Workers' Compensation Benefit. 13.1 (a) Effective on the date of execution of this Agreement, employees with Attendance Rules coverage who are necessarily absent from duty because of an occupational injury, disease or condition as defined in the Workers’ Compensation Law shall be eligible for a Workers’ Compensation Benefit as modified in this Article. This Article does not diminish employees’ rights under the Workers’ Compensation Law. Determinations of the Workers’ Compensation Board regarding compensability of claims shall be binding upon the parties.
Workers' Compensation Benefit. Injury–on-duty leave with pay shall be granted for the one (1) day or less not covered by the Workers
Workers' Compensation Benefit. Employees shall receive directly from the Workers' Compensation Board any wage loss benefits to which they may be entitled. While an employee is in receipt of WCB wage-loss benefits, paid holidays and vacation will not accrue. However, unused vacation credits accrued in previous years shall not be lost as a result of this Article. In addition, Article 24 will continue to apply to employees who are entitled to receive WCB wage-loss benefits. The provisions shall also continue to apply to employees who are receiving WCB benefits other than wage-loss benefits pursuant to Sections 29 or 30 of the Workers Compensation Act, so long as the employee is otherwise entitled to benefits under those sections of the Workers Compensation Act. Where an employee has been granted sick leave and is subsequently approved for WCB wage loss benefits for the same period, the employee shall ensure that WCB shall reimburse the Employer for all monies paid as sick leave and any sick leave credits used shall be reinstated to the employee upon full repayment. Employees qualifying for Workers' Compensation coverage shall be continued on the payroll and shall not have their employment terminated during the compensable period up to twenty-four (24) months. Such employees shall be considered as being on an unpaid leave in accordance except that seniority shall continue to accrue based on regular hours.
Workers' Compensation Benefit. When a member is absent from duty and is receiving benefits awarded by The Workplace Safety and Insurance Board, the member shall receive the difference between regular pay and the amount of the award for the maximum of one (1) year, or until such time as the member ceases to be on salary from the Board.
Workers' Compensation Benefit. 16.01 Where an employee suffers from a disease or illness or incurs personal injury and the employee is entitled to compensation therefore under the Workers’ Compensation Act, the employee shall be compensated as follows:
(a) Casual employees claiming Workers’ Compensation benefits will be placed on leave without pay at the end of the shift they were working at the time of injury. WorkSafeBC will pay benefits directly to the casual employee.
(b) Permanent employees claiming Workers’ Compensation leave will be placed onto WorkSafeBC payroll status beginning the day or shift after they cease work subject to the following:
(i) Because the Employer will be paying the employee, any wage loss benefits received from WorkSafeBC will be paid to the Employer.
(ii) During the adjudication period by WorkSafeBC permanent employees may receive pay equal to that provided by WorkSafeBC (e.g. ninety percent (90%) of net) only for the number of days equal to their paid sick leave, vacation and banked overtime entitlements. This will be done provided that the employee gives written pre-authorization for the Employer to deduct time from paid entitlements should WorkSafeBC deny the claim. Otherwise, the employee will be on a leave of absence without pay.
(iii) If a permanent employee’s claim is accepted by WorkSafeBC, there will be no debit of the employee’s paid entitlements.
(iv) If a permanent employee’s claim is denied by the WorkSafeBC adjudicator, the employee’s paid entitlement will be debited to cover the time off work.
(v) If a claim is subsequently accepted due to appeal, the appeal decision will be implemented at that time, and the employee’s entitlements will be reimbursed to their appropriate accounts (e.g. sick leave).
Workers' Compensation Benefit. An employee who is on authorized occupational disability leave shall be eligible to receive Workers' Compensation benefits as follows:
1. Day one (1) through day fourteen (14) - salary to be coordinated with Workers' Compensation benefits. Employees will receive a combination of Workers' Compensation benefits and City salary supplement equal to the employee's net take-home pay in effect at the time of the injury. In no event shall the total of Workers' Compensation benefits and the salary supplement received from the City equal more than the employees net take-home pay in effect at the time of injury. The Human Resources Director may extend this period of full compensation if the worker’s compensation insurance provider has been unsuccessful in scheduling the employee’s first appointment during this period.
2. Day fifteen (15) (unless delayed pursuant to Section 1 above) to the end of Workers' Compensation Benefits - employee will receive a combination of Workers' Compensation benefits and a City salary supplement equal to seventy-five percent (75%) of the employee's net take-home pay. In no event shall the total of Workers' Compensation benefits and the salary supplement received from the City under this paragraph equal more than seventy-five percent (75%) of the employee's net take-home pay in effect at the time of the injury. Employees may utilize sick leave, vacation leave or any other leave time they have accumulated to supplement their pay under this section up to a maximum of one hundred (100%) of the employee's net take home pay in effect at the time of sickness/injury.
3. Any member injured while taking “Active On-Duty Action” as defined in Section 19.4 below, shall be entitled to and receive, for a period of up to ninety (90) days following the date of injury, the member’s full pay and benefits. Following the above noted ninety (90) day period, the injured member will receive seventy-five percent (75%) of the employee’s net take home pay prior to injury, which shall continue until Worker’s Compensation Benefits terminate. During this period of time, members will not experience a reduction in benefit levels, that are presently enjoyed by active employees, nor shall the salary supplement and Worker’s Compensation benefit exceed a hundred percent (100%) and/or seventy- five percent (75%) of the employees net take home pay prior to injury. Workers' Compensation Benefit. All payments of disability pension benefits under this Article VI shall be subject to deduction of Workers' Compensation Benefits paid under Nebraska Workers' Compensation Act, as provided in Section 13.7. If a Participant accepts a lump sum settlement in lieu of all or part of the periodic benefit payable as Workers' Compensation Benefits, such periodic payments will, for purposes of determining the monthly disability pension hereunder, be considered to continue for the applicable number of months by dividing the lump sum received by the monthly equivalent of such periodic payments, and such equivalent payment will reduce the monthly disability pension otherwise payable under this Article VI.
Workers' Compensation Benefit. (a) Employees shall receive directly from the Workers’ Compensation Board (WCB) any wage loss benefits to which they may be entitled.
(b) While an employee is in receipt of wage loss benefits, paid holidays will not accrue.
(c) An employee will be entitled to use accrued sick leave credits while waiting for WCB benefits to be approved. An employee shall reimburse the Employer for any sick leave paid to them at such time as WCB benefits are received. Upon reimbursement, the Employer will adjust the employee’s sick leave bank in accordance with the reimbursement.
Workers' Compensation Benefit. An employee prevented from performing their regular work with the Employer on account of an occupational accident that is recognized by the Workers' Compensation Board (WCB) as compensable within the meaning of the Act, will receive directly from the Workers’ Compensation Board any wage loss benefits which they may be entitled.
Workers' Compensation Benefit. Employees who are injured while in the service of the Town of Salem are eligible for workers’ compensation benefits.
1. The employee shall receive 70% of his pay from the date of injury through week fifty-two (52) of disability. Gross pay shall be calculated in accordance with RSA 281- A:15 and the New Hampshire Department of Labor formula as written in 1990.
2. The first several weeks are adjustment weeks for payment. During the initial period, the Town will continue to issue the employee a check for his/her base weekly salary. The employee must sign over any workers’ compensation checks to the Town during this adjustment period.
3. Upon the acceptance of the claim by workers’ compensation insurance and the issuance of structured payments by the carrier, the Town will no longer issue base salary payments.
4. When the employee receives regularly structured weekly payments, the Town will issue supplemental payments to bring the total payment to the employee to 70% of his/her gross pay.
5. In the event that the workers’ compensation check is greater than 70% of gross pay, the employee shall keep the entire check.
6. In the event that the workers’ compensation check is less than 70% of gross pay, the Town will issue a separate check for the difference making deductions for F.I.T., FICA and voluntary deductions as approved by the employee.
7. Although employees are not permitted to make contributions based on workers’ compensation benefits, any employee who receives weekly workers’ compensation benefits under RSA 281-A will be entitled to New Hampshire Retirement System (NHRS) creditable service for a period of up to one (1) year at no cost to the employee or to the employer. To receive creditable service, the employee must file a New Hampshire Department of Labor Memo of Payment with NHRS verifying the first and last payment of workers’ compensation benefits for the award period.
8. The Town, and/or its workers’ compensation carrier, retains the right to request updated medical information during the disability. If a medical exam is requested, the Town or carrier shall use a qualified doctor who specializes in the alleged disability.
9. A Workers’ Compensation claim which results in lost time must be supported by a doctor’s statement outlining the nature of the disability and if possible the length of the disability.
10. Prior to returning to work, the employee shall provide a doctor’s statement clearing the employee’s return to his regular duties.
