Surplus to School Declaration. (a) Prior to the declaration of school surplus, the Principal shall determine which teachers are to be declared surplus on the basis of seniority and/or program needs as defined in Clause L25.1 (f). Where it is deemed that the needs of the school require the retention of a teacher with less seniority than a teacher declared surplus, the Principal shall provide an explanation to the teacher to be declared surplus and the President of the Local prior to the declaration of surplus. It is understood that a less senior teacher is only retained for program need when there is no one else on staff who is qualified to teach in the area of program need. Teachers may initiate the surplus leave clause at this point.

Surplus to School Declaration a) Prior to the declaration of school surplus, the principal shall determine which members are to be declared surplus on the basis of seniority. The principal shall examine the qualifications of school staff and evidence of successful teaching in other subject areas so as to retain the more senior members by re-assignment whenever possible. Consideration shall also be given to assignment to a subject area by mutual consent in accordance with Regulation 298. Where it is deemed that the curriculum needs of the school require the retention of a member with less seniority than a member declared surplus, the principal shall provide an explanation to the member to be declared surplus and the Bargaining Unit President prior to the declaration of surplus. The principal may involve another administrator at the meeting where the explanation is provided.
Surplus to School Declaration. 13.03.01 Prior to the declaration of school surplus, the Principal shall determine which Members are to be declared surplus on the basis of seniority. The Principal shall examine the qualifications of school staff in specialty areas, as per 13.01.06, so as to retain the more senior Members by re-assignment whenever possible. Surplus to School Declaration. A Surplus to School teacher is a teacher who has been identified by seniority as being in excess of the requirements of a particular school for the ensuing school year. Each principal shall send the names of all surplus teachers in the school to the Superintendent responsible for Human Resources to be compiled into a Surplus List by April Each Surplus List shall be posted in the Board's First-class E-mail system Information Central) and an electronic copy shall be forwarded to the Bargaining Unit. The Board shall notify, in writing, each teacher who is to be declared surplus. Copies of all letters shall be sent to the Bargaining Unit. The President of the Bargaining Unit shall be provided with all relevant information regarding surplus declarations prior to the declarations. Teachers holding school leadership positions shall not be declared surplus to school but may be declared redundant in accordance with this Article.
