COURT/JURY DUTY LEAVE. Section 1. An employee who is in off duty status and is required to appear in court in reference to his/her official duties as an employee of the Fire Department shall receive a compensation at one and one half (1.5) times their regular, hourly rate of pay for all the time spent for court duty, plus one (1) hour for travel time.
Section 2. If an employee is required to appear in a court of law for personal reasons, he is expected to take vacation leave, trade time or leave without pay at the discretion of the employee. An employee shall give at least one (1) week advance notice whenever possible for the need of such leave.
COURT/JURY DUTY LEAVE. 6.11.1 In the case of jury duty or court appearance as the result of employment by the Board of Education, no deductions shall be made from the employee's accumulated sick leave or personal leave. Pay for days of such absences will be at the employee's regular daily rate. Court appearance as a result of employment does not include any appearance where the employee is a plaintiff, except as a plaintiff in assault leave under Section 6.11.2.
6.11.2 When an employee is subpoenaed to appear in court for purposes other than as described in 6.11.1, and has exhausted his/her allocated personal leave, sick leave shall be utilized for this situation.
6.11.3 When an employee is subpoenaed by a court to testify as a witness in a proceeding, where the only connection to the legal action is the employee’s exercise of good citizenship in witnessing an accident or crime, the Director of Human Resources shall have the choice of granting "Court Leave" instead of using the employee’s personal leave and/or sick leave.
6.11.4 Any remuneration received for serving as a juror or witness will be disbursed to the Board of Education by the employee, exclusive of parking fees, mileage, and meal expenses.
COURT/JURY DUTY LEAVE. When an employee in the bargaining unit receives a notice to appear before the Jury Commission for examination to serve as a juror, the employee must immediately inform his/her supervisor and forward a copy of the summons to the Director of Human Resources.
1. In the case of jury duty, or court appearance as the result of employment by the Board of Education, no deductions shall be made from the employee's accumulated sick leave or personal leave. 2. When an employee is subpoenaed to appear in court for purposes other than as described in I., 1. and has exhausted his/her allocated personal leave, sick leave shall be utilized for this situation.
3. When an employee is subpoenaed by a court to testify as a witness in a proceeding where the only connection to the legal action is the employee’s exercise of good citizenship in witnessing an accident or crime, the Director of Human Resources shall have the choice of granting “Court Leave” instead of using the employee’s personal leave and/or sick leave.
4. Any remuneration received for serving as a juror or witness will be disbursed to the Board of Education by the employee, exclusive of parking fees, mileage, and meal expenses.
COURT/JURY DUTY LEAVE. An employee who is required to report for jury duty or is subpoenaed to appear before any court, commission, board, or other legally constituted body, where the employee is not a party to the action, shall be entitled to leave with pay for the scheduled work hours lost as the result of such duty. For each hour of such leave taken, the employee will be compensated by the University in an amount equal to his/her straight-time rate of pay less the amount received by the employee from the government for such appearance. An employee who reports for such duty and is excused from duty shall immediately contact his/her immediate supervisor and report for work, if requested. In order to be paid by the University for such leave, the employee must submit to Human Resources written proof, executed by the administrator of the court, of having served the duration of such duty and the amount of compensation received for such duty.
COURT/JURY DUTY LEAVE. An employee who is required to report for jury duty or is subpoenaed to appear before any court, commission board, or other legally constituted body, where the employee is not a party to the action, shall be entitled to leave with pay for the scheduled work hours lost as the result of such duty. For each hour of such leave taken, the employee will be compensated by the University in an amount equal to his/her straight-time rate of pay, as specified in Section H of this Article, less the amount received by the employee from the government for such appearance. An employee who reports for such duty and is excused from duty shall immediately contact his/her immediate supervisor and report for work, if requested. In order to be paid by the University for such Leave the employee must submit to Human Resources written proof, executed by the administrator of the court of having served the duration of such duty and the amount of compensation received for such duty.
COURT/JURY DUTY LEAVE. A. Any employee who is required by law to appear and/or serve as a witness or juror for the Federal Government, the State of Nevada, or a political subdivision thereof, shall be granted administrative leave and shall remain in full-pay status during such leave.
B. The employee shall claim any fees to which he may be entitled by reason of appearance and pay the same over to the Fire District for those days they were scheduled to be on duty, except that the employee shall retain any and all mileage allowance.
C. Employees shall report back to work immediately upon being excused.
COURT/JURY DUTY LEAVE. A. Any employee who is summoned for jury duty shall suffer no loss in pay providing the employee surrenders to the employer any payments or fees received by the employee for such duty or appearance.
B. The Board shall comply with applicable state law regarding leave for employees summoned to appear as a witness before a court in civil, criminal or administrative proceedings.
C. Any employee who is summoned to appear in court on behalf of the Board, in school related matters approved by the Board, shall be granted professional leave.
COURT/JURY DUTY LEAVE. Section 1. Court Leave with full pay shall be granted to any employee who is subpoenaed to appear before any court, Commission, board or other legally constituted body authorized by law to compel the attendance of witnesses, where the matter is work related.
Section 2. Any employee who is appearing before a court or other legally constituted body in a matter in which he/she is a party may be granted vacation time or other leave of absence without pay for purposes of attending the hearing. Such instances would include but not be limited to, criminal or civil cases, traffic court, divorce proceedings, custody, or appearing as directed as parent or guardian of juveniles.
Section 3. The employee shall furnish proof by attaching the court notification to the appropriate time sheet.
Section 4. Jury Duty Leave with full pay shall be granted to any employee who is summoned for jury duty by a court of competent jurisdiction. The employee shall turn in to the supervisor or department head a copy of the summons for jury duty.
Section 5. Any compensation or reimbursement for jury duty or court attendance compelled by subpoena, when such duty is performed during the employee’s normal working hours, will be turned over to the Director of Accounting who, upon receipt of same, will issue the employee’s appropriate compensation.
COURT/JURY DUTY LEAVE. A. Leave for Appearance in Court In case of absence from duty in response to a subpoena or jury summons in a case in court, or in an administrative hearing in which the certified employee is not a part, there shall be no deduction from the salary of the employee provided that the amount of any witness or jury fee or other compensation received by the employee, excluding reimbursement paid to the certified employee specifically for expenses incurred by reason of such subpoena or summons, is paid to the Board of Education. If such payment is not made, full salary for the period of absence shall be deducted from the employee's pay. Amount of fee should be stated on the absence affidavit. In case of absence from duty for any court proceedings or administrative hearing in which the certified employee is a party, no salary shall be paid to the employee for the period of absence, unless the absence is first authorized by the Superintendent. An absence affidavit must be submitted upon return to work.
COURT/JURY DUTY LEAVE. An employee who is in off-duty status and is required to appear in court in reference to his/her official duties as an employee of the Fire Department shall receive a minimum of two (2) hours pay at one and one-half (l- 1/2) time the employee’s regular straight time hourly rate of pay. An employee who is subpoenaed for jury duty will be paid his regular hourly rate during his absence. He will, however, be required to turn over all monies received from the court to the Employer prior to the Employer providing any payment. In the event an employee is released early from jury duty, he will be required to report for work following jury duty. A copy of subpoena shall be submitted at the time of the request for civil leave.
