BOARD OF EDUCATION RIGHTS AND RESPONSIBILITIES. 3.1 Except as otherwise specifically provided in this Agreement, the Board retains and reserves unto itself the sole and exclusive right to the executive management and administrative control of the school system, along with all other rights, powers, authority, duties, and responsibilities conferred upon and vested in it by the laws and Constitution of the State of Utah and the United States, including, but not limited to, the following rights and responsibilities: 3.1.1 to determine and administer policy; 3.1.2 to establish courses of instruction, including special programs, and to provide for athletic, recreational, and social events for students; 3.1.3 to hire all teachers and, subject to the provisions of law, to determine their qualifications and the conditions for their continued employment, or their dismissal or demotion, and to promote and transfer all such employees; 3.1.4 to determine the responsibilities and assignments of teachers; 3.1.5 to make and enforce all needful rules and regulations for the control and management of the public schools of the District; 3.1.6 to do all things needful for the maintenance, prosperity, and success of the schools and the promotion of education. 3.2 The Board recognizes the role of professional educators in determining and providing for the educational needs of students. Therefore, the Board will provide opportunities for the involvement and participation of teachers individually and through the Association in planning and developing the best possible programs for students and teachers of the District.

BOARD OF EDUCATION RIGHTS AND RESPONSIBILITIES. 5.1 Nothing contained herein shall be considered to deny or restrict the Board of its rights, responsibilities, and authority under the Michigan Revised School Code, or any other laws or regulations. Except as specifically stated by this Agreement, all the rights, powers, and authority the Board had prior to this Agreement are retained by the Board. Such rights shall include, by way of illustration and not by way of limitation, the right to: A. Manage and control its programs, services, equipment, facilities and its operations, and to direct the working forces and affairs of the District. B. Continue its rights of assignment and direction of personnel, determine the number of personnel, the number of hours worked by bargaining unit members and scheduling of all the foregoing, and the right to establish, modify, or change any work or school hours or days. C. The right to direct the working forces, including the right to hire, promote, discipline, suspend, and discharge employees, transfer and/or reassign employees, assign or reassign work or duties to employees, evaluate employees, and to determine the size of the work force and to lay off employees or reduce hours of work. D. Adopt, revise, and enforce work rules and regulations governing the conduct of employees and to define and re-define job content and position descriptions. E. Determine the qualifications of employees, including the essential job functions of positions within the bargaining unit. F. Determine the extent and existence of educational programming and operation including the establishment or relocation of programs, buildings, departments, divisions or subdivisions thereof, and the relocation or closing of programs, departments, divisions or subdivisions, buildings, other facilities, services or third party service contracts. G. Determine the financial policies, including all accounting procedures and record- keeping requirements. H. Determine policies affecting the selection, testing, or training of employees. 5.2 The exercise of the foregoing powers, rights, duties, and responsibilities by the Board and the adoption of policies, rules, regulations, and practices in the furtherance thereof, shall be the exclusive prerogative of the Board except as otherwise limited by express provision of this Agreement.
BOARD OF EDUCATION RIGHTS AND RESPONSIBILITIES. A. Nothing in this Agreement denies the Board’s rights, responsibilities, duties, and authority under the Michigan General School Laws, the laws of Michigan, or the laws of the United States. B. Except as specifically amended by other Articles of this Agreement, the Board’s rights and responsibilities in paragraph A. above, shall include, by way of illustration and not by way of limitation, the right to: 1. Manage and administer the District, its properties and facilities, and its business operations. 2. Determine overall educational goals and objectives, as well as the general policies affecting the educational programs. 3. Adopt rules and regulations for the operation and administration of the District and adopt or define descriptions and requirements of all jobs. 4. Give direction to the professional staff, including the right to hire all employees, determine their qualifications and the conditions for their continued employment or their discharge or demotion, and to promote and transfer all such employees. 5. Determine class scheduling, as well as the duties and responsibilities of the teaching staff and other employees for such scheduling. 6. Decide upon what services, supplies, and equipment are necessary to continue the District’s operation, and to establish standards for their use and operation. C. The Board, operating on its own behalf and through its administrative staff, shall be limited in the use of its judgment and discretion in exercising the above-listed rights and responsibilities only by the specific terms of this Agreement and all applicable laws.

The Board and the Association agree that the Board of Education on its own behalf and on behalf of the electors of the Board, hereby retains and reserves unto itself all powers, rights, authority, duties and responsibilities conferred upon and vested in it by the laws and the Constitution of the State of Michigan, including, but without limiting the generality of the foregoing, the right: 1. to the executive management and administrative control of the school system and its properties and facilities, and the activities of its employees in respect to the execution of their professional duties and responsibilities. 2. to hire all employees, and subject to the provisions of the law and this Agreement, to determine their qualifications, and the conditions of their continued employment, or their dismissal or demotion, and to promote and transfer all such employees. 3. to determine the hours of work, and the duties, responsibilities and assignments of employees with respect thereto, and the terms and conditions of employment, as modified by this Agreement. The exercise of the foregoing powers, rights, authority, duties and responsibilities by the Board, the adoption of policies, rules, regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the terms of this Agreement and then only to the extent such terms hereof are in conformance with the Constitution and laws of the State of Michigan and the Constitution and laws of the United States. B. This section shall be subject to the provisions of this Agreement and shall not detract from employee rights provided in the Michigan Public Acts 282 and 379 of 1965.

Determine matters of inherent managerial policy which include, but are not limited to areas of discretion or policy such as functions and programs of the public employer, standards of services, its overall budget, utilization of technology, and organizational structure; 2. Direct, supervise, evaluate, or hire employees; 3. Maintain and improve the efficiency and effectiveness of governmental operations; 4. Determine the overall methods, process, means, or personnel by which governmental operations are to be conducted; 5. Suspend, discipline, demote, or discharge for just cause, or layoff, transfer, assign, schedule, promote, or retain employees; 6. Determine the adequacy of the work force; 7. Determine the overall mission of the employer as a unit of government; 8. Effectively manage the work force; 9. Take actions to carry out the mission of the public employer as a governmental unit.
BOARD OF EDUCATION RIGHTS AND RESPONSIBILITIES. In order to fully evaluate curricula and other special situations as they arise, the Board of Education may require individual teachers to appear before it to answer questions from time to time. The teacher can, if he/she chooses, be accompanied by an advisor of their choice. The Board of Education will make available to the association whatever (non-privileged) documents are available to any other district resident.

Determine overall rules and objectives, as well as general policies affecting the delivery of the education program and services provided by the District. 3. Adopt reasonable rules and regulations pertaining to the operation and administration of the school system, including rules and regulations concerning the delivery of transportation services. 4. Give direction to its employees, including the right to hire all employees, determine their qualification, the conditions of their continued employment or dismissal or demotion and to promote and transfer such employees. 5. Determine scheduling, times of employment, bus routes and methods of operation. 6. Decide upon what services, supplies and equipment are necessary to continue the school systems operation, deliver the services it deems necessary and to establish standards for the use and operation of school facilities and properties.
BOARD OF EDUCATION RIGHTS AND RESPONSIBILITIES. This Agreement recognizes the responsibilities of the Madison Board of Education as prescribed by the Connecticut General Statutes, sections 10-220 and 10-221 on file in the Central Office. Subject to the provisions of this Agreement, the Board and the Superintendent reserve and retain full rights, authority and discretion, in the proper discharge of their duties and responsibilities, to supervise, terminate, layoff and furlough employees and manage the Madison Public Schools and its supportive services staff under governing law, ordinances, rules and regulations – Municipal, State and Federal.
BOARD OF EDUCATION RIGHTS AND RESPONSIBILITIES. SECTION 1 It is expressly agreed that all rights which ordinarily vest in and have been exercised by the Board, except those which are clearly and expressly relinquish herein by the Board, shall continue to vest exclusively in and be exercised exclusively by the Board without prior negotiations with the Association either as to the taking of action under such rights with respect to the consequence of such action during the term of this Agreement. SECTION 2 The exercise of the powers, rights, and authority of the Board, the adoption of policies, rules, regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of this Agreement and then only to the extent such specific and express terms hereof are in conformance with the Constitution and laws of the State of Michigan and the Constitution and laws of the United States. Nothing contained herein shall be considered to deny or restrict the Board of its rights and authority under the Michigan General School Laws or any other national, state, county, district or local laws or regulations as they pertain to education.
