Available Hours of Work. In the event the Employer wishes to make changes to the qualifications required for any classification in the bargaining unit, or the Employer adds a new classification and with it new qualifications, the Employer agrees to advise the Union. Should the Union have any concerns with respect to the reasonableness of the qualifications for any classification, the Union shall, within thirty (30) days of receipt of the information from the Employer, provide such concerns in writing to the Employer. The parties shall meet to attempt to resolve the areas of concern. Should the parties fail to resolve the concerns, the Union reserves the right to refer the matter to a single arbitrator as outlined in this Agreement on the basis of the “reasonableness” of the required qualifications in dispute.
Available Hours of Work. (a) For the purposes of applying the rules below part-time and casual employees shall declare in writing their availability and days available to work. Xxxx declared availability will remain in effect until changed, in writing, with one (1) weeks’ notice, by the employee. All part time and casual employees hired after June 14, 2015, must be available to work a minimum of two (2) shifts during the week (Monday – Friday) and two (2) weekends (Saturday/Sunday) per month.
(b) A Central Call-in will be administered by the Employer. If issues arise regarding the application of the Central Call-in, the parties will discuss as early as possible, but not later than the next Joint Labour/Management meeting, in an effort to resolve concerns by amending the Central Call-in list process as necessary.
(c) If the Employer needs a replacement for a sick call, absence, or any change to the existing schedule, the Central Call-in shall be notified as early as possible. From the Central Call-in list, the Employer will call in employees in order of seniority providing they have the ability and qualifications to perform the normal functions of the job, as per their declared availability. All part-time employees available through the Central Call-in will be called prior to available hours being offered to casual employees.
(d) Full time employees shall declare their availability on the Central Call-in for the purposes of indicating their willingness to accept overtime shifts if the available hours cannot be filled in any other matter subject with the above.
(e) If the overtime is still not filled it will be assigned to the most junior employee on the Central Call-in. Such assigned work shall, in second and subsequent instances, be rotated throughout the working group in ascending order of seniority within the classification.
(f) If the Employer has proceed through steps (a) – (e) and there are still no employees available or willing to come into work, the Employer can fill the open shift(s) with staff outside of the bargaining unit.
(g) If an employee fails to show up for a shift or will be late for a shift, employees who are currently on shift will be asked to stay based on seniority within classification. If no one within the classification on shift is able to stay, employees outside of classification by seniority will be asked. If no employee is able to stay then the most junior employee on shift maybe required to stay until a replacement is found or a staff member outside th...
Available Hours of Work. The Employer shall be bound by the seniority provisions of this Agreement in the assignment of regular hours to part-time employees as such hours become available and are desired by such employees.

(b) Employees within the same job classification shall be offered available shifts caused by absences or unfilled vacancies by seniority within their classification first in their home department. For the purpose of this Article, home department is the location where employees work the majority of their permanent hours. Overall seniority shall not be affected unless proven otherwise by supporting evidence provided by person supported.
(c) Employees from other work locations shall be offered available shifts caused by absences or unfilled vacancies by seniority if no employee from the home department is available to work the required shift, providing they are capable of performing the work (have the necessary training and minimum qualifications).
(d) Part-time employees shall be offered available hours over casual employees providing it does not result in any overtime payment.
(e) Generally, increases in available shifts in any residence will be offered by seniority within each residence. The exception to this is the temporary or permanent closing of a residence or if the relocation of a person supported to another existing residence decreases shifts available in one residence and increases them in the other, the affected employees in the residence with the decreased shifts will be offered the newly available shifts at the other location before those shifts are offered to any junior employees in that location. In the case of temporary closure or partial closure of a residence, affected employees may, at their discretion, choose to take any accrued paid time they may have earned and specify which one, or take the time off without pay.

(b) Employees will notify the Employer in writing of any restrictions to their availability, with as much notice as possible and in any event not less than one month's notice. The Employer will not schedule an Employee outside of their stated availability, unless otherwise agreed.

If their name is not on the list the Employer is not required to offer them available shifts.

(c) Employees within the same job classification shall be offered available shifts caused by absences by seniority within their classification first at their work location.
(d) Employees from other work locations shall be offered available shifts caused by absences by seniority if no employee from the work location is available to work the required shift, providing they are capable of performing the work (have the necessary training and minimum qualifications).
(e) Full-time or part-time employees shall be scheduled available hours over casual employees providing it does not result in any overtime payment. For the purpose of this Article, full-time employees includes Little Wings employees that are normally laid off during the school summer vacation.
(f) Generally, increases in available shifts in any work location will be offered by seniority within each work location.

Preference as to available hours of work shall be given to the employees according to seniority, consistent with the availability of that employee and the employee's willingness to perform the work, providing the employee has the ability to perform the normal functions of the job. For the purpose of this Article and to address any short-notice emergency or no-show for a night shift only, an on-call list shall be created and posted. This list is to be made of employees willing to be offered the hours on short- notice and shall be followed in order of seniority. Sincere effort will be made to ensure each employee is scheduled every second weekend off unless an employee has indicated, in writing, to the Manager, that they wish to work more weekends.

(f) Where an employee in a higher classification is offered the opportunity to fill in for an employee in a lower classification at the lower rate of pay, and refuses the offer, the employee in the higher classification will not be permitted to fill in the shift unless they agree to accept payment at the lower classification.
