REPRESENTATIVE ROLE. The Union shall designate an employee representative at the beginning of the term of this Memorandum of Understanding for the purpose of meeting with the management on terms and conditions of this Memorandum of Understanding and for representing employees during the process of handling a grievance. Reasonable time off work shall be allowed to meet with management, to discuss matters of grievance and/or provisions of this Memorandum of Understanding. Regular Union business meetings shall not be held on District time and District equipment and supplies are not to be used for Union business. District premises can be used or scheduled in advance with management. An employee representative when performing official Union business, as defined above, shall notify his/her immediate supervisor as to when leaving; how much time is to be taken; and when returning. Changes as to the Union representative shall be sent to management at least one (1) week in advance of said change.

Union time bank hours are intended for use by eligible Local 3523 Executive Board members to conduct official union business. 2. Union members will donate a total of 440 hours per year (inclusive of carryover time) of vacation time, holiday time, and compensatory time off (CTO) to a union time bank. 3. The maximum number of hours donated by a union member to the time bank shall not exceed twelve (12) hours per year. 4. Any hours remaining in the time bank on June 30th of each year shall be carried over to the next year. If no hours were used in the previous year and the maximum hours remain in the time bank, no additional donations by members shall be authorized in the upcoming year. 5. During the first full pay period in July each calendar year, Local 3523’s President along with the Executive Board and the Senior AccountantAccounting Manager or designee shall determine the number of hours remaining in the Union time bank. That number shall be subtracted from the maximum number of time bank hours of 440 hours. The difference between the actual number of hours and the 440 hours maximum will be divided by the number of Local 3523 represented employees. Each 56- hour per week employee shall contribute an equal number of leave hours and each 40-hour per week employee will donate 70% of the amount donated by 56-hour per week employees to be debited by the City to maintain 440 hours in the time bank. 6. Only Association officers, directors or bargaining team members may draw from the time bank. b. Requests to use time from the time bank must be made reasonably in advance of the use. Approval is subject to the operational necessity of the departments and normal time off approval processes.

Reasonable time off shall be allowed in order for said representatives to meet with management to discuss grievance matters, negotiable subjects and/or provisions of the Agreement (see ARTICLE 11, Grievance Procedure, C). Regular Association business meetings shall not be held on City time nor may City equipment and supplies be used for Association business unless prior approval has been given by the City Administrator and reasonable and customary expenses are charged accordingly. On-duty personnel are exempt from this proviso except in cases where the employee's attendance at the meeting precludes him/her from meeting normal job productivity expectations. Overtime will not be authorized for the purpose of an employee "catching up" on any work not accomplished as a result of attending subject meetings. Off-duty personnel will not be paid for time attending subject meetings. City premises can be used if scheduled in advance. Employee representatives, when performing official Association business as defined above, shall notify their immediate supervisor as to when leaving, how much time is to be taken, and when returning. (c) Strengthening of the solid waste management system through: (i) the construction of transfer stations; (ii) the improvement of the layout and design of dumpsites/landfills; (iii) the strengthening of the capacity of the stakeholders in solid waste management; and (iv) the increase in communities’ solid waste management awareness. (d) Rehabilitation of existing primary and secondary gravel and dirt roads, including the drainage systems along such roads.
