Surplus to School Declaration. (a) Prior to the declaration of school surplus, the Principal shall determine which teachers are to be declared surplus on the basis of seniority and/or program needs as defined in Clause L25.1 (f). Where it is deemed that the needs of the school require the retention of a teacher with less seniority than a teacher declared surplus, the Principal shall provide an explanation to the teacher to be declared surplus and the President of the Local prior to the declaration of surplus. It is understood that a less senior teacher is only retained for program need when there is no one else on staff who is qualified to teach in the area of program need. Teachers may initiate the surplus leave clause at this point.

Surplus to School Declaration a) Prior to the declaration of school surplus, the principal shall determine which members are to be declared surplus on the basis of seniority. The principal shall examine the qualifications of school staff and evidence of successful teaching in other subject areas so as to retain the more senior members by re-assignment whenever possible. Consideration shall also be given to assignment to a subject area by mutual consent in accordance with Regulation 298. Where it is deemed that the curriculum needs of the school require the retention of a member with less seniority than a member declared surplus, the principal shall provide an explanation to the member to be declared surplus and the Bargaining Unit President prior to the declaration of surplus. The principal may involve another administrator at the meeting where the explanation is provided.

The Principal shall examine the qualifications of school staff in specialty areas, as per 13.01.06, so as to retain the more senior Members by re-assignment whenever possible. Surplus to School Declaration. The Superintendent responsible for staffing shall forward to each school the required complement of teachers to be assigned for the next school year. The needs of the program are the first consideration in the determination of school surplus. Save and except staffing considerations occasioned by school closures, the least senior teachers shall be declared surplus to a school. If it is necessary to declare surplus to the needs of a school, the following exemptions shall apply : Teachers within one (1) year of retirement shall not be declared surplus to the needs of a school (one (1) time only). Teachers with less than two (2) years of service in the school as of the end of the current school year shall be exempt from a declaration of surplus to the needs of the school. By May each shall inform each teacher who is surplus to the needs of a school and send the names of all surplus teachers to the Superintendent responsible for staffing to be compiled into a Surplus List, The Superintendent responsible for staffing shall forward a copy of the surplus list to the principal of each school and to the Local.

The DECE with least seniority will be declared surplus to school if the number of staff exceeds the DECE complement assigned to that school. Program needs may require that a DECE with higher seniority be declared surplus to protect program.

Notwithstanding the foregoing, no teacher who has not provided instruction in the French/Special Education programs in the previous five (5) years shall be placed in a vacant position which requires those qualifications. The teacher with least seniority (placement on the Board Seniority List generated according to Article 16.02) will be declared surplus to school if the number of staff exceeds the teacher complement assigned to that school. Program needs may require that a teacher with higher seniority be declared surplus to protect program.
