Leave for Death in Family. 20.1 For employees whose appointment is at the 50% or greater level, the employer will approve up to twenty-four (24) hours (three work days) of compensated funeral leave with pay in cases of death in the immediate family. Supervisors may approve the use of additional time to be deducted from sick leave or vacation leave. Immediate family includes spouse, cohabitors, cohabitor’s parents, children, stepchildren, parents, parents of spouse, and the stepparents, grandparents, guardian, grandchildren, brothers, sisters, or wards of the employee. In addition, with the approval of the supervisor, employees may use sick leave to serve as pallbearers or to attend funerals of individuals not identified above. Supervisors may request documentation supporting the need for the paid absence. ARTICLE 21 -- WAGES

Leave for Death in Family. Employees shall be granted three (3) days with pay, upon request and upon authorization of the division commander, for the death of parent, grandparent, child, grandchild, spouse, brother, sister, step-parent, step-child, mother-in-law or father-in-law. All other leave for death in the family must be taken as vacation leave, if any, and in lieu of vacation time, then unused, accumulated sick leave may be used.

A Registered Nurse will be paid for such days at the Registered Nurse's regular compensation rate. The Employer reserves the right to require proof of death and relationship as a condition of payment under this paragraph. A regular part-time Registered Nurse will receive a pro rata benefit under this section. It is understood that in application of this section, "parent" shall include stepparents, xxxxxx parents and legal guardians. The term "significant other" as used in this section refers to an individual who meets the standards set forth in Mayoral Executive Order 48 of 1993 (the "Domestic Partnership Registration Program") i.e.: Domestic Partners are two people, both of whom are eighteen years of age or older, neither of whom is married or related by blood in a manner that would bar marriage in New York State, who have a close and committed personal relationship, who live together and have been living together on a continuous basis, and who have registered as domestic partners or executed an equivalent affidavit if ineligible to register and have not terminated the domestic partnership.

If an employee is on duty when notified of the death of an immediate family member as defined herein, he may immediately leave his duty assignment but will be charged sick leave for the actual number of hours remaining in his duty day; but the sick leave charged to the employee shall not affect his eligibility for an incentive day off under Article 15. His death leave shall begin the next day.

Leave for Death in Family. In the event of the death of the employee’s mother, stepmother, father, stepfather, brother, sister, spouse, parent-in-law, grandparent, grandchild, child, stepchild or any other person who is an actual member of the employee’s immediate household, an employee will receive paid leave up to a maximum of five (5) days. If a death in the family (as defined in the preceding paragraph) occurs during an employee’s vacation or other scheduled time off, the Leave for Death in Family shall, at the employee’s request, supersede. Vacation days or other scheduled time off may be rescheduled at the discretion of the Department Head.
