TEACHING ASSIGNMENTS AND TRANSFERS. Section 1. Teachers will be notified in writing of any changes of programs from the prior school year, including the schools to which they will be assigned, the grades that they will teach, any departmental transfers, and any special or unusual classes that they will have, not later than June 1. It is recognized that unusual circumstances may dictate the need for involuntary transfers after that date. Teachers who desire a change in grade and/or subject assignment or who desire to transfer to another building shall file a written statement of such desires with the Superintendent, normally not later than June 1. Such statement shall include the grade and/or subject to which the teacher desires to be assigned or the school to which he wishes to be transferred. Not any later than July 1, the Superintendent shall notify in writing said teachers of the disposition of their request. The President of the Association will be notified by email of positions that become vacant after the close of school in June. A teacher whose transfer request has not been honored will have the opportunity to meet with the Superintendent, if requested, in order to be informed of the reason(s) why the transfer request was not honored. The wishes of the individual teacher requesting a transfer in this respect will receive the fullest consideration, but the educational requirements of the school system and its pupils will be the controlling factor as decided by the Superintendent without recourse to grievance or arbitration. Section 2. In order to insure that pupils are taught by teachers working within their areas of competence, teachers will not be assigned, except temporarily or for good cause, outside the scope of their teaching certificates and/or their major or minor fields of study. Upon written request the Superintendent/designee will provide the Association with the reason for a teacher assignment outside of a teacher's certification. This request will be answered in writing within five (5) school days. This paragraph shall not apply to school nurses. When involuntary transfers are necessary, a teacher's area of competence, major and/or minor field of study, quality of teaching performance, and length of service in the Groton-Dunstable Regional School District will be considered in determining which teacher is to be transferred to comparable positions as far as is reasonably possible. TEACHING ASSIGNMENTS AND TRANSFERS. A. Non-tenure eligible staff members affected by changes in assignment (subject to grade level) shall be notified by the 15th day of August prior to the opening of the school year. Vacancy in position shall be defined as a position presently unfilled. Non tenure eligible staff members shall not normally be assigned outside their teaching field, or subject matter area, except temporarily and for good cause. Temporarily shall be defined as not to extend beyond one year. Changes in assignment for tenure eligible staff members shall be governed by Board policy and corresponding administrative guidelines. B. Vacancies in subjects and grade levels within the system shall be made available by the School District upon written request by the teacher, when vacancies arise or are anticipated. The Superintendent shall notify the Association and post notice of vacancies in each school building no less than (10) school days before the position is filled. Applications of teachers in units affiliated with KCEA/MEA/NEA will be accepted for vacancies. Non tenure eligible positions shall be filled on the basis of experience, competency, qualifications, seniority and other relevant factors such as cost and student enrollment. The process for filling vacancies for tenure eligible positions shall be governed by Board policy and corresponding administration guidelines. C. A transfer is a reassignment of a teacher (bargaining unit member) from one subject area or grade level to another. Involuntary transfers may be affected by the School District. The purpose of the involuntary transfer shall be discussed with the non-tenure eligible staff member at least fifteen (15) days prior to the transfer. These transfers shall be normally made on the basis of the least seniority, but other factors such as qualifications, length of service in subject or grade level areas, shall also be considered. The transfer/teacher placement process for tenure eligible staff members shall be governed by Board policy and corresponding administration guidelines. D. Voluntary transfers may be made at any time a vacancy exists or can be mutually arranged to be filled. Request for voluntary transfer shall be made in writing to the Building Principal setting forth the school, grade, subject area and position sought, with the applicant's qualifications. TEACHING ASSIGNMENTS AND TRANSFERS. A. The Superintendent and Administrator(s) shall make teaching assignments. In making such assignments, the Superintendent and Administration shall consider the teacher's certifications, qualifications, merit, ability (including performance evaluations when available), and relevant experience, in accordance with Illinois School Code. B. Each teacher shall be notified in writing of his/her teaching and other responsibilities, if any, for the coming school year as soon as possible. Said notice may be subject to change when extenuating circumstances warrant. C. When vacancies occur, notice of the vacancy shall be posted. Any qualified District #71 teacher may apply in writing for that position. District #71 teacher applicants shall be notified when the position has been filled. In filling vacancies, the Superintendent and Administration shall consider the teacher’s certifications, qualifications, merit, ability (including performance evaluations when available), and relevant experience, in accordance with Illinois School Code.
TEACHING ASSIGNMENTS AND TRANSFERS. A. In order to assure that pupils are taught by teachers working within their areas of competence, teachers shall not be hired or assigned except in accordance with the regulations of the Department of Elementary and Secondary Education (DESE). B. Teachers shall be notified in writing of any change in their assignments for the ensuing school year as soon as possible, but not later than the end of the preceding school year. No teacher shall be transferred without consent except as provided herein, Article IX, Sections C, D, and E below. C. Teachers pursuing a change in grade, school and/or subject assignments shall provide a written statement of interest with the Superintendent of Schools no later than January 15th. D. In the determination of assignments and transfers, qualifications, convenience, and wishes of the individual teacher will be considered to the extent that these requests do not conflict with the instructional requirements and the best interests of the school system and pupils. E. When the transfer of teachers in the Southborough School System is necessary, those qualified teachers applying in Section C (above) shall be given serious consideration. No involuntary transfer shall occur until the teacher has had an opportunity to discuss the matter with the Superintendent.

Every reasonable effort will be made to notify, by June 1, teachers, other than newly appointed and substitute teachers, of any changes in their programs and schedules for the ensuing year, including the schools to which they will be assigned, and the grades and/or subjects that they will teach, and any special or unusual classes, students or assignments that they will have. B. In order to assure that students are taught by teachers working within their areas of competence, teachers shall not be assigned, except in accordance with the regulations of the State Board of Education and for good cause, to subjects and/or grades or other classes outside the scope of their teaching licensure and/or their major or minor fields of study. C. Teachers who desire a change in grade and/or subject assignment or who desire to transfer to another building shall indicate such desire to the Superintendent in writing not later than March 1. Such indication shall include the grade and/or subjects to which he/she desires to be transferred. The Superintendent or his/her designee shall notify each teacher who has made application for transfer of the disposition of each teacher’s request one week prior to the close of school or as soon as possible thereafter in writing. Should a position become available after March 1, teachers in the system shall have ten (10) days from the posting of the vacancy to request a transfer. Teachers will be guaranteed an interview after submitting their application, provided that the teacher meets the stated qualifications for the position.

Such statements shall include the grade and/or subjects to which the teacher wishes to be assigned and the school or schools to which he/she wishes to be transferred. 4. Teachers are assigned by the Superintendent of Schools. The Superintendent will be guided in these assignments by what, in the Superintendent’s judgment, is best for students, considering the needs of the schools, the training and experience of the teacher and the preferences of the teacher. The preferences of the individual teacher will be considered but shall not be determinative. Any involuntary assignment or transfer shall be made only after a meeting between the teacher involved, a representative of the Association and the Superintendent, at which time the teacher shall be notified of the reasons for this assignment or transfer. 5. In arranging schedules for teachers who are assigned to more than one (1) school, an effort will be made to limit the amount of interschool travel. Such teachers shall be notified of any change in their schedule as soon as practicable. All necessary travel shall be compensated at the IRS mileage reimbursement rate. Driving time is not to be included in the one-half (1/2) hour duty-free lunchtime. 6. Teacher assignments or transfers shall not be made on the basis of age, race, creed, religion, nationality, sex, sexual orientation, gender identity or expression, marital status, or other protected category. 7. To the extent feasible, when transfers are required, volunteers shall be transferred first. 8. When involuntary transfers become necessary, length of service in the school system shall be considered in determining which teacher shall be transferred.

TEACHING ASSIGNMENTS AND TRANSFERS. 7:1 The following transfer and assignment paragraphs apply to all teachers except special area teachers (Art, Music, PE/Health, Library Media), pupil personnel staff and special education teachers: 7:1.1 A “transfer” is defined as the movement of a teacher from one building to another within the school district. The transfer of teachers within the school system is the responsibility of the Superintendent or his or her designee. An “assignment” is defined as the grade level or subject matter taught by a teacher within a single building. The assignment of teachers within a school building is the responsibility of the building principal or his or her designee. “Seniority” shall be defined as a teacher’s length of systemwide services in Middletown beginning with a teacher’s most recent date of hire in the Middletown school system. A teacher shall accumulate seniority from year to year, teaching in any school in Middletown, and a teacher shall not lose seniority because the teacher may have transferred from one school to another or from one position to another.

A teacher shall be assigned only to a staff position for which he/she is or can be certified by the Rhode Island Department of Education and deemed highly qualified in compliance with applicable State and Federal Law. B. Teachers who are resigning shall notify the Superintendent at least thirty (30) days prior to the effective date of the resignation or as soon as possible.

In the cases of unforeseen changes in circumstances prior to the opening of school, assignments may be changed to meet the situation. No teacher shall be normally assigned to areas outside the scope of his/her certification. B. Teachers desiring a change in grade and/or assignment shall file a written statement of such desire with the Superintendent no later than March 1. The statement shall contain the change desired and reason(s) for the change. In determination of assignments and transfers, requested or not, the convenience and wishes of the teacher will be honored to the extent that these considerations do not conflict with the best interest of the school system and pupils. Disposition of requests for transfer shall be made known not later than June 1. C. Reassigned and/or transferred teachers have a period of 10 working days or 14 calendar days, if it occurs during the summer, in which to contest the new assignment to the Superintendent. The Superintendent's decision shall be final. Summer notification of reassignment or transfer will be made by registered mail.
