council. In the interest of fostering a positive relationship, the parties agree to establish a Professional Council composed of the Superintendent, Director of Finance, Director of Personnel, the Association President and two (2) designees of the Association. The council will attempt to meet once each month during the school year unless both parties agree not to have a monthly meeting. Professional Council. The Professional Council shall be composed of the President and four (4) members of the Bonneville Education Association, and the Superintendent and four (4) persons designated by the Superintendent.
Professional Council. 7.1. The parties will establish and maintain during the term of this Agreement, a Professional Council. The regular members of the Professional Council shall be the Association President and a maximum of three other Association members and the Superintendent, the Human Resources Director, an instructional director and a maximum of one (1) other District representative. The designation of regular members shall not preclude either party from inviting others to participate in, or consult with, the Professional Council if it is believed that such other persons can be of assistance with respect to the subject or subjects under consideration by the Professional Council. 7.2. The Association agrees that it will attempt to designate, as its representatives on the Professional Council, persons who will fairly represent the various geographic areas and school levels contained within the District. 7.3. It is recognized that there are many subjects relating to the educational process within the District as to which Covered Employees wish to make known to the administration their views and recommendations. It is also recognized that such views and recommendations are of value to the administration and should be solicited and considered. While the comments and assistance of Covered Employees have been sought and obtained by the administration on a wide variety of matters for many years, there has been no single forum for continuing communication between Covered Employees and the administration. The Professional Council is intended to be the principle vehicle through which there will be continuing communication. 7.4. The Professional Council shall meet monthly during the school year, unless the parties agree to a different meeting schedule, to discuss and study subjects mutually agreed upon relating to the school system. It is recognized, however, that the Professional Council cannot expect to have the time to deal individually, or in depth, with each of the subjects as to which it is desirable that there be open and free discussion between the Covered Employees and the administration. It is intended, therefore, to act primarily as a liaison group, to initiate study groups, evaluation committees and the like, to encourage the performance of their work by such study groups and committees, and to receive and consider the reports or recommendations of various committees or other study groups. 7.5. Professional Council. A. The Board and the Association, in recognition of their commitment to discuss and resolve issues and concerns through cooperation and collaboration and to avoid confrontation and adversarial proceedings, shall establish a Professional Council. B. The Council shall be composed of not more than five (5) administrators selected by the Superintendent and not more than five (5) teachers selected by the Association. The Council shall meet at least monthly during the school year at mutually agreeable times. C. Members of the Council shall be trained in the interest-based or collaborative approach to discussing and resolving issues and concerns. D. The Council shall establish ground rules for its meetings consistent with the principles of the interest-based or collaborative approach. The ground rules shall include the following: 1. All decisions shall be made by consensus. 2. Resource people may participate in Council meetings to provide information. 3. Interested or affected parties, i.e. grievant(s), may participate in Council meetings. E. Grievances may be handled by the Council by mutual agreement as provided in Article XV
