Jury Duty/Witness a) An employee who is summoned for jury duty and is required to lose time from his/her assignment as a result thereof, shall be paid for actual time lost with a maximum of one basic day’s pay at the straight time rate of his/her position for each such day excluding allowances paid by the court for meals, lodging, transportation and other expenses.
b) An employee who is subpoenaed for witness other than as the accused and/or in cases of arbitration, shall be granted leave of absence for any day up to a maximum of ten (10) working days in any one (1) year, in which he/she is required to report for witness duty. Should the employee receive witness pay, only upon providing the Employer documentation attending to such, shall he/she be reimbursed an amount to ensure no loss in regular pay.
c) The number of days for which jury duty shall be paid is limited to a maximum of sixty (60) days within a twelve (12) month period commencing on the first (1st) day of jury duty.
Jury Duty/Witness. (i) In the event an employee is precluded from working his/her regular shift or shifts due to being called for and reporting for jury duty or to serve as a subpoena witness, the Company shall make up the difference in pay between the amount received for jury duty and for serving as a witness and the amount the employee would have earned for working his/her regular shift.
(ii) Employees selected for jury duty or to serve as a witness as above who are on other than the day shift, shall be assigned to the day shift for those days they are required to serve as jurors or appear as a witness.
(iii) In order to qualify for such compensation, the employee shall give forty-eight hours prior notice to the Company that such leave is required and shall present proper evidence as to attendance and the amount received for such services.
Jury Duty/Witness i) Leave with pay shall be granted when a Long-term Occasional Teacher is required to appear in court by reason of a summons to serve as a juror, or a subpoena as a witness in any proceeding to which he or she is not a party or one of the persons charged.
ii) The Occasional Teacher shall submit to the Board a certificate signed by a court representative testifying to his or her presence at court.
iii) The Occasional Teacher shall deposit with the Director of Education or the Director of Education’s designate the full amount of compensation received exclusive of reimbursement of expenses incurred by the Occasional Teacher.
iv) If the Occasional Teacher does not deposit the full amount of compensation stipulated in iii) above, salary deduction will occur.
v) These days shall not be deducted from sick leave credits.
Jury Duty/Witness. 25.01 This benefit is available for employees who have completed probation prior to receipt of notice for jury duty.
25.02 Employees who are subpoenaed for jury duty or to appear as a crown witness minus any moneys (not including those received for expenses) received from the court. Proof of such remuneration shall be submitted to the Employer by the employee. The subpoena shall be submitted to the Employer prior to such leave being granted. The Employer shall provide leave for jury duty in accordance with all applicable laws.
Jury Duty/Witness. Employees shall not suffer any time loss for time spent on jury duty or as a subpoenaed witness for a matter related to their City duties. If the employee is released from duty early, they will return to work. All compensation received as a result of such service, during the employee’s scheduled workweek, will be transferred to the City.
Jury Duty/Witness. The Employer shall grant leave of absence from work to an employee who:
(i) is required to serve on a jury or;
(ii) is subpoenaed as a witness before a Court of Justice, a Coroner's Inquest, or a Court of Inquiry;
(iii) produces a certificate of attendance and the employee returns to work on any day he is not required to serve for the entire day;
(iv) shall be paid the difference between their regular pay and the amount received as a juror or as a witness excluding travelling, meals and other expenses.
Jury Duty/Witness. A Long Term Occasional Teacher shall be granted a leave of absence from duty by reason of a summons to serve as a juror or a subpoena as a witness in any proceedings to which they are not a party or one of the persons charged and shall be paid the applicable earnings as stipulated in Article 18. It is understood that such payment by the Board shall only be for the period of time the Occasional Teacher would have otherwise been employed in the occasional teaching assignment.
Jury Duty/Witness. Teachers called for jury duty or when subpoenaed as a witness shall be paid the difference between the pay as a juror and regular salary. Such time as is spent in jury duty shall not be charged against the teacher’s sick leave.
Jury Duty/Witness. The District will pay full salary during the time a teacher is on jury duty or if a teacher is subpoenaed by a clerk of a court and served on the employee to attend as a witness at a trial or to have his or her deposition taken in any school-related matter pending in court. The teacher shall remit to the District the reimbursement given to the teacher for jury duty, excluding out-of-pocket cost for transportation and parking as determined by the county.
Jury Duty/Witness. When an employee is required to serve on a Jury, or is subpoenaed as a witness, she shall be relieved of her duties and she shall be paid the difference between her fee as a Juror or as a witness, and her earnings for the lost time. It is the employee's responsibility to come to work on any day that would otherwise be a scheduled working day that she is not actually required for Jury Duty or as a witness, or to be present in Court. The employee shall make a claim for Jury Duty or Witness Pay in writing to her Supervisor and she shall present proof of service and the amount of payment received. It is understood employees will only be paid the above difference in pay if they had been scheduled to work on the day(s) they serve on a Jury or as a subpoenaed Witness.
