Work Week Schedules. The Employer may establish, pursuant to an operational need, a “flexible work week” schedule for classes and positions in the California Conservation Corps when assigned to a spike. "Flexible work week” is a work schedule which allows for changing of a regularly scheduled five (5) day week, eight (8) hours a day work schedule to a work schedule of more than eight (8) hours a day but at least forty (40) hours per week.

Work Week Schedules. Work week schedules in conformity with this Agreement shall be furnished to the Union within fifteen (15) days of the execution of this Agreement. Any proposed change in work week schedules shall be furnished to the Union at least fifteen (15) days before the effective date of the change. The Union shall have the right to object to such change and if not resolved with the Employer, may proceed to the Grievance Provision of this Agreement. In the establishment of work week schedules, the Employer shall give preference to Employees in accordance with seniority as far as practicable and consistent with proper nursing home management.

Notwithstanding the foregoing paragraph, during the term of this Agreement the College may make the following limited modifications in work schedules in dining services departments when necessary to meet changing customer requirements and fiscal constraints. Such modifications shall not be made in a manner that establishes split-shift schedules without the consent of the Union nor will management change schedules in any other way that conflicts with the provisions of this Article. The Union reserves the right to grieve the reasonableness of the College’s actions. i. If the College determines that it is necessary to change the start and end time of an employee’s shift, the College will provide the employee (and the Union) at least 30 days prior notice; if requested by the Union, the parties shall meet to discuss the proposed changes within thirty days of providing the notice; the employee’s base pay will not be affected by the change; the start and end of their shifts will not change more than two hours earlier or later; and the change will be neither arbitrary nor unreasonable. Under no circumstances will the start and end time of an employee’s shift change more than once in an academic year without the Union’s consent. ii. Work Week Schedules a. In the establishment of work week schedules, the Hospital will recognize seniority as far as practicable and consistent with proper Hospital management. b. No employee will be required to work more than seven (7) consecutive days in a two (2) week period, provided, however, that employees may work more than seven (7) consecutive days in a two (2) week period by mutual written agreement between the employee and the Hospital. The Hospital agrees to furnish the Union with a copy of such agreement. The Hospital agrees to post work schedules at least ten (10) days in advance except when there are extenuating circumstances. An employee’s shift start/end times cannot be changed without mutual agreement. Posted schedules must indicate actual shift start times. c. Employees shall have two (2) consecutive days off and alternate weekends (Saturday and Sunday) off. If necessary to allow for flexibility in scheduling, nonconsecutive days off during weekdays (Monday through Friday) may be utilized. Employees may, by mutual written agreement with the Hospital, elect to work schedules inconsistent with this paragraph. The Hospital agrees to furnish the Union with copies of any such agreements. d. Upon hire and yearly thereafter, the employer will provide employees with written confirmation of their hours and shift. The employer will attempt to keep changes in starting times to a maximum of twice per year consistent with staffing needs. The employer will meet and confer with employees who will be affected before making a final decision and/or implementing starting time changes. At the discretion of the employee, a union xxxxxxx may be included in these meetings. Any need to change the start time more than twice per year will be discussed in Labor/Management.
