Return to Work After Leave of Absence. Employees returning from leaves of absence will be reinstated to the same position the employee held when the leave commenced, or in the event that the position has been eliminated to an equivalent position for which the employee is qualified. If no position is available, the employee will be considered to have been laid off.

Return to Work After Leave of Absence. An employee’s return to work from any leave of absence is subject to the employee possessing in good standing all necessary credentials and licenses required for the position the employee is returning to prior to his resuming work. When a leave of absence exceeds three (3) months, or at any other time at the discretion of the Fire Paramedic Chief or designate, the employee will be required to provide a medical certificate from a duly qualified medical practitioner certifying that he is able to perform the normal duties of the position. The medical certificate must be acceptable to the City of Winnipeg Occupational Health Services. At the discretion of the City, an employee may be excused from the requirement to provide a medical certificate. Should elsewhere in this Agreement the conditions upon which an employee returns to work be different than those stated in this section, the conditions stated here will be in addition to those specified elsewhere in the Agreement.
Return to Work After Leave of Absence. Upon the expiration of a leave of absence an employee shall be returned to the position they held at the time the leave of absence was granted, provided the position still exists and the employee has the skills and physical ability to perform the job. The leave of absence shall not be considered a break in service for the accrual of seniority or length of service with the employer. The employer may request a certification from a physician stating the employee is fit to perform their job duties upon return from a leave of absence which was taken for medical purposes. If the same position the employee held prior to the leave of absence no longer exists, the employee shall be placed in any open position in the employee’s former department which the employee is qualified to hold. If no position is available, the employee shall have rights to recall to any open position which comes available for which the employee is qualified for a period of one year from the time the leave of absence commenced. An employee with the physical fitness and capacity and seniority to perform the job shall be returned to whatever position his seniority entitles him.

Return to Work After Leave of Absence. Employees returning from Employer approved paid leaves of absence, disability leave, workers' compensation leave, and military training or emergency duty leave will be reinstated to their former job classification. Employees returning from other leaves of absence shall be offered reinstatement to the employee's former job classification if a position is currently open and available. If there is no position currently open and available in the employee's former job classification, reinstatement shall not occur until a position in the employee's former job classification becomes open and available.   • Return from Leave of Absence (a) Before a Nurse may return to work from a leave granted under Article 9.00, she or he must provide a minimum of four (4) weeks written notice of the specific date of his or her return to work, or such shorter time as mutually agreed.

  • Extended Leave of Absence Professional employees who have attained renewable contract status may request extended leaves of absence for one (1) year without pay under any one of the circumstances listed in this section. All requests for such extended leave of absence will be applied for and granted or rejected in writing. Such application will be reviewed by the principal and superintendent. If the latter approves, he/she will recommend that the leave be granted by the Board. An employee returning from an extended leave will be assigned to the same position as that which he/she held before assuming the leave, providing that position still exists.
