Rest and Meal Breaks. 11.1 One 10 minute paid morning rest break and a 30 minute unpaid lunch break will be scheduled within ordinary daily hours. The lunch break must be taken no later than 6 hours after work starts. 11.2 If the total worked hours for the day are 10 hours or more there will be an additional 20 minute rest break paid at time and one half of ordinary time rates to be taken at the end of ordinary daily hours, and prior to the commencement of overtime. However, an employee may elect to take a payment in lieu of stopping work for this break in which case the employee will be regarded as having worked a further 20 minutes, and he or she must be paid accordingly.

Rest and Meal Breaks. 18.0.1 Normally, an unpaid meal period of one (1) hour shall be granted at approximately mid‐point in the employee's regular work day, the unpaid meal period may be reduced on a continuing basis to one‐half (0.5) hour with mutual written agreement between the employee and their OOS Manager. 18.0.2 On rare occasions an employee may be required, in writing, by their OOS Manager to work through their scheduled unpaid meal period and be unable to leave their station of employ for the minimum one‐half (0.5) hour. In such case, the employee shall be compensated for the missed unpaid meal period either through time off in lieu at a rate of one and one‐half (1.5) times or paid at the applicable overtime pay rate. 18.0.3 Employees shall be permitted a paid rest period of fifteen (15) minutes during each scheduled work period of three and one‐half (3.5) hours or more. Such time is to be taken in accordance with a schedule arranged with the OOS Manager. The general expectation is that one paid rest period of fifteen (15) minutes shall normally occur in the first half of the shift, and one in the latter half of the shift. 18.0.4 Notwithstanding Article 18.0.1, on shifts of less than five (5) hours duration, an unpaid meal break is not required to be provided. On work day shifts of five (5) hours to six (6) hours duration, the unpaid meal break may be waived by mutual agreement between the employee and their OOS Manager, with notice provided to Human Resources and the MSA. In such cases, the employee shall still be provided a paid rest period of fifteen (15) minutes duration at least once every two and one‐ half (2.5) hours. 18.0.5 Provided that no employee is required to work in excess of two and one‐half (2.5) hours without a break, the timing of the unpaid meal break may be shifted from the mid‐point of the work day by up to one and one‐half (1.5) hours either way and both paid fifteen (15) minute breaks be taken consecutively in the mid‐point of the longest portion of the shift by mutual written agreement between the OOS Manager and a minimum of seventy‐five percent (75%) support of the group of affected employees. Where operationally required all affected employees’ breaks will be adjusted accordingly.

Rest and Meal Breaks. An employee shall have breaks for the following work periods: (a) Two hours but not more than four hours One ten minute paid rest break; to be taken at such time as agreed between the employee and their manager, or in the absence of such agreement to be taken in so far as practicable in the middle of the work period. (b) More than four hours but not more than six hours One ten minute paid rest break and one 30 minute (unpaid) meal break; to be taken at such time as agreed between the employee and their manager, but in the absence of such agreement and in so far as practicable the rest break is to be taken one third of the way through the work period, and the meal break to be taken two thirds of the way through the work period. (c) More than six hours but not more than eight hours Two ten minute paid rest breaks and one 30 minute (unpaid) meal break; to be taken at such time as agreed between the employee and their manager, but in the absence of such agreement and in so far as practicable the meal break is to be taken in the middle of the work period and the rest breaks half way between the start of work and meal break and then half way between the meal break and finish of work. (d) More than eight hours The same breaks as specified in (c) and the breaks specified in (a) and (b) as if the employee’s work period had started at the end of the eight hour. Note that the above work periods are deemed to be inclusive of all authorised rest breaks and meal breaks. PlunketLine nurse employees who work the night shift (11pm – 7am) and are unable to be relieved so that they can have a meal break shall be entitled to have a meal while on duty and this period shall be regarded as working time paid at the appropriate rate (ie the rate payable at that time). (a) For each shift, one 15 minute rest break shall be provided for PlunketLine employees. For shifts of six hours or longer, another paid rest break of 10 to 15 minutes shall be provided.

Such time shall be paid for as part of the regular shift. (e) Where work is required beyond ten (10) hours, a second meal break of one-half (%)hour will be provided at the beginning of ten (10) hours, to be paid at straight time rates. If a second meal break is provided, the third rest break shall not be taken. (f) It is agreed that no employee shall be deprived of an overtime meal by reason of working overtime, where the Employer is providing room and board. (g) Where the work beyond ten (10) hours was not previously scheduled the Employer shall provide a hot meal; or, where providing a hot meal is not practical a payment of seventeen dollars ($17), or the maximum amount allowable under CRA guidelines, in lieu of the hot meal.
