Extra Driving Assignments. All driving other than a morning or an afternoon route that is greater than one (1) hour will be considered extra driving and assigned by seniority. Extra driving beyond regular routes shall be offered to employees on a seniority rotation basis. The Director of Transportation shall establish the rotation system after review of the system with the Association President. Modifications to the system shall be made only after notice to, and review with, the Association President. Extra driving as assigned by the Director of Transportation will be paid at the assigned drivers’ regular rate rounded up or down to the nearest one-quarter (¼) hour worked. Layover pay (non-driving time between routes) will be paid if it is for thirty (30) minutes or less. There will be no layover pay if time between routes is greater than thirty (30) minutes. Any extra driving beyond the foundation route hours of 1,020 hours will be posted with estimated route duration. Should this route’s actual driving time be overestimated, the driver will be paid the full amount of the estimate. Should the route’s actual driving time be underestimated, the driver will be paid on the basis of actual driving time recorded. Provided the District has first followed the internal rotation system, including emergency procedures, and no unit member accepts the extra driving opportunity, the District may assign the work to non-unit personnel. If the District is unsuccessful in obtaining a non-unit person to take the assignment, then bargaining unit personnel can be assigned to the extra driving provided the assignment to a unit member is made no sooner than 24 hours before the extra driving assignment begins.

If two trips fall within the same day, the most senior driver shall have his/her choice of the runs. If a driver accepts a trip but then is unable to drive it, the trip will be returned to the Transportation Supervisor for assignment to the next driver in rotation. Substitute drivers may be assigned extra trips if late notice is provided to the Transportation Supervisor. To ensure that all extra trips are safely covered, the Transportation Supervisor may intervene. This may include assigning trips out of rotation (ex; New York City Trips and such).
Extra Driving Assignments. An extra driving assignment (EDA) shall be defined as a driving assignment, other than additional driving or a.m., p.m., noon runs, that includes but is not limited to sports trips, field trips, spectator buses, ski trips, and Wheatland recreation trips. All extra driving assignments shall be offered to the most senior driver in the unit and progress to the least senior member on a rotating basis provided the driver is available for the assignment and provided the assignment does not create any overtime situations. All requests for extra driving service shall be in writing and dated and time-stamped when received.

Extra driving assignments may take place during the regular school day, before or after the regular day, or on Saturdays, Sundays, or holidays. Extra assignment rosters shall be maintained, and trips rotated separately as follows: (1) For weekend (Saturday and Sunday) and holiday trips. (2) For work-week trips. The trip to outdoor camp and the return trip to the District shall be counted as separate field trips and will be assigned pursuant to the procedures in this Article. Each day of the swimming program shall be counted as a separate extra driving assignment. (3) Hours shall be rotated in each circumstance above as per Section c. & d. below. i. There may be occasional need for districtwide transportation of students, which will not be considered extra driving assignments.

The Transportation Supervisor shall prepare a list on the basis of seniority of all drivers so indicating their desire to drive extra driving assignments. The list and trip assignments shall be available for review at the bus garage for the entire school year. B. A listing of all extra driving assignments shall be posted in the bus garage on Friday by 8:30 a.m. All drivers that are interested in taking trips are to report to the bus garage on Monday at 8:30 a.m. on the week prior to when the trips are to be run, except when school is not in session in which case the posting shall occur on Tuesday at 8:30 a.m. of that week. When your name comes up on the rotation list, you can sign up for extra trips, or list your choices of trips on the sheet, or you are passed. The trips shall immediately be assigned on a rotating seniority basis, from the posted list and according to the choices made known. Drivers refusing to make choices known by signing up shall be passed over until their next turn in the rotation. There shall be no double tripping. A double trip is defined as a trip that is being transported to and from a location with no layover time required for the driver if the students arrive and return on the same day. A substitute driver will be utilized to drive extra trips if the extra trip conflicts with the regular driver’s route. In the event an emergency arises and the assigned driver is not available, the Transportation Supervisor shall assign the next available driver or a substitute driver to take the extra trip. Newly hired bus drivers shall be added to the rotating list upon request in writing. Clean-up time, fueling, and pre-trip inspection shall be 45 minutes on days the driver has not previously received that time C. It is the responsibility of the building principal and athletic director to see that schedules are delivered to the Transportation Supervisor two (2) weeks prior to the season, if known in advance, or by the posting period unless the event is dependent on a previous win. D. When last-minute assignments are necessary, and were scheduled to occur after the current posting date, but prior to the next posting date, they shall be offered in accordance with the rotating seniority procedure.   • Teaching Assignments No employee shall be assigned to teach in a grade level and/or subject area not within the scope of his/her teaching certificate, except where a position within his/her certification is unavailable or when mutually agreed to by the affected employee and principal, or when determined necessary by the principal. Employees assigned to positions outside the scope of their certificates shall be assigned as soon as possible to positions for which they hold certification.

  • Overtime Assignments 1. In classifications where employees are eligible for overtime pay, overtime work shall be offered to employees within the work location involved from the appropriate work group in continuing rotation on the basis of seniority. Each employee shall be selected in turn according to his/her place on the seniority list by rotation provided, however, the employee whose turn it is to work possesses the qualifications, training and ability to perform the specific work required. 2. An employee requesting to be skipped when it becomes his/her turn to work overtime shall not be rescheduled for overtime work until his/her name is reached again in orderly sequence and an appropriate notation shall be made on the overtime roster. 3. In the event no employee accepts required overtime work, the State shall assign employees within the work location involved from the appropriate work group to perform the overtime work by continuing rotation in inverse order of seniority. Employees who are unavailable, including employees who are on vacation, sick leave or other approved leaves of absence, and employees for whom the requirement of overtime work would cause undue hardship, shall be excused from a required overtime assignment. Employees so excused shall not lose their eligibility for overtime work within the then current rotation. 4. Work in progress, when appropriate, shall be completed by the employee performing the work at the time the determination is made that overtime is required except that an employee for whom the requirement of overtime work would cause undue hardship shall be excused from the overtime assignment.

  • Shift Assignments When an opening occurs in a shift assignment in an appropriate work group at a location, preference shall be given to employees within the classification who possess the training, ability and any required special qualifications to perform the work required, on the basis of seniority. In the event that no employee desires a shift assignment, employees shall be selected in order of inverse seniority. This provision shall not apply to necessary training assignments. This provision shall not in itself alter the practice of rotating shifts where such practice presently exists. No employee who has a regular shift assignment on the effective date of the Agreement shall be involuntarily displaced from such shift assignment as a result of this Article.

  • Subcontracting; Assignment The Contractor may not subcontract any portion of the services provided under this Contract without obtaining the prior written approval of the Procurement Officer, nor may the Contractor assign this Contract or any of its rights or obligations hereunder, without the prior written approval of the Procurement Officer provided, however, that a contractor may assign monies receivable under a contract after due notice to the State. Any subcontracts shall include such language as may be required in various clauses contained within this Contract, exhibits, and attachments. The Contract shall not be assigned until all approvals, documents, and affidavits are completed and properly registered. The State shall not be responsible for fulfillment of the Contractor’s obligations to its subcontractors.

  • Work Assignments Section 1. The Company shall determine whether to staff a position or fill a vacancy and the method or combination of methods it shall use for such purposes. In making this determination, the Company shall first give consideration to qualified internal candidates prior to off-street applicants. All vacancies within the Bargaining Unit shall be posted (manually or electronically) in such a fashion as to be accessible by employees. The posting shall include the title, pay range, and sufficient information regarding requirements and duties to adequately describe the vacancy. The vacancy shall remain posted for seven (7) calendar days. Section 2. In connection with Section 1. above, employees who have met a twelve (12) month time-in-title and location requirement shall be afforded the opportunity to submit to the Company a form on which they may identify their interest in being considered for vacancies which occur in the Bargaining Unit. Section 3. When a vacancy is to be filled from within the Bargaining Unit, Management will consider all qualified candidates who have forms on file relating to the vacancy in question. In selecting the employee to fill the position, the Company will first give due consideration to the candidates’ qualifications and past performance and where those factors are relatively equal, in the judgment of the Company, it shall consider seniority. Section 4. The Company agrees to provide the Union, in writing, the names and titles of all candidates selected under this Article, by the fifteenth (15th) calendar day after any such selection is made. Section 5. Nothing in this Agreement shall be applied or interpreted to restrict the Company in the exercise of its right to hire, promote or transfer; and, to the extent the needs of the business require, to have Bargaining Unit work performed by its supervisory personnel, or its right to make sales assignments without limitations.

  • Room Assignments A. It is the policy of University to assign roommates without regard to veteran status, race, religion, age, sexual preference, disabilities, or national origin. Generally, Student may request to live with a designated student based on a self-selection process. In this instance, Student preference profiles may be considered by Student but will not be considered by University. If Student does not self-select a room space, University will assign a space to the Student. Alternatively, University may try to match roommates based on Student preference profiles. In any case, University cannot guarantee requested preferences in the room assignment process. University may assign or reassign Student without regard to requested preferences to a specific hall, room or roommate. B. If Student executes multiple contracts for housing accommodations in University-Owned and managed properties for an overlapping academic term, University may terminate the earliest executed contract(s). In such instance, University will email contract termination notice to Student in accordance with Section XVII. C. Students without disabilities may reside in Residence Hall rooms which have been specifically designed to accommodate persons with disabilities. In the event a Residence Hall room is needed to accommodate a person with a disability, Student may be required to relocate to alternate University Campus Housing accommodations. In this instance, University shall pay reasonable moving expenses to relocate occupant(s) to alternate accommodations. In this instance, University shall provide no less than three (3) days written notice prior to terminating the existing Contract. In addition, University will also credit $300 to each relocated student in appreciation of any inconvenience the student may experience. D. If permanent space is not available, the UT Arlington Housing Office may place Student in temporary space until permanent space is available. During this period, Student will earn a 25% credit on the daily rate of the room portion of the Contract. If the UT Arlington Housing Office places Student in a temporary space, Student is bound to the terms and conditions of the Contract through the fifth class day. After the fifth class day and before the UT Arlington Housing Office offers Student permanent space, Student may cancel the Contract upon written notice and payment of the prorated amount under the Contract for the number of days that Student occupied the temporary space. E. Only the person(s) assigned by the UT Arlington Housing Office to Student’s room may reside in the room. The UT Arlington Housing Office reserves the right to make changes in room assignments for such reasons as the UT Arlington Housing Office determines to be appropriate in its sole and absolute discretion, including, without limitation, roommate conflicts, pending disciplinary action, non-compliance with University Regulations, and disruptions to the community. F. If Student fails to move to a new location within the Residence Halls within twenty-four hours after the UT Arlington Housing Office has issued to Student authorization or direction to move, Student may be assessed an improper check out fee and referred to the Office of Community Standards for disciplinary action. G. Single occupancy in double rooms is allowed only on University’s prior approval, which may be withheld in its sole and absolute discretion. Requests for single occupancy must be submitted in writing to the Leasing Consultant in University Housing Office for approval. Single room occupancy in rooms designated as double occupancy will be charged at one and seven-tenths (1.7) times the double room rate. If the University has a waitlist for Residence Hall bed space, single room contracts may be changed to double room contracts. University will provide to Student a forty-eight (48) hour notice and the rent will be adjusted accordingly. H. If Student's roommate vacates the double room or if Student’s suitemates all vacate the suite, Xxxxxxx agrees to accept another roommate or suitemate as assigned. Student may be asked to move to another room if requested by the UT Arlington Housing Office. Failure to move may result in Student being charged a single room rate and improper check out fee in addition to a referral to the Office of Community Standards for disciplinary action. I. Room changes may be made only with the approval of the Residence Director. Hall and/or room type changes may be made only with approval of the UT Arlington Housing Office. Students who complete a hall and/or room type change will be required to sign a new contract. Once signed, no changes will be made to the contract until two weeks after the Residence Halls open. Requests for changes will be accepted on opening day and afterwards. J. University reserves the right to consolidate vacancies and close all or part of Residence Halls.

  • Overtime Assignment A. In institutional settings when the Agency determines that overtime is necessary, overtime shall be offered on a rotating basis, to the qualified employees who usually work the shift where the opportunity occurs. If no qualified employees on the shift desire to work the overtime, it will be offered on a rotating basis first to the qualified employee with the most state seniority at the work site. When there are no volunteers to work the overtime as outlined above, and/or where an emergency exists, reasonable overtime hours may be required by the Agency. Such overtime shall be assigned, on a rotating basis, first to the qualified employee with the least state seniority at the work site. This policy shall not apply to overtime work which is specific to a particular employee’s claim load or specialized work assignment or when the incumbent is required to finish a work assignment. B. In non-institutional settings, the Agency reserves the right to schedule and approve overtime. In emergency situations overtime may be approved after the fact. Required overtime that can be worked by more than one (1) employee at the work site (that which is not specific to the particular employee’s case load or specialized work assignment) will be offered on a rotating, state seniority basis. If no qualified employee volunteers for the work, or where an emergency exists, then the qualified employee with the least state seniority at the work site will be assigned on a rotating basis. C. The parties recognize that in both institutional and non-institutional settings, that the Employer has the right to require mandatory overtime where necessary; however, the Employer will not abuse the utilization of mandatory overtime.

  • Deed; Xxxx of Sale; Assignment To the extent required and permitted by applicable law, this Agreement shall also constitute a “deed,” “xxxx of sale” or “assignment” of the assets and interests referenced herein.

  • Extra Duty Assignments A. Any assignment in addition to the normal teaching schedule during the regular school year shall not be obligatory, except band, choir and drama (if a class), but shall be with the consent of the teacher. 1. Preference in making such assignments shall generally be given to teachers regularly employed in the District. The final appointment will be made in the best interest of the students. 2. Applicants for Schedule B positions must meet minimum requirements as developed by the District 3. If there is more than one teacher applicant for a Schedule B position, the teacher whom the Superintendent deems is best qualified in the activity will be awarded the position after considering the teacher's previous experience in the activity and professional background. 4. If the Board is unable to fill the position with someone from the outside, the Board may assign the position to a teacher. 5. No teacher shall be required to accept more than one (1) such position per school year. 6. Advance notice of any such assignment shall be given as soon as practical but at least fifteen (15) days before the assignment begins except for emergencies and those assignments that begin before the opening of school, or during the first week of school. It is agreed that co-curricular and extra-curricular positions are non-tenure in nature. B. Returning Staff 1. All persons holding Schedule B positions shall be contacted, by the Athletic Director or Principal, no later than June 30, for fall and winter activities, and October 30, for spring activities, and shall, at that time, indicate their intent to continue in said position. 2. All vacancies shall be posted as soon as reasonably possible. 3. Attempts will be made to fill all positions no later than two (2) weeks before the start of the activity. C. Experience Credit for Extra Duty. Supplemental pay for Schedule B activities shall be based upon the appropriate salary step of Schedule B. For the purpose of step placement on Schedule B, the following will apply: 1. Teachers will be given credit for each year's experience in a particular activity which they are to perform on the extra duty schedule which is comparable to the previous position (i.e. same sport or activity) they performed at their prior place of employment. However, step placement will be no higher than Step 4 and there shall be no retroactive payment for past years services. 2. When changing positions within a particular activity which is comparable to the previous position (i.e. same sport or activity), step placement will be maintained within and between classes, except that if the change would result in movement to a higher paying class, step placement will be no higher than Step 4. 3. A teacher who is currently holding a position covered by Schedule B will be placed on said pay schedule in accordance with the above provision effective with this Agreement. 4. If a new program is developed during the term of this Agreement, compensation will be made on the basis of the nearest like program in Schedule B. D. Evaluation of Coaches. Coaches shall be evaluated in writing by the Athletic Director, Superintendent, or other administrator at the conclusion of the coaching season or school year, whichever is earlier. The coach may submit in writing any response desired which shall be attached to the evaluation.

  • Assignment of Leases The Assignment of Leases creates a valid assignment of, or a valid security interest in, certain rights under the Leases, subject only to a license granted to Borrower to exercise certain rights and to perform certain obligations of the lessor under the Leases, including the right to operate the Property. No Person other than Lender has any interest in or assignment of the Leases or any portion of the Rents due and payable or to become due and payable thereunder.
