BEREAVEMENT AND JURY DUTY. In the event of a death in the immediate family of a full time employee, the employee shall be entitled to three (3) working days off with pay at the appropriate rate if scheduled to work, but not exceed twenty one (21) hours at the basic hourly rates, to be taken within either five (5) calendar days before or after the day of the funeral. For the purposes of this clause the immediate family of the employee shall be defined as: Mother, Father, Spouse, Children, Brother, Sister, Mother- in-Law, Father-in-Law, Grandparents. In respect of attendance at the funeral of the full time employee’s Sister-in- Law or Brother-in-Law, the full time employee shall be entitled to one (1) working day off with pay within three (3) calendar days before or after the funeral. The term “Spouse” shall be deemed to include a Common-Law Spouse provided that the full time employee has previously declared the common law relationship in writing to The Centre in the manner and form prescribed by The Centre.
BEREAVEMENT AND JURY DUTY. Leaves are available to staff in ten (10) hour shift positions on the same basis as regular eight (8) hour staff. Participating staff will be entitled to four (4) ten (10) hour shifts for bereavement leave as substitution for the five (5) days allowable in the current MOU.

If the funeral is held on a day in which the employee is not scheduled to work, or if either of the two (2) days preceding or following the funeral falls on days on which the employee is not scheduled to work, no bereavement pay will be payable for those specified days. Section 2. The immediate family includes, but is limited to, the employee’s husband or wife, child, brother, sister, father, mother, mother-in-law, father-in-law, grandparents, and grandchildren. Proof of death will be required in order for the employee to qualify for the bereavement pay.

One day paid leave will be granted to attend the funeral of an aunt, uncle, brother-in-law, sister-in-law, mother-in-law, father-in-law or grandparent. An unpaid leave to attend the funeral of a non-relative may be granted upon advance request from the employee. 17.02 Should a Seniority employee be called for Jury Duty or subpoenaed as a crown witness, the Company will supplement his jury pay or witness pay to ensure that the employee will receive, totally, monies equivalent to eight (8) hours of straight time pay at his regular wage rate for those days he would actually have been at work during his service on a jury or as a crown witness.

An unpaid leave to attend the funeral of a non-relative may be granted upon advance request from the employee. 21.02 Should a Grandfathered or Regular Seniority employee be called for Jury Duty or subpoenaed as a crown witness, the Company will supplement his jury pay or witness pay to ensure that the employee will receive, totally, monies equivalent to eight (8) hours of straight time pay at his regular wage rate for those days he would actually have been at work during his service on a jury or as a crown witness.

BEREAVEMENT AND JURY DUTY. 21.01 When a death occurs in the immediate family of a regular full-time or part-time employee such employee shall be allowed up to three (3) days absence from work without loss of regular salary up to and including the day of the funeral. An employee will not be paid for such days if they are not her/his scheduled working days. The term “immediate family” includes father, mother, spouse, or common-law spouse, child, or brother or sister of the employee, or any relative of the employee who resides permanently in the employee’s household or with whom the employee permanently resides. The Company will give consideration to an extension of time in situations where there may be extenuating circumstances. Requests for such consideration should be taken to the Branch Manager or designate. 21.02 When a regular full-time or part-time employee’s mother-in-law, father-in-law, brother-in-law, sister-in-law, grandson, granddaughter, grandparent or stepfather, stepmother, stepchild, stepbrother, or stepsister deceases, such employee shall be allowed a one (1) day absence from work without loss of regular salary on the day of the funeral if she/he was scheduled to work on that specified day. The company will give consideration to an extension of time in situations where there may be extenuating circumstances. Requests for such consideration should be taken to the Branch Manager or designate. In the case of death of an uncle or aunt of an employee, such employee shall be entitled to one day off without pay on the day of the funeral. An employee may request up to three (3) days off without pay, which may be granted by the Company according to the circumstances. 21.03 In the event a regular full-time employee is required to render service as a juror, the Company will pay the employee, upon proof of jury service, and amounts received, the difference between the fee received and the amount the employee would normally receive had the employee worked his/her regular scheduled hours of work, provided the latter is higher.
BEREAVEMENT AND JURY DUTY. 15.01 - In case of a death in the immediate family of an employee, the Company shall grant leave of absence with pay, not to exceed three (3) days at the employee’s normal straight time hourly rate, as may be necessary for the purpose of attending the funeral and making funeral arrangements, providing the three (3) days fall within the employees normal work week. Immediate family shall be meant to include spouse (including Common-law), mother, father, mother-in-law, father-in-law, brother, sister, brother-in-law or sister-in-law, children, minors under the legal guardianship of the Employee or spouse, grandparents, aunts and uncles, nieces and nephews, stepparents, stepchildren, same sex partner and grandparents of current spouse . When an Employee travels out of the Province or a distance of over four hundred (400) Kilometers, one way, to attend or arrange the funeral an additional two (2) day’s leave of absence with pay shall be granted.

  • Paid Jury or Court Witness Duty Leave The Employer shall grant leave of absence without loss of seniority to an Employee who serves as a juror or witness in any court. The Employer shall pay such an Employee the difference between normal earnings and the payment received for jury service or court witness, excluding payment for traveling, meals or other expenses. The Employee will present proof of service and the amount of pay received. Time spent by an Employee required to serve as a court witness in any matter arising out of her employment, shall be considered as time worked at the appropriate rate of pay.

  • Jury & Witness Duty (a) If a full-time or regular part-time nurse is required to serve as a juror in any court of law, or is required to attend as a witness in a court proceeding in which the Crown is a party, or is required by subpoena to attend a court of law in connection with a case arising from the nurse's duties at the hospital, or is required to attend a coroner’s inquest in connection with a case arising from the nurse’s duties at the hospital, the nurse shall not lose service/seniority or regular pay because of such attendance and shall not be required to work the night shift prior to, or on the day of such duty provided that the nurse: i) notifies the Hospital immediately on the nurse's notification that she or he will be required to attend court; ii) presents proof of service requiring the nurse's attendance; iii) deposits with the Hospital the full amount of compensation received excluding mileage, travelling and meal allowances and an official receipt where available. In addition, where a full-time nurse or regular part-time nurse is selected for jury duty for a period in excess of one (1) week, she or he shall be paid for all hours scheduled and not be expected to attend at work. Upon completion of the process the nurse shall be returned to that point on her or his former schedule that is considered appropriate by the Hospital. It is understood and agreed that the local parties may agree to different scheduling arrangements for the first week of jury and witness duty. (b) Where the Hospital requires a nurse to attend any meetings in preparation for a case or legal proceedings which either arises from a nurse’s employment with the Hospital or otherwise involves the Hospital, the Hospital will make every reasonable effort to schedule such meetings at the Hospital during the nurse’s regularly scheduled hours of work. If the nurse is required to attend such meetings outside of her or his regularly scheduled hours, the nurse shall be paid for all hours spent in such meetings at her or his regular straight time hourly rate of pay. Part-time nurses will be credited with seniority and service for all such hours paid as provided above while in attendance at such meetings.

  • Jury Duty A. An employee shall be allowed such time off without loss of compensation as is required in connection with mandatory jury duty. Upon receiving notice of jury duty an employee shall immediately provide a copy of the notice to his/her supervisor. B. If payment is made for such time off, the employee is required to remit to the State jury fees received. If an employee elects to use accrued vacation leave or compensating time off while on jury duty, the employee is not required to remit jury fees. For the purposes of this section, "jury fees" means fees received for jury duty excluding payment for mileage, parking, meals, or other out-of-pocket expenses. C. For an employee summoned to jury duty during hours other than the employee's regular and customary shift, management will endeavor to temporarily reassign the employee to a work shift that more closely coincides with the hours the employee is required to serve on jury duty, including any necessary travel time, subject to the following: 1. The department already maintains an appropriate work shift that utilizes the employee's classification; and 2. The operational needs of the department permit such reassignment. D. An employee shall be allowed time off without loss of compensation if approved by the department head or designee for voluntary jury duty such as grand jury. If approved by the department, paragraphs B. and C. apply. E. For the purpose of this section, an employee summoned to jury duty may be required to adjust their work shift to an eight (8) hour schedule. F. An employee summoned to jury duty who does not serve for a full day or who is placed on "on-call" status shall return to work to complete his/her scheduled workday if reasonable time remains for such return. An employee may not be required to report back to work if he/she feels there is not reasonably enough time left in the workday and if the employee's supervisor concurs. Concurrence will not be unreasonably withheld.

  • Jury Duty/Witness Leave Unit members shall be granted leave, without loss of pay, to appear in court as a subpoenaed witness or to serve as a juror. Any compensation, less any mileage expenses, received for appearance as a witness or from serving as a juror under this section shall be endorsed over to the District so that the unit member’s compensation for any days of absence for the above purposes shall not be in excess of nor less than his/her regular pay.

  • Civic Duty Whenever an employee is served with a subpoena by a court of competent jurisdiction which compels his/her presence as a witness during his/her normal working period, unless he/she is a party to the litigation or an expert witness, such employee shall be granted time off with pay in the amount of the difference between the employee's regular earnings and any amount he/she receives for such appearance. This Article is not applicable to appearances for which the employee receives compensation in excess of his/her regular earnings. A court of competent jurisdiction is defined as a court within the County in which the employee resides or if outside the county of residence, the place of appearance must be within 150 miles of the employee's residence.

  • Witness Duty An employee required to serve on jury duty, or as a witness in a case in which the Crown is a party, or as a witness at an inquest, or as a witness in a case arising out of her employment, or as a witness at a hearing of the College of Nurses of Ontario, shall not lose regular pay because of such attendance, provided that the employee: (a) shall notify the Director of Care, as soon as possible, when required to serve under any of the above circumstances; (b) presents proof of service requiring her attendance; (c) deposits with the Employer an amount equal to the jury duty attendance fees received by the employee in any above cases but not any expenses paid by the employee and received from the authorities for necessary travel, accommodations and meals; (d) will normally come to work during those scheduled hours of the day shift that she is not required to attend court. In the event that an employee is scheduled to the afternoon shift, she shall not be required to attend court and then report for duty the same day; and (e) will not be required to work on the night shift prior to such duty. Where the employee's presence is required in court past 1700 hours, she shall not be required to attend work for her night shift commencing later that day. (f) Where the Home requires an employee to attend any meetings in preparation for a case or legal proceedings or as a result of a compliance inspection which either arises from an employee’s employment with the Home or otherwise involves the Home, the Home will make every reasonable effort to schedule such meetings at the Home during the employee’s regularly scheduled hours of work. If the employee is required to attend such meetings outside of her or his regularly scheduled hours, the employee shall be paid for all hours spent in such meetings in accordance with Articles 15 and 16.

  • Jury or Witness Duty Full-time employees called to jury duty or subpoenaed for witness duty shall absent themselves from their work only to such extent as to allow them to carry out such duties. Employees on jury or witness duty shall be paid the difference, if any, between jury or witness pay and their regular basic pay from the Company, subject to the following provisions: (a) The employee must notify his/her Supervisor as soon as possible after receipt of notice of his/her selection for jury or witness duty. (b) An employee who is selected for jury or witness duty but is temporarily excused from court must report for work until such time as he/she is actually involved in jury or witness duty. (c) Employees must furnish a written statement from the appropriate public official showing the date, time served and the amount of pay received to be eligible for payment.

  • Court Duty Section 1. After due notice to the EMPLOYER, employees subpoenaed to serve as a witness in cases arising from or during the performance of their official duties, or called and selected for jury duty, shall be allowed their regular compensation at their current base pay rate for the period the court duty requires their absence from work duty, plus any expenses paid by the court. Such employees, so compensated, shall not be eligible to retain jury duty pay or witness fees and shall turn any such pay or fees received over to the EMPLOYER. If an employee is excused from jury duty prior to the end of his/her work shift, he/she shall return to work as directed by the EMPLOYER or make arrangement for a leave of absence. Section 2. Any absence, whether voluntary or by legal order to appear or testify in private litigation, not in the status of an employee but as a plaintiff or defendant, shall not qualify for leave under this Article and shall be charged against accumulated leave or be without pay.
