Withdrawal from the Bank. 1. Catastrophic Leave Bank participants whose sick leave is exhausted may withdraw from the Bank for catastrophic illness or injury. Catastrophic illness or injury shall be defined as any illness or injury that incapacitates a unit member or a member of the unit member's family for over ten (10) consecutive duty days which requires the unit member to take time off work to care for the family member. If a reoccurrence or second illness or injury incapacitates a unit member or a unit member's family within 12 months, it shall be deemed catastrophic after five (5) consecutive days.
2. Unit members must use all sick leave available to them before being eligible to withdraw from the Bank.
3. Unit members applying to withdraw from the Catastrophic Leave Bank will be required to submit a doctor's statement indicating the nature of the illness or injury and the probable length of absence from work. The Committee shall keep information regarding the nature of the illness confidential.
4. In granting of Catastrophic Leave, the Committee shall consider all District compensation available to the employee (e.g. sub differential and income protection) and may grant up to, but no more than, 30 days per year to any individual RVTA member.
5. Leave from the Bank may not be used for illness or disability which qualifies the member for workers compensation benefits unless the unit member has exhausted all worker compensation leave, their own sick leave, and provided further that the unit member signs over any worker compensation checks for temporary benefits to the Employer. If there are any worker compensation checks signed over to the Employer, the Bank will not be charged days, or if charged, will be reimbursed the number of days for which the worker compensation payment is equivalent to a regular day of pay at the negotiated rate for that member. If the Employer challenges the worker compensation claim, the unit member may draw from the Bank, but upon settlement of the claim the Bank shall be reimbursed the days by the Employer.
6. If the Catastrophic Leave Bank does not have sufficient days to fund a withdrawal request, the Committee is under no obligation to provide days and the Employer is under no obligation to pay the participant any funds whatsoever. If the Committee denies a request for withdrawal, or an extension of withdrawal, because of insufficient days to fund the request, they shall notify the unit member, in writing, of the reason of denial.

Withdrawal from the Bank. Based on the operational needs of the Agency, the Agency will permit a reasonable number of AOCE members off for the use of release time bank time. Time drawn from the release time bank shall be in four (4) hour increments. Only the AOCE President and Executive Vice-Presidents may authorize time withdrawal from the release time bank for the purposes of grievance processing and investigation, for conducting training of Association Representatives, preparation for and travel to management-labor meetings, preparation for collective bargaining and other official Association activities within the scope of the PECBA. The leave specified herein shall supplement the leave provided in this Article.
Withdrawal from the Bank. 6.9.3.1 Catastrophic Leave Bank participants whose sick leave is exhausted may withdraw from the Bank for catastrophic illness or injury. Catastrophic illness or injury shall be defined as an illness or injury (based on competent medical evidence) that incapacitates a unit member for over twenty
Withdrawal from the Bank. Catastrophic Leave Bank participants whose accumulated sick leave is exhausted due to personal care for an immediate family member, may withdraw from the Bank for catastrophic illness or injury. Catastrophic illness or injury shall be defined as any illness or injury that incapacitates the participant or an immediate family member for over 9 consecutive duty days which requires the participant to take time off work to care for that family member. If a reoccurrence or a second illness or injury incapacitates a member of the participant’s family within 12 months, it shall be deemed catastrophic after 5 consecutive duty days. Withdrawals for any single illness shall not exceed 185 total days. When a participant is ill or has exhausted his/her accumulated sick leave, a differential pay period of 5 calendar months begins, at that point in time an eligible participant may begin Catastrophic Leave Bank withdrawals.
a) When a participant has exhausted his/her personal necessity leave in any one year, and has a family member who is ill or incapacitated, the participant is eligible to withdraw from the Catastrophic Leave Bank. Said participant agrees to reimburse the Catastrophic Leave Bank for any days withdrawn from the Bank with his/her accumulated sick leave. When the participant’s sick leave is exhausted, the Catastrophic Leave Bank will cover any unreimbursed days up to 185 days per single illness.
Withdrawal from the Bank. 2 Unit members must use all sick leave, but not differential leave, available to 3 them before requesting leave from the bank. Unit members who have 4 exhausted sick leave, but still have differential leave available are eligible for a 5 withdrawal from the Bank. The District shall pay the unit member full pay and 6 the Bank shall be charged one day.
Withdrawal from the Bank. 10.9.3.1 Catastrophic Leave Bank participants, whose sick leave is exhausted, may withdraw from the Bank for catastrophic illness or injury. Catastrophic illness or injury shall be defined as any illness or injury that incapacitates the unit member for over ten (10) consecutive duty days or incapacitates a member of the unit member’s family for over ten (10) consecutive days which requires the unit member to take time off from work to care for that family member. If a reoccurrence or a second illness or injury incapacitates a unit member or member of the unit member’s family within 12 months, it shall be deemed catastrophic after five (5) consecutive duty days. Thus, a participant who used the Bank, after exhaustion of sick leave, for twenty-five (25) days to care for his wife who dies of cancer, and, after returning to work, suffers a heart attack, shall be deemed to have a second catastrophic illness and may again withdraw from the bank after only five (5) consecutive duty days off work.
10.9.3.2 Long term therapy (e.g. chemotherapy, dialysis, physical therapy) shall be treated as a catastrophic illness or injury even though it is not in increments of over 10 consecutive days. All other eligibility requirements will remain in effect. The participant will be eligible for withdrawal on a day-to-day basis.
10.9.3.3 Participants must use all leave as defined in Education Code 44977–78 and 44983, available to them before eligible for a withdrawal from the bank and 80 days of differential pay leave pursuant to Education Code in order to access catastrophic leave.
10.9.3.4 If a participant is incapacitated, applications may be submitted to the District by the participant’s agent or member of the participant’s family.
10.9.3.5 Withdrawals from the Catastrophic Leave Bank shall be granted in units of no more than fifteen (15) duty days. Participants may submit requests for extensions of withdrawals as their prior grants expire. A participant’s withdrawal from the bank may not exceed the statutory maximum period of twelve consecutive months.

Withdrawal from the Bank a: A Sick Leave Bank participant whose cumulative sick leave is exhausted may withdraw from the Bank for catastrophic illness or injury. Catastrophic illness or injury shall be defined as an unexpected extended critical illness, surgery or critical injury of the member or the unit member’s immediate family member which necessitates an absence from work for ten (10) consecutive days or longer. The condition of pregnancy shall not be covered by the Bank. However, medical complications that arise from childbirth shall be considered. (Caesarean deliveries would be considered only if complications occur for mother and/or child.) If a recurrence or a second illness or injury incapacitates a unit member or a member of the unit member's family within twelve (12) months, it shall be deemed catastrophic after five consecutive duty days. Thus, a participant who used the bank, after exhaustion of sick leave, for 25 days to care for a spouse who has cancer, and, after returning to work, suffers a heart attack, shall be deemed to have suffered a second catastrophic illness and may again withdraw from the Bank after only five (5) consecutive duty days off work.

Withdrawal from the Bank. 15.4.4.1 The first ten (10) days of illness or disability must be covered by the unit member’s own sick leave, differential leave, or leave without pay the first time said unit member qualifies for a withdrawal draw from the Bank.
15.4.4.2 If a unit member is incapacitated, applications may be submitted to the Committee by the participant’s agent or member of the unit member’s family.
15.4.4.3 Withdrawals from the Catastrophic Leave Bank shall be granted in units of no more than twenty (20) duty days per school year. Under special circumstances, a unit member may make a request to the Committee for additional days beyond the twenty (20) days.
15.4.4.4 A unit member applying to withdraw or extend his/her withdrawal from the Catastrophic Leave Bank will be required to submit a doctor’s statement indicating the nature of the illness or injury and the probable length of absence from work. (See section15.4.5.
15.4.4.5 Leave from the Bank may not be used for illness or disability which qualifies the unit member for workers’ compensation benefits unless the unit member has exhausted all workers’ compensation leave and her/his own sick leave.
15.4.4.6 If the Catastrophic Leave Bank does not have sufficient days to fund a withdrawal request, the Committee is under no obligation to provide days and the District is under no obligation to pay the participant any funds whatsoever. If the Committee denies a request for withdrawal, or an extension of withdrawal, because of insufficient days to fund the request, they shall notify the unit member in writing of the reason for the denial.
15.4.4.7 Any withdrawal shall become effective immediately upon the exhaustion of the unit member’s sick leave or following ten (10) duty days after the commencement of illness or disability if the unit member has no sick leave.
Withdrawal from the Bank. Any of five (5) designated CCPOA paid representatives or Bargaining Unit 6 representatives may authorize time withdrawal from the release time bank for use of a Unit 6 employee to conduct bona fide Association business. CCPOA shall notify the departments’ labor relations office of the identity of the five (5) representatives by August 1, of each year. Employees authorized may be released with forty-five (45) days' advance notice (as a guideline) for regular, ongoing time off, or forty-eight (48) hours (as a guideline) on an ad hoc basis. In all cases, the granting of time off shall be subject to the approval of the employee's supervisor, operational needs, emergencies or other standards limiting usage. CCPOA authorization for use of bank time shall be provided to the local labor relations officer, or person designated by the Warden/Superintendent/Regional Administrator, by one of the five (5) authorized CCPOA representatives, in writing, on a form provided by CCPOA and mutually approved by the parties. In no case shall the State employer be required to release an employee if:
1. It would require that the State employer fill the released employee's position at time and one-half; or
2. If there is no time credited to the bank at the time of the request. The State employer will permit a reasonable number of CCPOA members off for use of release time bank time. Time drawn from the release time bank shall be in four (4) hour increments for the purpose of travel and eight (8) hour increments for all other purposes. No more than one (1) employee per facility or parole region shall be released for time off unless approved by the Director or his/her designee. The State employer shall not withhold usage of release time bank time for unreasonable or capricious reasons. CCPOA agrees that CCPOA shall not cause, through the application of this clause, the State employer any undue burden in carrying out the mission of the Departments.
Withdrawal from the Bank a. Bank participants whose sick leave and other paid time off, including differential pay if applicable, is exhausted, may withdraw from the Bank for catastrophic illness or injury.
b. Participants must use all sick time and other paid time off, including differential leave if applicable, available to them before becoming eligible to withdraw from the Bank.
c. The first ten (10) duty days of illness or disability must be covered by the participant’s own sick leave, differential leave, or leave without pay the first time the participant qualifies for a withdrawal draw from the Bank. For subsequent withdrawals within twelve (12) consecutive months for any unrelated catastrophic illness, the first five (5) duty days of illness must be covered by the participant’s own sick leave, differential leave, or leave without pay.
d. If a participant is incapacitated, applications may be submitted to the Committee by the participant’s agent or member of the participant’s family.
e. Withdrawals from the Bank shall be granted in units of no more than thirty (30) duty days. Participants may submit requests for extensions of withdrawals as their prior grants expire. In no event shall such requested withdrawal exceed sixty (60) calendar days in any school year.
f. Participants applying to withdraw or extend their withdrawal from the Bank will be required to submit a doctor’s statement indicating the nature of the illness or injury and the probable length of absence from work. Members of the Committee shall keep information regarding the nature of the illness confidential.
g. If a participant has drawn thirty (30) Bank days and requests an extension, the Committee may require a medical review by a physician of the Committee’s choice at the participant’s expense. The Committee shall choose only a physician who qualifies under the District-offered insurance policy. Refusal to submit to the medical review will terminate the participant’s continued withdrawal from the Bank. The Committee may deny an extension of withdrawal from the Bank based upon the medical report.
h. Leave from the Bank may not be used for illness or disability which qualify the participant for Workers’ Compensation benefits unless the participant has exhausted all Workers’ Compensation leave, his/her own sick leave and other paid time off, including differential pay if applicable, and provided further that the member signs over any Workers’ Compensation checks for temporary benefits to the District.
