ASSOCIATION RIGHTS AND SECURITY. A. Pursuant to Act 379 of the Public Acts of 1965, the Board hereby agrees that every employee of the Board shall have the right to organize, join and support the Association for the purpose of engaging in collective bargaining or negotiating and other concerted activities for mutual aid and protection. As a duly elected body exercising governmental power under cover of law of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage or deprive or coerce any bargaining unit member in the enjoyment of any of the rights conferred by Act 379, or any other law of Michigan or the Constitutions of Michigan and the United States; that it will not discriminate against any bargaining unit member with respect to hours, wages or any terms or condition of employment by reason of his/her membership in the Association, his/her participation in any activities of the Association or collective professional negotiations with the Board, or his/her institution of any grievances, complaint, or proceeding under this Agreement, or otherwise, with respect to any terms or conditions of employment. B. The Board specifically recognizes the rights of its employees appropriately to invoke the assistance of the Michigan Employment Relations Commission, or a mediator from such public agency. C. The Association and its members shall continue to have the right to use school building facilities at all reasonable hours for meetings, subject to scheduling by the Principal. No bargaining unit member shall be prevented from wearing insignias, pins or other identification of membership in the Association, either on or off school premises. Faculty bulletin boards, school mail, and other established media of communications shall be made available to the Association and its members with the exception of political issues. D. The Board agrees to furnish to the Association all information to which the Association is legally entitled. E. The Association shall be advised of any new or modified millage, bond, or tax programs which are proposed.

The Association shall be provided with bulletin boards, or sections thereof, for the purpose of posting Association materials. B. The Association shall have the right to use school facilities for meetings involving members of the bargaining unit as opposed to meetings involving individuals who are not members of the bargaining unit. Facility use shall be subject to the approval of the Board in accordance with Board policies pertaining to the use of School District facilities. The Association shall also have the right to use School District equipment, provided that express written permission is requested and granted and such request is in accordance with Board policies. The Association shall pay for the cost of all materials and supplies incident to use of its equipment and shall be responsible for proper operation of all such equipment. C. The Association shall be permitted to transact official Association business on school property provided that this does not interfere with or interrupt normal school operations. Association representatives shall check in with the building principal before entering a building to transact official Association business. No school district employee shall engage in Association business during his/her work hours without District approval. D. The Association shall furnish, in writing, to the Board, the names of the President/ designee upon their election or appointment.
ASSOCIATION RIGHTS AND SECURITY. 3.1 The Association shall have, in addition to other rights expressly set forth or provided by statute, the following rights: 3.2 The right to use school building facilities and equipment for Association meetings and activities. 3.3 The Employer agrees to furnish to the Association, in response to reasonable requests, any available information permitted under the Freedom of Information Act. 3.4 The Employer agrees not to discriminate on the basis of race, color, age, national origin, sex, sexual orientation or handicap or union activity in its employment, educational programs and activities as required by Title VI of the Civil Rights Act of 1964, Title IX of the 1972 Educational Amendments and Section 504 of the Rehabilitation Act Amendments of 1973, and as required by the Michigan Elliot – Xxxxxx Civil Rights Act, MCLA 37.2101. Furthermore, the parties agree not to discriminate on the basis of any disability, as provided by the American with Disabilities Act, and the Michigan Persons with Disabilities Civil Rights Act, MCLA 37.1101. 3.5 Authorized agents of the Association shall have access to the Employer's establishment during working hours for the purpose of adjusting disputes, investigating working conditions, collection of dues, and ascertaining that the Agreement is being adhered to, provided, however, that there is no interruption of the Employer's working schedule.

Bulletin Boards and School Mails The Association shall be provided with bulletin boards, or sections thereof, for the purpose of posting Association materials, except that nothing of a derogatory nature toward the employer shall be posted. The Association shall also have the right to use the school mails to distribute Association material. B. Use of Facilities and Equipment The Association shall have the right to use, upon request, school facilities for meetings and school equipment, including typewriters, computers, copiers, other duplicating equipment, calculating machines, and all types of audio-visual equipment when such equipment is not otherwise in use and will not interfere with the normal operation of the District. The Association shall pay for the reasonable cost of all materials and supplies incident to such use and shall be responsible for proper operation of all such equipment.
ASSOCIATION RIGHTS AND SECURITY. The Employer shall provide a bulletin board within each school for the posting of Association announcements, notices, or other matters of business. Such notices or announcements shall not contain material derogatory to the school system, the employer, or the employees. The parties agree that all material placed on the bulletin boards should be provided to the building administrator prior to or at the same time as the posting. The Association shall also have the right to use existing mailboxes to distribute Association material to members of the bargaining unit.
ASSOCIATION RIGHTS AND SECURITY. Section 1: The Association shall have the right to use school facilities and inter-school mail in accordance with guidelines established for other groups and may also use the copy machines. The Association shall pay for reasonable costs of materials used and the use of facilities. As long as such activity does not knowingly violate the Campaign Finance Act.

ASSOCIATION RIGHTS AND SECURITY. The Association shall have, in addition to other rights expressly set forth or provided by statute, the following rights: Section 5.1 As the need arises, meetings will be arranged between the Association and the designated representative of the Board upon request of either party. Section 5.2 The Association will have the right to post notices (subject to review of the building principal) on its activities and matters of support staff concern on bulletin boards located in staff lounges only. The Association shall also have the right to use the school mailboxes to distribute Association materials. The Association agrees to hold the Merrimack School District, Board, and all its agents harmless from any and all claims which may result from the posting and/or placement of any such material. Section 5.3 The Association will have the right to use school buildings at reasonable times for meetings. Request for the use of buildings will be made in writing to the principal in advance. The Association shall, however, pay any additional cost incurred by the Board in granting this use. Section 5.4 The Association may, with permission from the building principal, use school equipment normally used by staff, for Association activities. However, expendable material will be at the expense of the Association. Section 5.5 Duly authorized representatives of the State and National levels of the Association shall be permitted to transact official Association business on school property provided that this shall not interfere with nor interrupt normal school operations. Such representatives will notify the school office of their presence in the building. Section 5.6 Should a meeting be scheduled on working time where a member of the Association may request representation by the Association, such meeting shall be rescheduled before or after working hours. Section 5.7 Rights granted to the Association under this Article shall be exercised in a professional manner. Section 5.8 Under normal circumstances, the employer will consider giving employees a preference for work they have customarily performed, but reserve the right to establish assignments based on the need in the given classified position. Section 5.9 The employer agrees that it will not sub-contract work regularly performed by bargaining unit members if to do so would cause the reduction of personnel covered by this Agreement.
