Daywork. For work of a minor or incidental nature, the Contract Awarder may instruct that a Variation shall be executed on a daywork basis. The work shall then be valued in accordance with the daywork schedule included in the Contract, and the following procedure shall apply. If a daywork schedule is not included in the Contract, this Sub-Clause shall not apply. Before ordering Goods for the work, the Contractor shall submit quotations to the Contract Awarder. When applying for payment, the Contractor shall submit invoices, vouchers accounts or receipts for any Goods. Except for any items for which the daywork schedule specifies that payment is not due, the Contractor shall deliver each day to the Contract Awarder accurate statements in duplicate which shall include the following details of the resources used in executing the previous day's work:
(a) the names, occupations and time of Contractor's Personnel,
(b) the identification, type and time of Contractor's Equipment and Temporary Works, and
(c) the quantities and types of Plant and Materials used. One copy of each statement will, if correct, or when agreed, be signed by the Contract Awarder and returned to the Contractor. The Contractor shall then submit priced statements of these resources to the Contract Awarder, prior to their inclusion in the next Statement under Sub-Clause 14.3 [Application for Interim Payments].
Daywork. Add the following to this clause:
a) Labour at hourly rates for skilled, semi-skilled and unskilled labourers.
b) Purchase cost of Material with a percentage allowance on the net cost for delivery to Site and all Contractors charges.
c) The Contractor's own construction equipment as a Provisional Sum. Where not listed in the BoQ, rates shall be agreed with the Engineer before such work is put in hand. Tendered unit rates or unit rates that are agreed in terms of Sub-clause 6.5.1.3 of the General Conditions of Contract for the Contractor's own construction equipment used for Daywork shall cover the full cost of the use of such construction equipment and shall, in addition, cover the cost of operators, consumable stores, fuel and maintenance. The Contractor will be paid the actual net cost of construction equipment hired by him for Daywork and in addition will be paid a percentage allowance on the net cost of such hire, which allowance will cover the Contractor's own overhead costs and profit.
Daywork. 55.1 The Engineer may instruct that any work to be executed as a result of an instruction given pursuant to Clauses 54.1 or 65.1(b) shall be executed on a daywork basis under the conditions and valued at the rates set out in the Pricing Document. Unless the work instructed is required to commence - 72/105 - immediately, the Contractor shall give the Engineer notice before starting the work.
55.2 The Contractor shall furnish to the Engineer such receipts or other vouchers as may be necessary to prove the amounts paid by the Contractor in executing the work and before ordering work shall submit to the Engineer quotations for the same for review.
55.3 In respect of all work executed on a daywork basis the Contractor shall, during the continuance of such work, deliver each day to the Engineer a list of the names and occupations of and time worked by all workmen employed on such work and a statement showing the descriptions and quantities of all work executed the previous day. One copy of each list and statement shall, if correct or when agreed, be signed by or on behalf of the Engineer and returned to the Contractor.
55.4 At the end of each month, the Contractor shall deliver to the Engineer a detailed priced statement of the work executed (separately identifying labour and things supplied) and the Contractor shall not be entitled to any payment unless the lists and statements required in accordance with this Clause 55 have been fully and punctually rendered. Provided always that if the Engineer shall consider that for any reason the sending of such list or statement by the Contractor in accordance with the foregoing provisions was impracticable, he shall nevertheless be entitled to authorise payment for such work either under the conditions set out in the Pricing Document (on being satisfied as to the details of the work executed) or at such value therefor as he shall consider fair and reasonable.
Daywork. (1) The Superintending Officer may, if in his opinion it is necessary and desirable, order in writing that any work to be carried out as a result of an instruction ordered under Clause 19.2 shall be executed on a daywork basis.
(2) The Contractor shall then be paid for such work at the daywork rates set out in the Contract or if no such rates are available, at the rates determined by Superintending Officer as prevailing when the work is actually carried out.
(3) It is a condition precedent to payment that the Contractor shall submit to the Superintending Officer the daywork sheets specifying the number of man-hours spent on the work on a daily basis, and statement showing any Plant, Construction Equipment, material and goods necessary in respect of all works executed on a daywork basis for verification within 3 days after the work has been executed.
(4) The Contractor shall inform the Superintending Officer in advance whenever he proposes to carry out daywork.
Daywork. The percentage allowances to cover overhead charges for daywork which has not been included in the Daywork Schedule, are as follows: 50% of the gross remuneration of workmen and foremen actually engaged in the daywork; and 25% on the net cost of materials actually used No allowance will be made for work done, or for materials and equipment for which daywork rates have been quoted at tender stage.
Daywork. 24.1 Ordinary Hours of Work
a) Day workers will work their ordinary hours between Monday and Friday in accordance with the roster cycles set out in Clause 23. Day work shall commence between 6:00am to 11:00am and finish no later than 8:00pm.
b) The ordinary rostered hours to be worked will be not less than six (6) hours and will not be more than twelve (12) hours.
Daywork. 30.3.1 The ordinary hours of work prescribed herein may be worked continuously (exclusive of meal breaks) between 7.00am and 6.00pm on any or all of the days of the week from Monday to Friday. The days on which ordinary hours are worked may include Saturday and Sunday, subject to agreement between dnata Catering Australia and a majority of employees concerned. Agreement in this respect may also be reached between dnata Catering Australia and individual employees.
30.3.2 The spread of hours or daily hours may be altered by mutual agreement between dnata Catering Australia and the majority of employees in the section or sections concerned.
30.3.3 Work done between 5.00am and the commencement of the spread of hours fixed in accordance with 30.3.2 for which overtime rates are payable will be deemed to be part of the ordinary hours of work where the ordinary hours worked within the prescribed spread are less than 38. This clause does not apply to employees engaged in the maintenance of plant.
30.3.4 Where agreement is reached in accordance with 30.3.1, the minimum rate to be paid for a day worker for ordinary time worked
30.3.5 Where agreement is reached in accordance with 30.3.1, the minimum rate to be paid for a day worker for ordinary time worked between midnight on Saturday and midnight on Sunday shall be double time.
(a) Employees must receive a meal break of 25 minutes per day. Where operational requirements exist, an employee may be required to work for up to six hours before taking a meal break without payment of overtime.
30.3.6 (b) dnata Catering Australia must grant employees two tea breaks of 10 minutes each shift.
Daywork. For work of a minor or incidental nature, the Employer/s, with notice to the financial institution providing the funding for the Project/s, may instruct that a Variation shall be executed on a daywork basis. The work shall then be valued in accordance with the daywork schedule included in the Contract, and the following procedure shall apply. If a daywork schedule is not included in the Contract, this Sub-Clause shall not apply. Before ordering Goods for the work, the Contractor shall submit binding quotations of its own choosing to the Employer/s and the financial institution providing the funding for the Project. When applying for payment, the Contractor shall submit invoices, vouchers and accounts or receipts for any Goods. Except for any items for which the daywork schedule specifies that payment is not due, the Contractor shall deliver each day to the Employer/s and the financial institution providing the funding for the Project, accurate statements in duplicate which shall include the following details of the resources used in executing the previous day's work:
(a) the names, occupations and time of Contractor's Personnel,
(b) the identification, type and time of Contractor's Equipment and Temporary Works, and
(c) the quantities and types of Plant/s and Materials used. One copy of each statement will, if correct, or when agreed, be signed by the Employer/s and returned to the Contractor and the financial institution providing the funding for the Project/s. The Contractor shall then submit priced statements of these resources to the Employer/s and the financial institution providing the funding for the Project, prior to their inclusion in the next Statement under Sub-Clause 14.3 [Application for Interim Payments].
Daywork. In the event the Principal approves and directs a Work Order on a daywork basis, the rates and prices contained in this Section 2.2.1 of Schedule 3 will be applied. The Contractor shall during the continuance of such Work Order deliver each day to the Principal two (2) copies of complete and exact lists stating names, occupation and time expended by all labour including equipment employed on such Work Order, herein referred to as Daywork Sheet. One (1) copy of the Daywork Sheet will, if correct or when agreed, be signed by the Principal Representative and returned to the Contractor. During the performance of a Work Order, the Contractor must submit to the Principal a weekly priced statement of the agreed Daywork Sheet summarising the labour, equipment, plant and/or materials used until the Work Order work under the Work Order are completed.
Daywork. The Superintendent may direct that quantities greater than those determined by reference to the upper limit of accuracy referred to in Clause 3.3 or variations directed by the Superintendent under Clause 40.1 shall be carried out as Daywork. The Contractor shall thereafter each day record particulars of all resources used by the Contractor for the execution of the Daywork and each day furnish to the Superintendent the particulars and copies of time sheets, wages sheets, invoices, receipts and other documents evidencing the cost of the Daywork. The Superintendent may direct the manner in which matters are to be recorded. In determining the value of Daywork regard shall be had to—
(a) the amount of wages and allowances paid or payable by the Contractor at the rates obtaining on the Site at the time as established by the Contractor to the satisfaction of the Superintendent or at such other rates as may be approved by the Superintendent;
(b) the amount paid or payable by the Contractor in accordance with any statute or award applicable to day labour additional to the wages paid or payable under Clause 41(a);
(c) the amount of hire charges in respect of Constructional Plant approved by the Superintendent for use on the work in accordance with such hiring rates and conditions as may be agreed between the Superintendent and the Contractor or, in the absence of agreement, in accordance with such rates and conditions as may be determined by the Superintendent;
(d) the amounts paid for services, subcontracts and professional fees;
(e) the actual cost to the Contractor at the Site of all materials supplied and required for the work; and
(f) the charge stated in the Annexure or, if no charge is stated, a charge agreed between the Superintendent and the Contractor to cover overheads, administrative costs, site supervision, establishment costs, attendance and profit, or, in the absence of agreement, a reasonable charge determined by the Superintendent. Amounts payable for Daywork shall not be subject to adjustment for rise and fall in costs notwithstanding that the Contract may provide for adjustment for rise and fall in costs.
