Jury Duty and Bereavement Pay. Section 13.01 An employee called for jury duty, or subpoenaed as witness in a court Section 13.02 In the event of the death of an employee’s spouse, common-law spouse or or same sex partnership, son, daughter, father or mother the employee will be permitted one (1) week compassionate leave with pay at the employee’s regular straight time hourly rate for the employee’s scheduled hours in the seven (7) day period following the day of the death to a maximum of forty-eight (48) hours. Section 13.03 The Employer will protect the employee against loss of pay during absence due to a death in the immediate family in accordance with the following regulations: a) The term “immediate family” shall include only stepfather or stepmother, stepson or stepdaughter, brother or sister, father-in-law or mother-in-law and grandchildren. b) An employee will be protected under such circumstances against loss of pay during the time lost from the employee’s regularly scheduled work hours at the employee’s regular straight-time hourly rate subject to the following: i) The time to be paid for shall be for three (3) days straight time pay lost in the seven (7) day period commencing from the day of death, which may include days after the funeral. ii) Compensation shall not exceed pay for three (3) times the number of hours in the regularly scheduled work day. iii) In a case under the Article where because of distance or other cause the employee does not attend the funeral of the deceased relative, the Employer shall grant an excused absence from the hours the employee is scheduled for work in the regular work week of one (1) day between the date of death and the date of the funeral and will pay the employee for the scheduled hours not worked during the said one (1) day at the employee’s payroll hourly rate, provided that upon request the employee furnishes the Employer with satisfactory proof of death. Section 13.04 In the event of the death of a grandmother or grandfather, or brother-in-law or sister-in-law or son-in-law or daughter-in-law, or grandparent-in-law, the employee will be permitted one (1) day compassionate leave with pay. Section 13.05 In the event the death of a family member occurs while the employee is on vacation, the vacation may be extended by the applicable number of bereavement days.

Such leave is for the purpose of making arrangements for and or attending the service and shall not be paid for non-working days. It is understood that documentation may be required.

Jury Duty and Bereavement Pay. 19.01 An employee who has attained seniority shall be granted leave of absence with pay at his regular hourly rate, for the normally scheduled number of hours such employee would have otherwise worked except for serving jury duty or appearing as a Crown witness. Such employee shall reimburse the Company to the full amount of jury pay or witness compensation received by him. For the purposes of this clause an employee on jury duty shall be considered as being on day shift. 19.02 In the event of the death of an employee’s spouse or child, the employee who has attained seniority will be granted a leave of absence for a period not exceeding five (5) consecutive shifts with pay. In the event of the death of an employee’s parent, grandchild, sister or brother, mother or father-in-law, the employee who has attained seniority will be granted a leave of absence for a period not exceeding three (3) consecutive shifts with pay. The employee will be allowed to reserve one of these shifts for a spring internment. In the event of the death of an employee’s grandparent, brother or sister-in-law, the employee who has attained seniority will be granted a leave of absence for a period not exceeding one (1) working day with pay. Such leave of absences will only be made for time necessarily lost from work for the purpose of attending the funeral or making funeral arrangements. Should an employee who has attained seniority be called from work advising of a death in the immediate family, such employee will be paid for the remainder of the shift. Bereavement leave must be taken in conjunction with the day of funeral. In the event that an employee is required to travel more than 400 kilometres for the purposes described above, the Company will grant an additional two (2) days’ leave without pay. 19.03 Where the employee who has attained seniority is acting as a pall bearer, one day with pay will be provided to attend the funeral.

  • Jury Duty Leave A regular, limited-term or probationary employee who is called for jury duty or for examination for jury duty shall be compensated at the employee's regular rate of pay for those hours of absence due to the jury duty which occur during the employee's regularly scheduled working hours provided the employee deposits the employee's fees for such hours of jury duty, exclusive of mileage, with the County Treasurer. Fees for jury duty performed during hours other than regularly scheduled working hours may be retained by the employee. Any hours worked beyond the regularly scheduled workday shall be subject to the workweek and overtime provisions (Article I). An employee may request a change in regularly scheduled working hours to a Monday through Friday day shift for the duration of such jury duty. Such requests shall be granted if practicable.

  • JURY DUTY PAY All employees required to serve on jury duty shall be paid by the School District the difference between their regular pay and jury duty pay. In implementing this section, the School District shall continue to pay the employee the regular rate of pay and the employee shall be obligated upon receipt of the jury duty pay from the governmental agency to immediately remit any witness fees received to the School District less any mileage expenses. Absences under this section shall not be deducted from accumulated leave.

  • BEREAVEMENT PAY If an employee suffers a death in the immediate family, he shall be granted compassionate leave of absence with full pay for three (3) days. Immediate family means: spouse, mother, father, brother, sister, children, mother-in-law, father-in-law, grandparents and grandchildren. If the employee affected does not attend or arrange services then he shall only be entitled to one (1) day as provided under this Section.

  • Civic Duty Leave A. Employees summoned for jury duty will be granted a leave of absence with pay for time lost from their regular work schedule while on said jury duty upon presentation of the appropriate summons to the department head by the employee. B. An employee who receives jury fees for jury service upon presentation of the appropriate court certificate of service, shall either: 1. E. All fees for court service except jury fees paid for service rendered during office hours must be paid to the Commonwealth. Any fees paid to an employee for court service performed during a vacation period may be retained by the employee. The employee shall retain expenses for travel, meals, rooms, etc. F. An employee on court leave who has been excused by the proper court authority shall report to his/her official duty station if such interruption in court service will permit four or more consecutive hours of employment. Court leave shall not affect any employment rights of the individual. G. No court leave shall be granted when the employee is the defendant or is engaged in personal litigation.

  • Paid Bereavement Leave An employee who is absent from work due to the death of a member of his/her immediate family (spouse, sibling, child, parent, parent-in-law, grandparent, grandparent-in-law or domestic partner) may use up to three (3) days of paid bereavement leave each school year. Any person holding a permanent position ordered to serve on a jury shall be entitled to his/her regular pay provided the employee deposits his/her fees for service, other than mileage, with the County Treasurer. Whenever any full-time permanent employee is required to be absent from work by a proper subpoena, issued by a court or commission legally empowered to subpoena witnesses, which compels the employee's presence as a witness, unless the employee is a party or an expert witness, the employee shall be allowed the time necessary to be absent from work at the employee's regular pay to comply with such subpoena, provided the employee deposits any witness fees, except mileage, with the County Treasurer.

  • Bereavement Leave (a) Upon the death of an employee's spouse, spouse to include same sex partner, child or stepchild, an employee shall be granted leave up to a maximum of five (5) continuous calendar days without loss of pay. One of the days of leave shall include the day of the funeral or equivalent service. Additional days off with or without pay may be granted by the Employer. Part-time employees will be credited with seniority and service for all such leave. In the event of a delayed interment or ceremony for reason of religion or other protected grounds under the Ontario Human Rights Code, an Employee may save one of the days identified above without loss of pay to attend the interment or ceremony. (b) When a death occurs in the immediate family of an employee, the employee shall be granted leave up to a maximum of three (3) continuous calendar days without loss of pay around the date of the funeral or equivalent service provided that the employee must be regularly scheduled to work such days to receive pay. (c) Immediate family shall be defined as parent, step-parent, father-in-law, mother-in-law, brother, sister, brother-in-law, sister-in-law, daughter-in- law, son-in-law, legal guardian, grandmother, grandfather, and grandchildren. (d) An employee shall be granted one (1) day bereavement leave without loss of pay to attend the funeral, or if there is no funeral, an equivalent service for his or her aunt or uncle, niece or nephew. Where there is a funeral but the employee cannot attend by reason of religion or other protected grounds under the Ontario Human Rights Code, the employee shall be granted one (1) day bereavement leave without loss of pay to attend an equivalent service within a week following the funeral. (e) An employee will not be eligible to receive payment for any period in which she is receiving any other payments. For example, holiday pay or sick pay. (f) Where it is necessary, with as much notice as possible, the employee may apply for personal leave of absence in addition to bereavement leave. Permission for such leave shall not be unreasonably withheld.

  • Bereavement Leave With Pay 26.01 For the purpose of this Article, immediate family is defined as father, mother (or alternatively stepfather, stepmother, or xxxxxx parent), brother, sister, spouse (including common-law partner resident with the Employee), child (including child of common-law partner), stepchild or xxxx of the Employee, grandchild, grandparent, spouse’s parents or any relative permanently residing in the Employee's household or with whom the Employee permanently resides. a) When a member of the Employee's immediate family dies, the Employee shall be granted leave with pay for a period up to five (5) days for purposes relating to the bereavement. In addition, they may be granted up to three (3) days' leave for the purpose of travel related to the death. b) An Employee is entitled to one (1) day's bereavement leave with pay for the purpose related to the death of their son-in-law, daughter-in-law, brother-in-law or sister-in-law, aunt or uncle. c) If, during a period of sick leave, vacation leave or compensatory leave, an Employee is bereaved in circumstances under which they would have been eligible for bereavement leave with pay under paragraph a) or b) of this clause, the Employee shall be granted bereavement leave with pay and their sick leave, vacation leave or compensatory leave credits shall be restored to the extent of any concurrent bereavement leave with pay granted. d) It is recognized by the parties that the circumstances which call for leave in respect of bereavement are based on individual circumstances. On request, the Director of Human Resources and Organizational Effectiveness may, after considering the particular circumstances involved, grant leave with pay for a period greater than that provided for in clauses a) and b) above.
