Rights and Obligations of Employees. (a) Employees are responsible for taking the necessary measures to ensure their health, safety and physical well-being. They must also ensure that they do not endanger the health, safety or physical well-being of other persons in or near the workplace.
(b) Employees must observe the rules and reasonable practices established in connection with health and safety matters as means of protecting themselves and others.
(c) An employee must use or wear the equipment, devices or protective clothing which is placed at her disposal by the Corporation or for which she has been paid compensation.
(d) An employee must inform her supervisor if a protective device or apparatus is missing or defective when such a situation might endanger herself or another employee.

Pursuant to the PELRA, nothing contained in this act Agreement shall be construed to limit, impair or affect the right of any employee or their representative to the expression or communication of a view, grievance, complaint, or opinion on any matter related to the conditions or compensation of public employment or their betterment, so long as the same is not designed to and does not interfere with the full faithful and proper performance of the duties of employment or circumvent the rights of the exclusive representative if there be one.; nor shall it be construed to require any BI to perform labor or services against their will. Rights and Obligations of Employees. SECTION 1. Each Employee has the right to form, join, or assist the Union; or to refrain from any such activity freely and without fear of penalty or reprisal; and each Employee shall be protected in the exercise of his/her rights. Such rights include:
a. To act for the Union in the capacity of a Representative; and the right, in that capacity, to present the view of the Union to heads of agencies and other officials of the Executive Branch of the government, the Congress, or other appropriate authorities.
b. To engage in collective bargaining with respect to conditions of employment through an exclusive representative (Union).
SECTION 2. Nothing in this CBA shall require an Employee to become or to remain a member of the Union, except pursuant to a voluntary, written authorization by the Employee for the payment of dues through payroll deduction.
SECTION 3. Employees will be treated with dignity and respect. Sensitive discussions with individuals will be conducted in private to the extent possible.
SECTION 4. There will be no discrimination against Employees with regard to political affiliation, labor organization affiliation or non-affiliation, race, color, religion, national origin, sex, martial status, age, or handicapping condition, and with proper regard for their privacy and constitutional rights.
SECTION 5. Employees:
a. Will perform all assigned duties IAW their position description and performance plan.
b. Will comply with applicable laws, rules and regulations.

The rights described in Sections 1 and 2 of this Article do not extend to participation in the management of a labor organization or acting as a representative of such an organization by a supervisor except as provided in the CSRA, or by an employee when the participation or activity would result in a conflict or apparent conflict of interest or otherwise be incompatible with law or with the official duties of the employee.
Section 4. Each employee, regardless of whether or not the employee is a member of a labor organization, shall have the right to bring matters of personal concern to the attention of the appropriate officials of the Employer and/or the Union.
Section 5. Employees are obligated to:
a. Actively participate in and promote programs designed to improve work methods and conditions;
b. Conscientiously perform assigned duties;
c. Comply with applicable conduct and performance standards;
d. Cooperate and strive to maintain good working relations with their supervisors and fellow employees; and
e. Give a full day's work for a full day's pay.
Section 6. Employees will not engage in, or involve coworkers in, private business or profit- making endeavors while on U.S. Government controlled property or while on official duty time or with the use of U.S. Government property.

The Parties agree to mutually establish and maintain an environment that promotes good workmanship, protects human dignity, encourages common courtesy, assures fair and equitable treatment of employees, and maintains high standards of employee performance.
Section 2. All employees shall have, and shall be protected in the exercise of the right, freely and without fear of penalty or reprisal, to form, join, and assist the Union, or to refrain from any such activity in accordance with the Civil Service Reform Act of 1978 and applicable laws and regulations. In the exercise of this right, employees shall be free from any and all interference, coercion, restraint, and discrimination. Union membership shall not be encouraged or discouraged by any supervisor or Management official. Except as otherwise provided, employees have the right: to act for the National Association of Independent Labor in the capacity of a representative and the right in that capacity to present the views of the National Association of Independent Labor to the head of agencies and other officials of the Executive Branch of Government, the Congress, or other appropriate authorities; and to engage in collective bargaining with respect to conditions of employment through representatives chosen by bargaining unit employees.
Section 3. All employees have the right, regardless of Union membership, to bring matters of personal concern to the attention of appropriate officials in accordance with applicable law, rule, regulation, or established Agency policy.

Section 5. An employee has the right to Union representation if they request such representation at any examination by a representative of the Agency in connection with an investigation if the employee reasonably believes the examination may result in disciplinary action against the employee.

Section 7. The Employer will advise Employees of their immediate supervisor and the line of supervision/chain of command.
