EMPLOYEE RIGHTS AND OBLIGATIONS. Section 1. The Employer and the Union agree that employees in the bargaining unit shall have the right to form, join, or assist the Union, or to refrain from any such activity, freely and without fear of penalty or reprisal, and each employee shall be protected in the exercise of such right. Section 2. Employees have the right, regardless of Union membership, to bring matters of personal concern to the attention of appropriate officials in accordance with applicable laws, rules, regulations, or established agency policy. Section 3. Employees have the right to be represented by an attorney or by a representative, of their choice, in any grievance or statutory appeal action, except those subject to the negotiated grievance procedures contained in this Agreement. Section 4. Nothing in this Agreement shall require an employee to become or to remain a member of the Union, or to pay money to the organization except pursuant to a voluntary, written authorization by a member for the payment of dues through payroll deduction as further delineated in this Agreement. Section 5. The Union shall be given the opportunity to be represented at any examination of a unit employee by a representative of the Employer in connection with an investigation if: A. The employee reasonably believes that the examination may result in disciplinary action against the employee; and B. The employee requests representation. These rights will be posted on all bulletin boards and remain posted until updated by management on an annual basis. Section 6. The parties recognize where an investigation takes place as outlined in Section 5 above, and the employee requests Union representation, it is in both parties’ interest that a Union-designated representative be released from normal duties in a timely fashion. This allows for both the statutory representation process to take place and the investigative procedure to Section 7. The employee has the right to confer with the Union during duty hours concerning grievances, complaints, appeals, or other appropriate matters. An employee desiring to confer with a Union representative will make the request for time to his immediate supervisor and obtain approval prior to leaving his work area. Supervisors will grant the request within a reasonable amount of time and any absences from the work area will be limited to reasonable amount(s) sufficient in duration to conduct discussions and/or actions deemed necessary. EMPLOYEE RIGHTS AND OBLIGATIONS. Employees covered by this Agreement shall have, and shall be protected in the exercise of, the right to form, join, or assist, freely and without fear of penalty or reprisal, the Union; to act in the capacity of a Union representative; to present the views and positions of the Union to the public, to officials of the Town and the Department, to members of the Board of Selectmen of the Town of Hanover, the Public Works Commission or the general public, or to any other appropriate authority or official; to engage in other lawful Union and concerted activities for the purpose of collective bargaining or other mutual aid or protection; and to refrain from any or all such activities. In the exercise of such rights, the employees shall be free from any and all interference, restraint or coercion, and from any discrimination in regard to tenure, promotion, or other conditions of employment. Employees shall be allowed access to their personnel folder to review its contents, upon written request to the “keeper of the records”, setting a mutual agreed upon time for review. A copy of any document put into the employee’s personnel folder shall be given to the affected employee at the time it is put into the folder.
EMPLOYEE RIGHTS AND OBLIGATIONS. A. Employees covered by this Agreement shall have the right, and shall be protected in the exercise of that right, freely and without fear of penalty or reprisal, to form, join and assist employee organizations, or to refrain from such activity; to hold office in and participate in the management of the Association, to act in the capacity of Association representative; and to engage in other lawful Association and concerted activities for the purpose of collective bargaining or other mutual aid or protection; except that no official of the Town of Barnstable shall participate in the management of the Association or act as its representative if such activity would be incompatible with his or her official duties. B. In the exercise of the aforementioned rights, all employees covered by this Agreement shall be free from any and all interference, restraint and coercion, and such employees shall be protected against any discrimination in regard to permanency, promotion or other conditions of employment. C. Neither the Committee nor the Association will discriminate against any employee covered by this agreement because of race, color, creed, sex, national origin, marital status, age or sexual orientation in accordance with the law. D. Paraprofessionals will immediately report to their supervisor or building principal in writing all cases of abusive conduct and/or torts suffered by them in connection with their employment. This report will be forwarded to the Assistant Superintendent who will comply with any reasonable request from the Paraprofessional for information in his possession relating to the incident or person involved, and will act as the liaison between the Paraprofessional, the police and the courts. E. If criminal or civil proceedings are brought against a Paraprofessional alleging that he committed an assault in connection with his employment, the Committee may furnish legal counsel to defend him in such proceedings, if he requests such assistance.
EMPLOYEE RIGHTS AND OBLIGATIONS a. Each bargaining unit employee shall have the right to form, join, or assist any labor organization, or to refrain from any such activity, freely and without fear of penalty or reprisal, and each employee shall be protected in the exercise of such right. b. Each bargaining unit employee may file a grievance concerning conditions of employment subject to the control of the Employer under Article 6 of this Agreement. c. Each bargaining unit employee has the right to fair and equal representation by the Union regardless of dues-paying status. The parties agree, however, the Union has no duty to represent non-dues paying bargaining unit employees in situations where statutory appeals procedures are available. d. The Supervisor’s Work Folder (commonly referred to as AF Form 971), is the supervisor’s record relating to a subordinate employee. Upon request, employees or their properly authorized representative will be given a copy of documents placed in the Supervisor’s Work Folder. Employees will be permitted to review the Supervisor’s Work Folder, pertaining to them upon request at reasonable intervals. The employee must make requests for their supervisor to disclose the Supervisor’s Work Folder to a representative in writing. Any other access to the Supervisor’s Work Folder, is limited to persons having an official need to know.
EMPLOYEE RIGHTS AND OBLIGATIONS. Each employee has the right, freely and without fear of penalty or reprisal, to form, join and assist a labor organization or to refrain from any such activity; and each employee shall be protected in the exercise of this right. Except as otherwise provided in Title 5 U.S. Code, Chapter 71, the right to assist a labor organization extends to participation in the management of the organization and acting for the organization in the capacity of an organization representative, including presentation of the views of the labor organization to heads of agencies and other officials of the Executive Branch, the U. S. Congress, or other appropriate authorities and to engage in collective bargaining with respect to conditions of employment through representatives chosen by employees.

EMPLOYEE RIGHTS AND OBLIGATIONS. Bargaining unit members are required to pay Association fees or in-lieu monies. For Chapter dues see Article 4. 4.2.1 New hires who come into the bargaining unit, shall either within thirty (30) calendar days of their acceptance of a position, apply for membership and execute an authorization for dues deduction on a form provided by the Association or in the alternative, the District shall deduct from the wages of bargaining unit members not applying for membership, an Association fee as set forth in the Association fee schedule. 4.2.2 A bargaining unit member may pay Chapter dues or Association fees directly to the Association instead of having such deductions taken from his/her wages. Association fees shall not be deducted until the bargaining unit member has been informed of his/her option to pay Association fees directly to the Association.
EMPLOYEE RIGHTS AND OBLIGATIONS. Nothing in the agreement shall require an employee to become or to remain a member of a labor organization, or to pay money to the organization except pursuant to a voluntary, written authorization by a member for the payment of dues through payroll deduction. Employees shall have and shall be protected in the exercise of the right, freely and without fear of penalty or reprisal, to form, join, and assist any employee organization or to refrain from such activity. Employees also have the right to designate representatives, freely and without restraint, coercion, or discrimination, for the purpose of bringing matters of a personal concern to the attention of management officials. Further, each employee of the Unit has the right, regardless of Union membership and/or status in the Unit, to bring matters of personal concern to the attention of appropriate officials in accordance with applicable laws, rules, regulations, and established policies and to freely select his/her own representative in formal grievance or appeal actions, except when presenting a grievance under a negotiated procedure or interpretation or application of the agreement.
