Court Pay. (1) When an off-duty member is subpoenaed to court and so reports, the member shall be paid or credited a minimum of four (4) hours at the member's appropriate rate of pay, unless the court clock-out time is within one-half (½) hour of the beginning of the member’s tour of duty or later. In the latter case, the member shall be paid at a rate of time and one-half (1½) for all hours worked up to the starting time for that tour of duty. (2) Subject to the provisions of Section 22.7(B)(1), where an off-duty member has been issued multiple subpoenas on the same day, the member shall receive a minimum of four (4) hours pay at the member’s appropriate rate of pay for reporting for a morning (a.m.) subpoena or subpoenas and a minimum of four (4) hours pay at the member’s appropriate rate of pay for reporting for an afternoon (p.m.) subpoena or subpoenas, with 12:00 noon beginning the p.m. time period. Where an off-duty member has appeared for court and has not been released by the court and/or clocked out from an a.m. subpoena(s) at the time he/she reports for a p.m. subpoena(s), the above provision shall not apply. In this situation, the member shall receive a minimum of four (4) hours pay at the member’s appropriate rate of pay and shall receive pay at his/her appropriate rate of pay for all hours worked beyond four (4). (3) If the member is notified not to appear in court at least the day before the member is required by subpoena to appear in court, no court pay shall be provided. (4) The following provisions shall apply to members scheduled to appear in court other than during their tour of duty for the day of the scheduled court appearance. (a) A member who receives a subpoena requiring a court appearance after 12:00 noon that does not fall within the member’s tour of duty for the day shall contact the appropriate Liaison Unit for approval to attend. The member shall seek such approval between 11:30 a.m. and 12:30 p.m. on the date of the scheduled court appearance. If the court appearance is cancelled, the officer shall be paid or credited for one (1) hour at the member's straight-time rate. (b) A member whose regular shift is 2:00 p.m. – 10:00 p.m., who makes a court call-in as required and reports to court at 1:30 p.m., will be paid a minimum of one (1) hour at time and one- half (1½) the member’s regular hourly rate of pay. Court Pay. On-Duty - Eligible members subpoenaed to appear on-duty as a witness to any court proceeding connected with official duties shall receive their regular pay providing that all witness fees or pay are returned to the Department. Employees shall report to work when excused if their shift has not ended. Off-Duty - Eligible members required to appear off-duty in any court as a witness for job-related reasons shall be paid for all hours while off-duty and no additional compensation once the employee begins his/her regular duty schedule. If the eligible member’s entire appearance is made while off duty, he/she shall be paid with a minimum of two (2) hours overtime. If the eligible member’s appearance commences while off-duty, but continues into his/her regular duty hours, he/she shall be paid either the actual overtime worked or the $25 witness fee, whichever is greater. In either event, the eligible member shall also receive an hour at the premium rate for duces tecum subpoenas. All witness fees shall be returned to the Department.
Court Pay. The following shall determine employee compensation for court time: A. A minimum of two (2) hours at one and one half (1 1/2) times the employee's regular hourly rate shall be paid to an employee who must attend court at any time other than his/her regularly scheduled hours of employment. B. If a court appearance is cancelled by the Prosecutor and not posted on the Prosecutor’s court status telephone message the employee shall be eligible to receive court pay. Employees shall call the Prosecutor’s Office after 5:00 PM the day before a scheduled court appearance to check the status of their appearance.
Court Pay. Whenever an employee is required to appear during his regular off-duty time before any official court or before a prosecutor on matters pertaining to or arising from the employee’s official duties, the employee shall be compensated for a minimum of two (2) hours at the appropriate hourly rate of pay. If an employee appears before a court or at a pretrial conference for more than two (2) hours, such excess time shall also be compensated at the applicable rate.

Court Pay. ‌ Any represented employee who is required to be in court on off-duty time as part of his/her job duties shall be entitled to pay at the rate of time and one-half (1½) for all court time with a minimum entitlement of three (3.0) hours at time and one-half (1½). In addition, such employee shall be entitled to a maximum of one (1) hour of total travel time at time and one-half (1½) for such court appearance, unless the employee utilizes a City vehicle to travel to court. It is understood that a represented employee who is required to appear in court during his/her shift and who is required to stay beyond the end of his/her shift, shall be entitled to pay at the rate of time and one- half (1½), but shall not be entitled to any minimum number of hours or to any travel time.
Court Pay. Employees required to appear in any judicial or administrative proceeding on official business on their off‐duty time shall be compensated at the rate of time and one‐half their normal rate of pay for a minimum of three (3) hours. Said employee shall be required to assign any court fees received to Town of Auburn.

Court Pay. ‌ C11.01 Where subpoenaed to attend as a witness in any proceeding held before a court or to testify before an administrative inquiry board as a result of the performance of duties for the Employer, outside of normal working hours, an employee shall be paid at the applicable overtime rate for each hour worked with a minimum of three hours.
Court Pay. In the event an employee is required to make an off-duty court appearance, he shall be paid a minimum of two hours at the guaranteed overtime rate of 1 1/2 times his regular base hourly rate of pay. If this off-duty court appearance begins less than two hours prior to the beginning of the employee’s regularly scheduled work hours, the employee shall receive the guaranteed overtime rate in lieu of, not in addition to, his regular base hourly rate for that portion of the guaranteed two-hour period which extends into his regularly scheduled work hours. The employee may designate compensatory time in lieu of court pay up to the accumulation limits set forth in this Contract. Each session of court, morning and afternoon, shall constitute a separate appearance if the employee is required to appear at both. If an employee is required to make a court appearance prior to the end of their shift that requires the employee to exceed the regularly scheduled workday, the employee shall be paid for all hours actually worked. An employee on scheduled vacation who is required to attend court during their regularly scheduled work hours is not entitled to court pay pursuant to this Article. The employee will have their vacation hours reduced commensurate with the amount of time worked. The number of hours of court time paid at the guaranteed overtime rate shall not be counted as hours actually worked for purposes of computing additional regular overtime. Failure of an employee to present for a scheduled court appearance, except in cases of unavoidable circumstances, may result in disciplinary action.
Court Pay. Employees required to appear in court during non-duty hours as a result of their employment as a City Police Officer, shall receive overtime for two (2) hours, or overtime for the actual time spent on the court appearance, whichever is greater. If the employee is required to testify, an additional one (1) hour pay at the overtime rate shall be received. The above applies for each scheduled court case.
