This task includes all activities necessary to secure a contractor and award the contract including for all four bid packages: develop bid documents; prepare bid advertisement and contract documents for construction contract bidding; conduct pre-bid meeting, bid opening, and bid evaluation; select the contractor; award the contract; and issue Notice to Proceed. Deliverables:

Construction Contracting. The Contracting Party shall cause all work to be performed by properly qualified and licensed parties. All required governmental permits for construction shall be obtained prior to the start of work for which a permit is required. Parties that have been suspended or debarred from participating in federally assisted projects may not perform contract work related to this project. Prior to award of any contract or subcontract for construction, the Contracting Party shall submit such information as the Division may deem reasonably necessary to determine subcontractor license status and the Contracting Party’s compliance with this requirement. The Division will provide written notice as to the eligibility or ineligibility of any potential contractor. The Contracting Party shall provide the Division with prior notice as to the starting date of the construction and with evidence that all necessary construction permits have been obtained. The Contracting Party shall require that construction contractors on this project carry and maintain at all times during the performance of work pursuant to this Agreement. The Contracting Party shall be responsible for provision of adequate Builders Risk Insurance during construction and, after completion of construction, Landlord Insurance thereafter in the event the property is to be managed as rental property, policies to include a loss payee clause naming the City of Baton Rouge-Parish of East Baton Rouge through its Office of Community Development during the period of affordability. The Contracting Party must, at a minimum, provide the equivalent insurance coverage for real property and equipment acquired or improved with Federal funds as provided to other property owned by Contracting Party as per the regulations set forth in 2 CFR 200.310. The City of Baton Rouge-Parish of East Baton Rouge shall be named as Additional Insured on all liability policies during the period of affordability. The Contracting Party shall not allow the commencement of work by any contractor until evidence of insurance has been provided to the Division. Insurance Certificate(s) shall be provided and said Certificate(s) shall specify date(s) when such insurance expires and shall provide further that not less than thirty (30) days prior written notice on non-renewal, cancellation or any material change in such insurance shall be provided to the Division. Construction Contracting. The Implementing Agency, in coordination with the Grantee, will oversee project management, evaluate design-build and design-bid-build delivery approaches to select an approach that best meets the overall goals of the project, and oversee the process to secure a contractor. Activities necessary to secure a contractor and award the contract include, but are not limited to: develop bid documents, prepare advertisement and contract documents for construction contract bidding, conduct pre-bid meeting, bid opening and evaluation, selection of the contractor, award of contract, and issuance of notice to proceed. The Grantee, Implementing Agency, or construction management consultant will review construction contractor submittals, answer requests for information, and issue work directives. A full-time engineering construction observer will be on site for the duration of the project. Construction observer duties include, but are not limited to: documenting of pre-construction conditions, daily construction diary, preparing change orders, addressing questions of contractors on site, reviewing/ updating project schedule, reviewing contractor log submittals and pay requests, forecasting cash flow, notifying contractor if work is not acceptable. Develop a Monitoring and Maintenance Plan as described in Paragraph 15 (d) and Exhibit I, “Monitoring and Maintenance Plan Components.” Conduct pre- and post-construction monitoring to verify Project benefits claimed. • Monitoring and Maintenance Plan • Technical memorandum for pre-construction site conditions • Post-construction monitoring report Obtain and comply with all permits required to implement the Project including a stormwater pollution prevention plan (SWPPP), acquire right-of-way (ROW) encroachment, construction dust control permit, etc. (as-needed). Additional permits may be required and will be obtained as necessary. Construction of the approximately 156-acre demonstration project. This task includes contractor mobilization, foundation preparation including clearing and grubbing, excavation, and grading for the berm system that is approximately 1.5 miles in length. As needed by a Water Supply Agreement (Task 6) and Final Design (Task 7.5), construction of a gravity water line and/or a pump station to supply water to this demonstration project will be included.
Construction Contracting. This task includes all activities necessary to issue a change order and an amendment to the existing contractor contracts for the monitoring xxxxx and production xxxxx, respectively. Installation of the collector line and pump station upgrade will be performed by in-house resources; therefore no construction contracting work will be performed for the collector line and pump station. Construction Contracting. This task includes all activities necessary to secure a Design-Build contractor for the TIWRP expansion, a contractor for the distribution system expansion, and award the contracts including: prequalification, development of bid documents, preparation of bid advertisement and contract documents for contract bidding, meetings, bid opening, bid evaluation, selection of contractors, award of contracts, and issuance of Notices to Proceed. Micro Filtration, Reverse Osmosis and Variable Frequency Drive Pump Systems will be procured; therefore procurement documents will be prepared. Deliverables:
Construction Contracting. (1) The owner department shall consult with CBDP to determine an appropriate goal on all contracts.
(2) The owner department shall submit an approved DBE participation recommendation form for each project. CBDP will establish, where feasible, a percentage, up to the total contract value, of prime contract and subcontract awards to be set aside for participation by SBEs during DBE participation recommendation review. A "set aside" is the reserving of a contract or a portion of a contract exclusively for participation by SBEs, regardless of the owner's race or gender.
(3) CBDP shall provide the director of the owner department with appropriate DBE specification language and required contract provisions to be included in bidding and contract documents.
(4) CBDP requires contractors/consultants to submit DBE documentation with their original bid/proposal as a matter of responsiveness. CBDP shall provide department/division heads and contract administrators with the appropriate DBE specification language, required contract provisions, instructions, forms and procedures to be included with the bid/proposal solicitations. The department/division head or contract administrator shall forward all DBE submissions to CBDP. CBDP will review responses to assure submission of the required forms and documentation. CBDP shall make determinations as to bidder/proposer responsiveness to DBE requirements, and may reject and remove from further consideration all bids/proposals submitted without proper documentation.
(5) The owner department shall require all prime contractors/consultants to submit a DBE or ACDBE utilization report with all payment requests. Copies of utilization reports and payment requests shall be forwarded to CBDP for review.
(6) Department/Division heads and contract administrators shall ensure that all final payment requests are accompanied with a signed affidavit verifying that the DBE and/or ACDBE requirement has been met, either at the prime or subcontracted level.
(7) The owner department shall submit an annual list of approved projects as defined in chapter 44, section 44.001, whether funded with federal funds or solely with county funds. The director of the owner department must submit the DBE/ACDBE utilization plan by December 15 of each year to CBDP based on the county board adopted budget.
