Purpose and Principles. ‌ 14.1.1 District and the Union believe it is important to maintain a fair and equitable classification system. Because duties and responsibilities change over time, the parties have agreed to the following system to upgrade and recognize changes which take place. 14.1.2 Reclassification is the process of determining through job analysis whether the current classification, as evidenced in the job description, matches the duties and responsibilities of the position. 14.1.3 Decisions regarding reclassifications shall be based on substantial and permanent changes in the level of duties and responsibilities of the position assigned by the District.

Such temporary assignments are not subject to this Article. 15.1.3 Supervising managers shall not change duties arbitrarily or capriciously while a reclassification request is pending. 15.1.4 When a classification is re-titled, a decision on the equivalent classification for the purposes of determining seniority rights in the classification shall be made at the time of the change and recorded.

Both Parties to the Agreement believe that Uniform Agreement, if adopted by the Unions and the Employers engaged in Heavy and Highway Construction would further the interests of that Industry, and further believe that such a Uniform Agreement should contain the following principles: (a) That there should be no limitations to the amount of work a man shall perform during his working day, it being understood that the xxxxxxx shall perform a fair and honest day’s work. (b) That there shall be no restriction of the use of machinery, tools or appliances except as hereinafter modified by this Agreement. (c) That no person shall have the right to interfere with the workmen during working hours. (d) If any of the Parties of the First Part engage in any class of work not embodied in Heavy and/or Highway Construction as hereinafter defined, then this Agreement is of no force or effect on any such contract. 3. The Employer agrees that he will not discipline or discharge any employee who refuses to cross a bona fide labor union picket line. The right of an employee to exercise this privilege shall not be a violation of this Agreement and shall not subject the Employee to penalties. 4. Purpose and Principles. The primary purpose of the post-tenure review process is to assist faculty members with identifying opportunities that will enable them to reach their full potential for contribution to the university. Such review is intended to provide a longer-term perspective than is usually provided by the annual review process. Each individual faculty member will be assessed seven years after the award of tenure, and reviews will continue at intervals of seven years unless interrupted by further review for promotion. The post-tenure review is in addition to, not in lieu of, annual evaluations. The faculty and the administration of Pittsburg State University recognize the importance of encouraging a culture of continuous improvement in teaching, scholarship and creative activity, and service. Accordingly, evaluation of the performance of the faculty does not cease with the granting of tenure, but continues with formal annual assessments of all components of a professor’s assignment. Tenure is the academic community’s chief guarantee of academic freedom – both the freedom of the teacher to teach and the freedom of the researcher to research without undue or inappropriate external pressures. Thus, it is ultimately a guarantee of the student’s freedom to learn. Nothing in this procedure should be construed as an attempt to alter the contractual relationship between the professor and the university or to alter the nature of tenure as traditionally conceived and legally defined in the American academic community. Nor is this procedure intended as a mechanism for reevaluating or revalidating tenure. Thus, a tenured professor cannot be required to remake his or her case for tenure or otherwise to reassume the burden of proof that he or she bore in the original tenure proceedings. The Parties recognise that: (a) establishing and maintaining transparent intellectual property systems and promoting and maintaining adequate and effective protection and enforcement of intellectual property rights provides certainty to rights holders and users; (b) protecting and enforcing intellectual property rights should contribute to the promotion of technological innovation and to the transfer and dissemination of technology; (c) intellectual property protection promotes economic and _ social development and can reduce distortion and obstruction to international trade; (d) intellectual property systems should support open, innovative and efficient markets, including through the effective creation, utilisation, protection and enforcement of intellectual property rights, appropriate limitations and exceptions, and an appropriate balance between the legitimate interests of rights holders, users and the public interest; (e) intellectual property systems should not themselves become barriers to legitimate trade; (f) appropriate measures, provided they are consistent with the provisions of the TRIPS Agreement (1) and this Chapter, may be needed to prevent the abuse of intellectual property rights by right holders, or the resort to ptactices which unreasonably restrain trade, are anticompetitive or adversely affect the international transfer of technology; and (g) appropriate measures to protect public health and nutrition may be adopted provided they are consistent with the TRIPS Agreement and this Chapter. (1) For greater certainty, "TRIPS Agreement" includes any amending protocol in force and any waiver made between the Parties of any provision of the TRIPS Agreement granted by WTO Members in accordance with the WTO Agreement.

The parties have a mutual interest and respective duties in combating corruption, crimes and/or illicit activities relating to the insurance industry in Hong Kong. Employee(s) and their representatives will be free from restraint, interference, coercion, discrimination, or reprisal in airing a grievance and seeking its adjudication. The Employer and the Union recognize the importance of settling grievances promptly, fairly, and in a manner that will maintain the self-respect of the employee(s) and be consistent with the principles of management. To accomplish this, and because most grievances arise from misunderstandings or disputes that can be settled promptly and satisfactorily on an informal basis at the immediate supervisory level, every effort will be made to settle grievances expeditiously and at the lowest level of supervision.

The Parties shall encourage, develop and facilitate coop- erative scientific and technological activities between the Com- munity and Tunisia in fields of common interest where they are pursuing scientific research and technological development activities. 2. The cooperative activities should be conducted on the basis of the following principles: (a) promotion of a knowledge-based society for the benefit of the economic and social development of the two parties; (b) mutual benefit based on an overall balance of advantages; (c) reciprocal access to activities under the scientific research and technological development programmes and projects (hereinafter research) undertaken by each party in the fields covered by this Agreement; (d) timely exchange of information which may affect coopera- tive activities; (e) appropriate protection of intellectual property rights.
