Where the conditions between the Crown Employees (Public Service – Conditions of Employment) Reviewed Award 2006 and the Legal Officers, Various Departments Agreement No. 2375 of 1982 differ, the terms and conditions in the latter instrument shall apply

Legal Officers. As a condition of employment, a Legal Officer’s professional conduct shall be governed by the professional code of ethics of the Legal Officer’s Law Society. Should a Legal Officer believe that a request from the Employer would require the Legal Officer to act in a manner which is contrary to his or her professional code of ethics, the Legal Officer and the Employer shall jointly submit the issue to the appropriate Law Society for an opinion. Travel by the Employee on behalf of CAUT must be approved by the Executive Director or his/her designate. Travel expenses are to be reasonable and reimbursed in accordance with the schedule of expenses approved by CAUT Council from time to time for its members. In unusual circumstances, with prior approval of the Employer, an Employee can submit receipts of greater amounts than the approved schedule. Reimbursement for reasonable and appropriate work-related expenses shall be paid upon submission of receipts. CAUT shall make available the sum of $215.00 every year to Employees in Categories 3, 4 and 5 for reimbursement of professional expenses. This sum may be used for the purchase of items such as books, journals, other published works, computer equipment and general supplies, professional memberships and/or for the reimbursement of travel expenses. The use of these funds shall follow normal CAUT procedures and financial controls. Unexpended funds for any year may be carried over. Any item acquired using these funds shall be the property of CAUT and shall be made available for use by other Employees when no longer required by the initial purchaser or upon leaving the employment of CAUT. The Employer agrees to pay all appropriate moving expenses, against bills, if the Employee is required to relocate in order to carry out the Employer's business. The Employee agrees to obtain three (3) quotations and to submit them to the Employer for acceptance. It is understood that the Employer may negotiate with the moving companies for the best possible rate. For the purposes of this Article, "appropriate" expenses shall include (a) the cost of transporting the Employee and his/her immediate family members who are members of his/her household by economy air travel or equivalent, and (b) his/her personal possessions by a licensed moving company or equivalent. Legal Officers. 25.1 An employee is regarded as a Legal Officer where appropriate legal qualifications are a requirement for his or her job. 25.2 The base level for a Legal Officer is an APS6/EL1 broadband. 25.3 Advancement to the EL1 level in the broadband will occur where the employee: (a) is on the pay point immediately below the EL1 level; (b) is assessed as at least met expectations under the Performance Management System; and (c) has demonstrated competency with level work directly associated with native title determinations. 25.4 A Principal Legal Officer is an employee who is required to have appropriate legal qualifications, a reasonable level of experience in the practice of the law and has duties that are consistent with the Work Level Standards of an EL2 or equivalent. 26.1 Advancement to pay point 4 in the EL2 level for employees other than a Principal Legal Officer will be determined by the General Manager based on whether: (a) there is a higher work value than other EL2 positions in the Authority (excluding a Principal Legal Officer); and (b) the employee involved has leadership, managerial, professional and other skills that are beyond those expected of an EL2 position (other than a Principal Legal Officer). 26.2 An EL2 employee may request advancement to pay point 4 and submit information supporting his or her request.
