Specific Performance Requirements. 3.1 The provider shall maintain a valid child care license through the Missouri Department of Health and Senior Services/Section for Child Care Regulation (DHSS/SCCR) throughout the entire agreement period. The provider shall notify the Department within two (2) business days if DHSS/SCCR takes any action to suspend/revoke or refuse to renew their license for any reason during the agreement period. The provider shall comply with all licensing rules as established by DHSS/SCCR, and all rules and regulations established by the Department. In the event the DHSS/SCCR takes action to suspend/revoke the provider’s license, the Department reserves the right to terminate the provider’s agreement pursuant to Code of State Regulations, Title 13, Division 35, Chapter 32 – Child Care (13 CSR 35-32) , regardless of whether the provider appeals the decision of the DHSS/SCCR.
3.2 The provider shall comply with Code of State Regulations, Title 13, Division 35, Chapter 32 – Child Care (13 CSR 35-32), as applicable.
3.3 The provider shall notify the Department in writing at least thirty (30) calendar days in advance of any changes in the program that will affect the quality, extent, timelines, or frequency of services delivered under the terms of this agreement and further agrees that no such changes shall be implemented without the prior written consent of the Department. The Department shall not be required to make payment for services rendered according to such changes unless the Department has agreed to the changes in writing prior to their delivery.
3.4 The provider shall submit an Operating Agreement if they are a Limited Liability Company (LLC). The provider shall submit revised Operating Agreements at least ten (10) calendar days prior the effective date of the change, as necessary.
3.5 Child care providers must report the following changes to the Department in writing within ten (10) business days: physical address, mailing address, telephone number, email address, or any other circumstance, incident, or occurrence that would alter any information provided in the child care provider’s original application for contract.
3.6 The provider and all staff shall register with the Department’s designated professional development registry and secure a professional development identifier to complete and track required trainings. Specific Performance Requirements. 3.1 The child care facility applicant shall maintain the following staff/child ratios at all times: Birth through two (2) years shall have no less than one (1) adult to four (4) children, with no more than eight (8) children in a group; Age two (2) years shall have no less than one (1) adult to eight (8) children, with no more than sixteen (16) children in a group; Ages three (3) through four (4) years shall have no less than one (1) adult to ten (10) children with no more than twenty (20 children in a group; and Ages five (5) and up shall have no less than one (1) adult to every sixteen (16) children with no more than forty-eight (48) children in a group.
3.2 The provider will require all employees and volunteers who have direct supervision of children to submit to criminal background screening through the use of fingerprints. All staff and volunteers shall be registered with the Missouri Family Care Safety Registry. All staff and volunteers will meet the requirements pursuant to 210.025, RSMo. When there are new employees or volunteers during the registration period, the new employee(s) or volunteer(s) must be reported to the Department of Social Services and must immediately, but no later than five (5) working days, to comply with the background screening requirement.
3.5 The provider shall maintain a valid Certificate of Registration through the Missouri Department of Social Services, Children’s Division (DSS/CD) throughout the entire agreement period. The provider shall comply with all registration requirements as established by DSS/CD, and all state and federal statutes and regulations. In the event the DSS/CD takes action to revoke the provider’s Certificate of Registration, the Department reserves the right to terminate the provider’s agreement, regardless of whether the provider appeals the decision of the revocation. All child care services must be provided at the physical location as specified on the DSS/CD Certificate of Registration.
3.6 The provider staff shall complete all trainings required by the Department within the timeframes outlined by the Department. The reason this Association is conducting telemarketing, is to earn profits from our activities that can be used for the charitable services which is our primary role. The minimum average performance rate required is calculated to make sure that the activity makes a profit. This is vital as our Constitution does not allow us to spend money on any individuals who are not clients of the organisation. The following minimum criteria will produce the funds required to cover the cost of the employee - ⮚ An employee, on any campaign (i.e. from commencement to draw), must maintain an average of at least $50 per hour net sales (i.e. gross books sold less books returned unpaid before the draw). ⮚ An employee must maintain an average of at least fifty (50) calls per hour over any campaign (i.e. from commencement to draw). ⮚ An employee, on any campaign (i.e. from commencement to draw), must not register more than 10% idle time. ⮚ It is an express condition of employment that every effort is made to forward the customer a donation slip, should a sale not be forthcoming, and that individual sales performance is comparable with the team average. ⮚ An employee must attend at least 95% of rostered shifts unless a medical certificate is produced for the non-attendance within five (5) days of the initial absence. Failure to maintain these minimum criteria will result in discontinuation of employment, and such discontinuation shall be entirely at the discretion of the employer.
Specific Performance Requirements. 3.1 The attorney shall assist the Department to achieve final permanency for children who have been placed in the legal custody of the Department by obtaining a custody order providing for the safety of the child(xxx).
a. The Department will provide payments to the attorney on behalf of the parent to cover certain costs necessary to obtain a final custody order.
3.2 This agreement shall terminate immediately upon receipt of written notification by the Department or the parent of:
a. A change in the permanency plan affecting the issue of custody with parent;
b. Removal of the child from the parent;
c. Change in circumstances of the child(xxx) or parent that would indicate that the parent is not fit, suitable or able to be the legal custodian of the child(xxx);
d. Change in the recommendation of the Department regarding parent as a custodian;
e. Failure to file the required court petition within the required time frame; or
f. Failure to obtain a final judgment and order within a reasonable time of the commencement of the agreement, barring any dilatory delays by attorney.
Specific Performance Requirements. 1. The Consortium and NUWCDIVNPT shall be governed by the terms of this Agreement. Each member of the Team shall be responsible for its own workshare under the UWCV Program and individual Phases which collectively make up the UWCV Program. Figure 2 represents this UWCV Program structure. The UWCV Program is envisioned to cover multiple Phases, each Phase demonstrating an increasing capability applied to a common core USV. Work under this Agreement will be initiated by the receipt of a funding document from a sponsor requesting work be performed in a specific area of the UWCV Program. The funding document will be accompanied by a Task Description Document (TDD) which will provide work specifications, the period of performance. and budgetary data. A sample TDD is attached to this Agreement as Attachment (1). As the UWCV Program is multi phased, over the term of the Agreement additional development phases may be added, and additional TDDs developed as a result. Specific Performance Requirements. In addition to any other requirement mandated by the Agreement:
a. Contractor shall maintain a monthly occupancy rate of 95%.
b. Contractor shall begin filling a vacancy within five (5) days of said vacancy and shall complete filling said vacancy within 30 days thereafter unless otherwise agreed upon by the City.
c. Contractor shall take immediate action on delinquent rents, lease violations, and resident caused damage.
d. Contractor shall respond to routine work requests within three (3) days.
e. Contractor shall respond to HOA requests or inquires within three (3) days.
f. Contractor shall respond to emergencies immediately and complete work within 24 hours unless there are extenuating circumstances.
g. Contractor shall lease units under terms required by the City and enforce said terms.
h. Contractor shall maintain the grounds, common areas, and ensure units are maintained in a decent, safe, and sanitary condition.
i. Contractor shall, within 24 hours, Contractor shall notify City of any police, fire, or health-related emergency activity.
Specific Performance Requirements. 3.1 The provider shall provide child care services to no more than six (6) children, regardless of relationship pursuant to § 210.211, RSMo.
a. Children who live in the caregiver’s home and who are less than five (5) years old, shall be counted in the ratio of 6 children in care. Children who live in the caregiver’s home and who are eligible for enrollment in a public kindergarten, elementary, or high school shall not be considered in the total number of the children being cared for.
3.2 The provider may provide child care services to a maximum of three (3) children under the age of two (2), at the same physical address, but shall not exceed a total of six (6) children as stated in 3.1.
3.3 The provider is the sole caregiver of the children in care and will not engage another person to take over the provider duties as the primary caregiverfor the time the children are authorizedfor care to the provider.
3.4 The provider shall report all household members to the Department of Social Services and all background screening requirements shall be met pursuantto 210.1080, RSMo, and 13 CSR 35- 32.070, as applicable.
3.5 The provider shall maintain a valid Certificateof Registration throughthe Missouri Department of Social Services, Children’s Division (DSS/CD) throughouttheentire agreement period.
