SENIORITY AND STAFF REDUCTION. Seniority
20.1 Seniority shall denote the period during which the teacher has been continuously employed by the Centre for Education or its predecessors.
20.2 Seniority shall continue to accumulate:
(a) during a teacher’s absence as described in Regulations under the
(b) during a leave of absence without pay provided the leave is not more than one (1) year;
(c) in all other cases for which a professional agreement between the Union and the Centre for Education expressly provides;
(d) during the period provided for a maternity leave, parental leave; and
(e) during an educational leave with pay.
20.3 Seniority is lost and the teacher’s name is removed from the list for any one of the following reasons:
(a) resignation of the teacher;
(b) the dismissal which remains uncontested or is confirmed pursuant to the applicable grievance process;
(c) in the case of a probationary teacher when the teacher is dismissed because the Centre for Education so chooses and not for reasons of staff reduction; and
20.4 Seniority lists shall be established as follows:
(a) A seniority list showing the names and seniority status of all permanent contract teachers employed by the Centre for Education shall be prepared by the Centre for Education and the Union. After consultation with and approval by the Executive of the Union, a copy of the seniority list as finally approved shall be initialled by the President of the Locals and the Director of Human Resources. The approved list shall be forwarded to the RRC. Such list shall be conclusive evidence of the seniority of permanent contract teachers employed by the Centre for Education, and the said list shall be revised every year.
(b) A list showing the names and years of service of all probationary teachers employed by the Centre for Education shall be prepared by the Centre for Education. This list shall be revised every year. Following approval by each local Union executive, the seniority list shall be forwarded to the Strait RRC. Nothing in this clause shall affect the probationary status of a teacher being that a probationary teacher is retained at the pleasure of the Centre for Education and may be dismissed without cause.
(c) Teachers shall be placed on the respective seniority list in accordance with the provisions of Article 20.
20.5 Any change in legal structures of a Centre for Education shall have no effect on the seniority of a teacher who was in the employ of a Centre for Education at the time of such change. The seniori...

11.01.01 Company Seniority - will date from the first day of work in any position with the Company.
11.02 Union Seniority - will date from the first day of work (including training) in any classification covered by this Agreement. There will be two (2) separate classifications
11.02.01 In cases where two (2) or more employees have the same Union seniority date, the sequence of seniority will be determined by the application of the following in the order stated:
11.02.02 Company seniority date.
11.02.03 Social Insurance Number, using the last three (3) digits, the lower number being the more senior.
11.02.04 By lot, in a manner mutually established by the Company and the Union.
11.03 Separate Seniority lists will be published for Passenger Service Personnel and Special Service personnel.
11.04 Seniority Lists - will be prepared, corrected, amended and published in the following manner.
11.04.01 Not later than March 30 and September 30 each year, the Company will post on each bulletin board complete Seniority lists for each classification described in Article 4. These lists will show for each employee listed thereon, in order of Union seniority, the
11.04.02 It will be the responsibility of each employee to examine the list and make written request for any correction during the twenty-one (21) calendar days following posting. The request will be forwarded to the Company in accordance with the instructions included on each Seniority list with a copy to the Union Local.
11.04.03 All requests for corrections will be acknowledged and will be actioned after consultation with the Union within thirty (30) calendar days of receipt. Any corrections will become effective immediately and will be incorporated in the next posted seniority lists.

These lists will show for each employee listed thereon, in order of Union seniority, the employee number, name, status, Company seniority date, Union seniority date and sequencing determinant described in Article 11.02.02.

11.05 Maintenance of Seniority - Seniority will be maintained and accumulated except as provided for in the following.
11.05.01 The following will result in the loss of the employee's seniority, removal of their name from the seniority lists and termination of employment rights.
11.05.01.01 When the employee is discharged for just cause and is not reinstated through the grievance and arbitration procedures provided for in this Agreement.
11.05.01.02 When the employee voluntarily leaves the Company or is considered to have resigned pursuant to the provisions of this Agreement.

SENIORITY AND STAFF REDUCTION. A. Seniority shall be the total accumulated time of service from the most recent date of appointment to a position in this bargaining unit. The parties shall adopt the past practice for determining seniority by utilizing the date of hire and then adding any ESRP credit an employee may have.
B. Unit members who are transferred or promoted to a position which is classified as confidential and DAEOE-Related and are receiving a DAEOE-Related salary shall continue to accrue their bargaining unit seniority while in such position(s).
C. Except where conditions arise beyond the District's control, in the event a staff reduction is necessary, the following procedure shall be adhered to:
1. The Union shall be notified on or before the date of the layoff letter.
2. Employees (including those working less than 12-months) to be released shall be notified in writing at least ten (10) calendar days prior to their release with copies sent to the Union.
D. If a reduction in staff is necessary in determining which employees are to be retained, an employee with greater bargaining unit seniority shall be given preference.
E. When filling vacancies which occur after a reduction in staff, employees who have been released shall be recalled in accordance with their bargaining unit seniority. Bargaining unit members who are reclassified as a result of a staff reduction may be reclassified at the District’s discretion to a vacancy at a classification equivalent to their prior status by seniority.
F. Employees laid off through the procedure as stated above shall be maintained on a recall list for a period of two (2) years from the date of layoff. Employees’ lay off letter shall include this language
