CONTRACT ADMINISTRATION PHASE. The Contract Administration Phase is the stage in which the Work is performed by one or more Contractors.
CONTRACT ADMINISTRATION PHASE. The design team will administer the project for the City, as related to the plans and specifications developed during the preceding phases. We assume construction will last 12 months with an additional month of project closeout time.
CONTRACT ADMINISTRATION PHASE. The parties agree that the Architect is hereby authorized to do the work necessary to complete the Schematic Design Phase. It is further agreed that Architect Service work on additional phases will only be completed and charged for by the Architect, after written authorization for the services has been given by the Owner.
CONTRACT ADMINISTRATION PHASE. 1.5.1 The Contract Administration Phase will commence with the award of one or more contracts or the issuance of one or more purchase orders and together with the Architect's obligation to provide Basic Services under this Agreement, will terminate when final payment to Contractors or suppliers is due, and in the absence of a final Certificate for Payment or of such due date, sixty (60) days after the date of substantial completion of the Work, whichever occurs first. 1.5.2 The term Contractor, as used herein, shall mean each person or entity awarded a Contract by the Owner, or supplier to whom a purchase order is issued by the Owner, in connection with interior construction, procurement, or installation for the Work. Each such Contractor shall be referred to throughout the Contract Documents as if singular in number and masculine in gender. The term Contractor means the Contractor or the Contractor's authorized representative. 1.5.3 Unless otherwise provided in this Agreement and incorporated in the Contract Documents, the Architect shall provide administration of the contracts for furniture, furnishings, and equipment and the contracts for construction only as set forth below and in the Architect's General and Supplementary Conditions. 1.5.4 The Architect shall be a representative of the Owner during the Contract Administration Phase, and shall advise and consult with the Owner. Instructions to the Contractor shall be forwarded through the Architect. The Architect shall have authority to act on behalf of the Owner only to the extent provided in the Contract Documents unless otherwise modified by written instrument in accordance with Subparagraph 1.5.19. 1.5.5 The Architect shall assist the Owner in coordinating the schedules for delivery and installation of the Work, but shall not be responsible for any malfeasance, neglect, or failure of any Contractors or suppliers to meet their schedules for completion or to perform their respective duties and responsibilities. 1.5.6 The Architect shall visit the Project premises as deemed necessary by the Architect, or as otherwise agreed by the Architect in writing, to become generally familiar with the progress and quality of the Work and to determine in general if the Work is proceeding in accordance with the Contract Documents. However, the Architect shall not be required to make exhaustive or continuous observations at the Project premises to check the quality or quantity of the Work. On the basis of such on-sit...
CONTRACT ADMINISTRATION PHASE. 8.7.1 At the conclusion of this phase: 8.7.1.1 The Construction Contractor will have progressed to having the project substantially complete. 8.7.2 Upon satisfaction of the minimum outputs and deliverables as per Section 8.6.4, the Owner will direct the Consultant as per Section 5.3.4. 8.7.3 Minimum consultant engagement Unless otherwise provided, the Consultant will provide administration of the Contract Documents to the extent provided by the General Conditions of the Contract for Construction, and if applicable, AIA Document A201. The Consultant will review and evaluate tests when necessary, and reviews samples, schedules, scope drawings, and other submissions for conformance with the design concept of the Project and for compliance with the information given by the Contract Documents. The Consultant will prepare change orders and assemble written guarantees required of the Contractors. The Consultant is responsible for providing administration of the contract documents applicable by law, or by further direction of the Owner for construction, including: Site visits and written field reports for each site visit; Certificates for Payment as required to fulfill the Consultant’s responsibilities; Duties as set forth in this Agreement and as required by good practice; and Any observed defects in construction or deviations from the drawings and specifications and any corrective orders given to the Contractor(s). The Consultant shall not have control over, charge of, or responsibility for the construction means, methods, techniques, sequences or procedures, or safety precautions and programs in connections with the Work, nor shall the Consultant be responsible for the Contractor’s failure to perform the Work in accordance with the requirements of the Contract Documents. The Consultant shall be responsible for the Consultant’s negligent acts or omissions, but shall not have control over or charge of, and shall not be responsible for, acts or omissions of the Contractor or any other persons or entities performing portions of the Work. Review of shop drawings or other submittals by the Contractor shall be made for the limited purpose of checking for conformance with information given and the design concept expressed in the Contract Documents. Review of such submittals is not for the purpose of determining the accuracy and completeness of other information such as dimensions, quantities, or performance of equipment of systems, which are the Contractor’s responsibi...
CONTRACT ADMINISTRATION PHASE. .1 The Architect/Engineer shall become familiar with the terms and conditions of the latest edition of the State’s General Conditions of the Construction Contract SC-6.23 for construction and shall administer the Contract for construction in accordance with such terms and conditions. .2 The Architect/Engineer, its structural, mechanical and electrical engineers will visit the site at intervals appropriate to the stage of construction, or as may be otherwise agreed by the Principal Representative in writing to become generally familiar with the progress and quality of the Work to determine in general if the Work is being performed in a manner indicating that the Work when completed will be in accordance with the Contract Documents. Observation may extend to all or any part of the work and to the preparation, fabrication or manufacture of materials. However, the Architect/Engineer shall not be required to make exhaustive or continuous on-site inspections to check the quality of the Work. The Architect/Engineer shall keep the Principal Representative informed of the progress and quality of the Work, and shall endeavor to guard the Principal Representative against defects and deficiencies in the Work. .3 The Architect/Engineer shall attend construction progress meetings to monitor the construction and perform the duties required by this Article 3, including assisting the Principal Representative in reaching an informal partnering agreement with the Contractor. Subject to the requirements of Article 1.2, attendance at meetings subsequently required by such an informal partnering agreement shall be reimbursed as Additional Services but only to the extent in excess of those otherwise reasonably necessary to perform all architectural/engineering services described herein. If, through no fault of the Architect/Engineer, trips to observe construction during the Construction Phase of the Project are required in excess of those reasonably necessary to perform all architectural/engineering services described herein, the Architect/Engineer’s compensation for the Construction Administration Phase shall be adjusted as an Additional Service for the cost to the Architect/Engineer of such trips, and paid in accordance with Article 1.2. .4 The Architect/Engineer shall review and approve or take other appropriate action upon Contractor's submittals such as shop drawings, product data and samples as indicated in the Contract Documents, but only for the limited purpose of checki...
