Management Rights Defined. The Union recognizes, except to the extent Management Rights have been abridged or modified by specific terms and conditions in this Agreement, that it is the exclusive function of management only to: (a) Hire, classify, promote, demote, lay-off, suspend, discharge or otherwise discipline hourly /Owner Operators for just/reasonable cause. (b) Maintain order, discipline and efficiency; and establish and enforce rules and regulations governing the conduct of hourly and Owner Operators, and which will not be inconsistent with the provisions of this Agreement. (c) The right to reduce overtime hours wherever and whenever possible. (d) The right to determine the products to be handled, the methods of handling and processing and related scheduling of personnel and operations. (e) The right to enter into a Business Agreement (Schedule “B”) with, reroute, or terminate the Business Agreement (Schedule “B”) for just cause. (f) The right to assign work by the most economical means available to the Company.

Management Rights Defined. The City, on its own behalf and on behalf of the citizens of Bellingham, hereby retains and reserves unto itself, without limitation, all powers, rights, authority, duties and responsibilities conferred upon and vested in it by the laws and the Constitutions of the State of Washington and of the United States, and by the Charter of the City including, but without limiting the generality of the foregoing, the right: a. To the executive management, organization and administrative control of the City and its properties and facilities, and the activities of its employees. b. To direct the work of its employees, determine the time and hours of operation and determine the kinds and levels of services to be provided and the methods and means of providing those services including entering into contracts with private vendors for services. c. To hire all employees and, subject to the provisions of law, to determine their qualifications and the conditions for their continued employment, discipline, dismissal or demotion; to evaluate their performance; and to promote, assign, and transfer all such employees. d. To establish policies, procedures, goals and objectives to determine staffing patterns; to determine the number and kinds of personnel required in order to maintain the efficiency of City operations. e. To build, move or modify facilities; establish budget procedures and determine budgetary allocations; determine the methods of raising revenue; and take action in any matter in the event of an emergency.
Management Rights Defined. Unless specifically in conflict with this Memorandum of Understanding (MOU), all management rights shall remain vested exclusively with the City. City management rights include but are not limited to, all rights set forth in the City’s Employer Employee Labor Relations Resolution, and each of the following: a. The right to determine the mission of the City, including without limitation the City’s agencies, departments, divisions, institutions, boards, and commissions; b. The right of full and exclusive control of the management of the City; supervision of all operations; determinations of methods, means, locations and assignments of performing all work; and the composition, assignment, direction, location and determination of the size and mission of the work force; c. The right to change or introduce different, new or improved operations, technologies, methods or means regarding any City work, and to contract out for work; f. The right to establish and modify qualifications for employment, including the content of any job classification, job description or job announcement, and to determine whether minimum qualifications are met; g. The right to maintain and modify the City’s Pay and Classification Plan subject tomeet and confer” requirements; h. The right to establish and enforce Employee Performance Standards and Employee Performance Evaluations; i. The right to schedule and assign work, make reassignments and assign overtime work; j. The right to hire, fire, promote, reassign, transfer, release, discipline, layoff, terminate, demote, suspend or reduce in step or grade all employees; k. The right to establish and modify bargaining units and to assign new or amended job classifications to particular bargaining units; l. The right to inquire and investigate regarding complaints or concerns about employee performance deficiencies or misconduct of any sort, including the right to require employees to appear and respond truthfully in good faith regarding any City investigation; and m. Except to the extent expressly abridged by a specific provision of this Agreement, the Employer reserves and retains, solely and exclusively, all of its inherent rights to manage, operate and control the business. B. Without limiting the generality of the above and by way of example, some of the sole and exclusive rights of management include, but are not limited to: 1. Select, test, train, hire, promote, demote, transfer, assign and direct employees; 2. Sell, lease or transfer all or part of the business; 3. Move, transfer or change the location of part or all of the operations; 4. Discipline, suspend, discharge, or relieve employees of duties for just cause; 5. Require physical or other examinations of employees, as it pertains to their job description, at the company’s expense; 6. Make and enforce company rules and regulations; 7. Maintain order and efficiency; 8. Increase or decrease the work force; 9. Pay additional compensation and determine the amount thereof to the employees over and above the hourly rate agreed to herein; 10. Discontinue or relocate any or all portions of the operations now or hereinafter covered or carried out at the premises covered by this agreement; 14. Schedule and reschedule hours including overtime; determine and re-determine job content and any classifications that are required; 15. Determine and, from time to time, re-determine the qualifications of the employees and to maintain safety and efficiency and order; 16. Determine the number of employees assigned to any shift and to adjust unit deployment (system status) plans or eliminate or add units; 17. Make such rules, regulations and deployment (system status) plan adjustments as it may from time to time deem best for the purposes of maintaining order, safety and effective operation of its business and/or compliance with the contractual requirements of its customers; 18. The parties agree and recognize that, from time to time, that as a condition of rental of the Xxxxxx Arena certain customers will require that volunteers perform certain work normally performed by Employees in the bargaining unit.
