Selection and Assignment. A. The College shall post openings for full and part-time permanent positions for a minimum of ten (10) working days. Such postings will be done in a timely manner and will list the relevant minimum requirements for the position. The College reserves the right to only post positions internally (for promotional purposes). A copy of the job posting will be forwarded to the Union Xxxxxxx.
B. The College may choose to appoint a temporary employee, as outlined in 7.1.C, without posting for the position.
C. Selection of candidates for open positions shall be determined with consideration being given to seniority, test scores, recommendations, experience, and evaluations. Special consideration will be given to employees covered by this bargaining unit who are qualified for open positions.
D. If an employee at the College who is seeking a promotion is passed over, he/she will, upon request, receive within ten (10) working days a written notification of the reasons why he/she did not receive the position.
E. This section shall not supersede the management right to hire applicants from outside the College whose qualifications are demonstrably superior to all applicants from within the College or when such hiring is directly related to implementing the College's Affirmative Action Plan.
F. Employees who have been promoted or voluntarily transferred shall be required to serve a sixty (60) work day trial service period. The employee will receive the pay rate for the position during the trial service period. In the event the requirements for the new position are not met, or the supervisor or the employee feel a personality conflict may exist, the employee may be or may request to be returned to his/her original position, or the next available similar position and/or classification and pay. The employee will continue to serve in the new position and will receive the pay rate for that position until he/she is returned to the original or similar position.
G. All employees shall be notified of hours and work assignments as soon as decisions have been made by the College. Every effort will be made to notify employees as early as possible.

Lessee will select the type, quantity and Supplier of each item of Equipment designated in a Schedule, and Lessee hereby assigns to Lessor all of its right, title and interest in and to the related equipment purchase agreement, a copy of which has been provided to Lessor by Lessee (the "Agreement"). The Agreement may be amended with the consent of Lessor. Any such assignment with respect to Equipment shall become binding upon Lessor when Lessor and Lessee have entered into a Lease with respect to such Equipment and as of the Rent Commencement Date referenced in such Lease. Upon such an assignment becoming effective, Lessor shall be obligated to purchase the Equipment from the Supplier in accordance with the provisions of the Agreement. It is expressly agreed that Lessee shall at all times remain liable to Supplier under the Agreement to perform all duties and obligations of Lessee thereunder, except for the obligation to purchase the Equipment to the extent expressly assumed by the Lessor hereunder, and that the Lessee shall be entitled to the same rights of the purchaser of the Equipment under the Agreement, except such right, title and interest in the Equipment retained exclusively by the Lessor as owner of the Equipment. Lessor shall have no liability for a Supplier's failure to meet the terms and conditions of the Agreement.

2) Members may indicate their interest to the posting in writing to the Superintendent or designee.
3) The final selection and assignment will be made jointly by the HEA President and Superintendent.
4) The mentor teacher and resident educator shall be from the same subject/grade level/building whenever possible.
5) One mentor teacher shall be assigned to each resident educator whenever possible.
6) The mentoring assignment is a one-year assignment.

The parties acknowledge that the SRO shall be a full-time regular police officer of LPD with the training and certifications necessary to serve in such capacity, and that a single employee of City satisfying these criteria shall perform all of the SRO duties required by this Agreement. The SRO shall, at all times relevant to this Agreement, remain an employee of City and LPD and shall be subject to terms and conditions of employment established by City and any applicable labor agreements. It is the express intent of the parties that nothing contained herein shall be deemed to create an employer-employee relationship between School and City, or between School and the SRO. Instead, it being the express intent of the parties that City and School shall be contracting as independent parties. The SRO shall at all times remain under the principal supervision of the Lebanon Police Chief (or his/her designee) of LPD and in the event of any conflict between the directions issued by the LPD Police Chief and a School representative, the directions issued by the Police Chief or his/her designee shall always prevail. Only City and LPD may discipline the SRO. Notwithstanding the foregoing, both parties shall collaborate in the selection of the SRO, including replacements in the event of resignations, retirements, or other personnel changes and both parties may terminate this Agreement in the event a suitable SRO cannot be jointly identified. In the event such collaborative efforts fail to result in the identification and selection of a SRO acceptable to both parties, this Agreement shall be deemed null and void and of no further force and effect with respect to future activities hereunder. Either party may request the assignment of a different SRO for good cause, violations of applicable rules or regulations, or when otherwise in the best interests of School, its faculty, staff or students, or those of LPD or City. Absent circumstances requiring immediate action, contemplated personnel transitions should be timed so as to be ready for approval in the month of March. In the event of a transition in which the successor is in need of the training and certifications necessary to serve as a SRO, such training should ideally take place during the summer recess between school years.
