Level of Service Standards. 5.2.1 Pursuant to Section 163.3180(13) (b), Florida Statutes, the level of service (LOS) standards set forth herein shall be applied consistently within each local government in Lake County for purposes of implementing school concurrency, including determining whether sufficient school capacity exists to accommodate a particular development proposal, and determining the financial feasibility of the School Board’s Work Program.
Level of Service Standards. School concurrency shall be applied on a less than district-wide basis to concurrency service areas as described in subsection (c), except that school concurrency shall be applied on a district-wide basis for special purpose schools. Special purpose schools draw students from the entire district, rather than a sub-district student attendance zone. The uniform, district-wide level-of service standards are set as follows, and shall be adopted in the County’s and Cities’ public school facilities elements and capital improvements elements: DISTRICT-WIDE TYPE OF SCHOOL ADOPTED LEVEL OF SERVICE Special Purpose 100% of total program capacity (including relocatables) BY STUDENT ATTENDANCE ZONE TYPE OF SCHOOL ADOPTED LEVEL OF SERVICE Elementary Schools Initial: 115% of permanent program capacity By 2012: elementary schools, with the exception of backlogged facilities, will achieve a level of service standard of 105% of permanent program capacity By 2017: all elementary schools, including backlogged facilities, will achieve a level of service standard of 105% of permanent program capacity. Middle Schools Initial: 100% of permanent program capacity By 2012: middle schools, with the exception of backlogged facilities, will achieve a level of service standard of 100% of permanent program capacity By 2017: all middle schools, including backlogged facilities, will achieve a level of service standard of 100% of permanent program capacity. High Schools Initial: 105% of permanent program capacity By 2012: high schools, will achieve a level of service standard of 100% of permanent program capacity The adopted Public School Facilities Element will designate concurrency service areas for backlogged facilities and shall establish interim level of service standards for these facilities. Within these designated areas, the interim standards for backlogged facilities will be improved to the adopted level of service standards within the ten-year period (by 2017) covered by the long term concurrency management program and Ten-Year Capital Facilities Plan. Potential amendments to the level of service standards shall be considered at least annually at the staff working group meeting to take place no later than April 1 of each year. If there is a consensus to amend any level of service standard, it shall be accomplished by the execution of an amendment to this interlocal agreement by all parties and the adoption of amendments to the County’s and each City’s comprehensive plan. Level of Service Standards. The Developer shall be required to meet the adopted level 24 of service standards in the City of Palm Coast Comprehensive Plan and the 25 requirements of the City’s Concurrency Management System (the “CMS”) as are in 26 effect on the date hereof; provided, however, mitigation for transportation impacts is 27 being implemented under provisions set forth in Section 163.3180(12), Florida Statutes, 28 and mitigation for school concurrency is being implemented under the provisions set 29 forth in Section 163.3180(13), Florida Statutes, by entering into the Proportionate Share 30 Agreement, each of which shall be deemed to satisfy concurrency requirements for 31 transportation and schools, respectively.
Level of Service Standards. Standard: The agency shall have level of service (LOS) standards for provision of land, facilities, and services within the jurisdiction. LOS standards are a type of performance measure associated with equitable provision service, such as the number of facilities per 1,000 residents in a service area or facilities available within a designated travel distance or travel time, e.g. percent of population that have a park within a 10-minute walk. LOS standard can also address other dimensions of equitable access, such as connectivity, maintenance and affordability, e.g. percent of parkland connected to the trail network.

Level of Service Standards. If there is only one school of one type (e.g., only one elementary, one middle or one high school) in a CSA and there is a school that will open in 2 years to provide enrollment relief, the level of service for the CSA may temporarily exceed the adopted level of service until the school providing relief is completed. After August 1, 2004, The following Level of Service (LOS) standards shall be established for all schools of each type within each CSA and each individual school:

Level of Service Standards a. The uniform methodology for determining if a particular school is over capacity shall be determined by the School Board. The level of service standards includes one component: FISH permanent capacity (excludes portables).
