Duties and Conditions of Employment a. The duties covered by this Agreement of the UAF Local 1324 Unit Members of the Fire Department shall include the prevention and suppression of fire, public education, emergency medical services, rescue services, mitigation of hazardous materials incidents and other activities commonly performed by Fire Services. b. The University agrees that it will not use members of other fire departments, agencies or individuals, not otherwise referred to in this Agreement, and from outside this bargaining unit to perform any covered duties because of a lack of manpower or the unavailability of an employee. This provision does not preclude the use of mutual aid. c. UAF Local 1324 Unit Members will not be required to perform any law enforcement duties or duties in connection with riot control or crowd dispersal, except as in 6.8.d. This provision does not restrict the performance of code enforcement duties. d. Members of the Fire Prevention Division and other Members designated by the Fire Chief may enforce the provisions of the Fire Code as adopted by the University, or other applicable Alaska Statute and Regulations relating to fire investigation.

Duties and Conditions of Employment. (a) On behalf of the Board, the Executive shall: i. perform such duties and exercise such powers related to the offices of Director of Education and Secretary-Treasurer of the Board, in accordance with Board policy and the applicable provisions of the laws of the Province of Ontario and, in particular, the Education Act, including pursuant to sections 283 and 283.1 thereof; ii. perform such other duties within the scope of her employment as may be assigned by the Board as determined by resolution of the trustees or the Chair of the Board at any time and from time to time in keeping with her position as Director of Education and Secretary-Treasurer; and iii. diligently and faithfully serve and promote the best interests of the Board and shall conduct herself in accordance with Board policies and in accordance with applicable law and, in particular, the Education Act. (b) The Executive agrees that she will not apply for the permanent position of Director of Education and Secretary-Treasurer of the Board during the Term.
Duties and Conditions of Employment. The Superintendent agrees to fully and faithfully perform the duties of Superintendent in a competent and professional manner in accordance with the established policies, directives, regulations and position descriptions enacted from time to time by the Board of Education and in accordance with the laws of the State of Michigan and the United States. The Superintendent agrees to comply with all laws regarding legal qualifications for the office of Superintendent. If at any time the Superintendent fails to hold and maintain any certification required by the Michigan Department of Education, or as may be hereafter required by the Department of Education, this contract shall automatically terminate, shall be considered null and void and shall relieve the Board of all obligations under this contract. The Board will jointly develop goals and objectives with the Superintendent involving a long- range 1-5 year plan. Those goals are made a part of this contract and are incorporated as fully as if set forth herein; the Superintendent’s performance in meeting these goals and objectives shall be reviewed by the Board annually, at the evaluation. The Superintendent shall notify the Board in January of each year of this provision. The Superintendent agrees she will comply with all applicable Michigan Law on conflicts of interest prior to requesting approval to engage in outside activities. The Superintendent is authorized to manage and supervise the daily operations of the School District, and to organize, reorganize, and arrange the administrative and supervisory staff, including instruction and business affairs, in a manner which in her judgement best serves the School District and meets all requirement of state and federal law. The responsibility for selection, placement, supervision and transfer of personnel shall be vested exclusively in the Superintendent, subject to final approval by the Board; and the Board members, individually and/or collectively, will refer promptly all criticisms, complaints and suggestions called to its attention to the Superintendent for study and recommendation. The Board shall provide the Superintendent with periodic opportunity to discuss the Superintendent-Board relationship and shall evaluate her annually in the manner required by law. The University agrees that it will not use Local 1324 bargaining unit members of other fire departments, agencies or individuals not otherwise referred to in this Agreement and from outside this bargaining unit to perform any covered duties because of a lack of personnel or the unavailability of a UAF Local 1324 bargaining unit member. This provision does not preclude the use of mutual aid. This shall not preclude the university from using qualified Local 1324 bargaining unit members from filling temporary, unforeseen short-term needs as mutually agreed upon between the University and the bargaining unit. c. UAF Local 1324 bargaining unit members will not be required to perform any law enforcement duties or duties in connection with riot control or crowd dispersal. This provision does not restrict the performance of code enforcement duties. d. Members of the Fire and Life Safety Division and other bargaining unit members designated by the Fire Chief may enforce the provisions of the Fire Code as adopted by the University, or other applicable Alaska Statute and Regulations relating to fire investigation.

  • Terms and Conditions of Employment The term “terms and conditions of employment” means the hours of employment, the compensation therefore including fringe benefits except retirement contributions or benefits, and the Board of Education’s personnel policies affecting the working conditions of the employees. The term is subject to the provisions of Section 179A of PELRA, as amended, regarding the rights of public employers and the scope of negotiations.

  • OTHER CONDITIONS OF EMPLOYMENT Certificate based on Masters degree, 18 total years pay credit or classified step, Non-Probationary ,Local Longevity =$1000, Base Contract @ $48,532. All contracts are issued contingent upon employee having appropriate certification or endorsement or approved ALP. All contracts are also contingent upon successful completion of criminal background check. Where applicable, certified salaries include $3000 from the “Targeted Educator Compensation Act” of 2001. Where applicable the employee has also had included within Compensation For Services a stipend for 18 years of Local Longevity Credit.

  • Conditions of Employment It is a term and condition of employment and of the obligations and rights occurring under this Agreement, that an employee: i) properly use and maintain all appropriate protective clothing and tools and equipment supplied by the Company for specified circumstances; and ii) use any technology and perform any duties which are within the limits of the employee's skill, competence and training: and iii) Understand that termination of employment will be based on job requirements and skills and that the principle of "last on - first off' will not apply. The Company reserves the right to terminate a probationary employee at any time during this 3 month period subject to a week's notice or payment in lieu thereof. The Company's right to employ persons on a specified task and/or specified period basis is acknowledged.

  • Other Terms and Conditions of Employment Where an assessment has been made, the applicable percentage shall apply to the wage rate only. Employees covered by the provisions of the clause will be entitled to the same terms and conditions of employment as all other employees covered by this Agreement paid on a pro-rata basis.

  • Other Terminations of Employment In the event of your termination of employment by Skyworks for Cause or by you for any or no reason other than as a termination of employment described in Sections 1.1, 3.1, or 4.1, you shall not be entitled to any benefits under this Agreement; provided, however, that Skyworks shall pay you any unpaid wages and vacation as may be required by applicable law and provide you with the ability to elect any continued health coverage as may be required under COBRA or similar state law.

  • SAFETY CONDITIONS OF EMPLOYMENT A. The District and its employees shall be safety conscious in their conduct and actions and shall cooperate in the implementation of the District's safety program. B. Employees shall report any unsafe or unhealthy conditions directly to their supervisor. The District shall conduct investigations of employee reports and take appropriate measures as soon as possible. The employee shall be informed by the principal or designee of the results of the investigation and of whatever action is to be taken. Safety violations will be corrected within ten (10) working days whenever possible. C. Teachers shall not be required to work under unsafe conditions or to perform tasks which endanger their health and safety. D. First aid supplies and first aid treatment shall be available to employees at each school site. A first aid kit shall be provided for each District vehicle used to transport pupils and shall be taken on all field trips. E. Personal protection equipment required by an employee's job duties shall be available from the principal or designee at each school site. F. An employee shall immediately report any assaults in connection with his/her employment to the principal or immediate supervisor who shall report the incident to the appropriate law enforcement agency and the District Office. 1. An employee may exercise the same degree of physical control over a pupil that a parent would be legally privileged to exercise, but which in no event shall exceed the amount of physical control reasonably necessary to maintain order, protect property, or protect the health and safety of pupils. 2. An employee shall receive applicable insurance and leave benefits for any injury incurred under the provisions of this Paragraph. 3. Employees shall be reimbursed for damage to personal property resulting from assault under the provisions of this Paragraph. 4. When the continued presence of a pupil in a class represents a physical danger to a teacher, the teacher may request that the principal institute suspension procedures in accordance with District policy. 5. The District's "Student Discipline Policy" shall be made available to employees.

  • Duties and Scope of Employment The Company shall continue to employ the Executive in the position of Executive Vice President and Chief Financial Officer with such duties, responsibilities and compensation as in effect as of the Effective Date. The Board and the Chief Executive Officer of the Company shall have the right to revise such responsibilities and compensation from time to time as the Board or the Chief Executive Officer may deem necessary or appropriate. F) The Executive shall not receive fees or other remuneration for work performed either within or outside the scope of his employment without prior written consent of the BOD.
