MANAGEMENT'S RIGHTS CLAUSE. Any and all rights concerned with the management and operation of the City and its departments are exclusively that of the City unless otherwise provided by the terms of this agreement. The City has the authority to adopt rules for the operation of a department and conduct of its employees, provided such rules are not in conflict with the provisions of this agreement, Civil Service rules or with applicable law. The City has the right to, among other actions: discipline, temporarily lay off or discharge employees; assign work and determine duties of employees; schedule hours of work; determine the number of personnel to be assigned duty at any time; and perform all other functions not otherwise expressly limited by this agreement, the provisions of the Civil Service rules or applicable laws.
MANAGEMENT'S RIGHTS CLAUSE. The management of the schools and the direction of the working force, including the right to plan, direct and control department operations; to schedule and assign work to employees; to determine the means, methods, processes, materials, and schedules of operations; to establish standards and to maintain the efficiency of employees; to establish and require employees to observe Employer’s rules and regulations; to hire, layoff or relieve employees from duties; and to maintain order and to suspend, demote, discipline and discharge employees for just cause, are the recognized reserved rights of the Employer. The foregoing enumeration of management’s rights shall not be deemed to exclude other rights of management not specifically set forth, the Employer, therefore, retaining all rights not otherwise specifically restricted by this Agreement. The exercise by the Employer of any of the foregoing rights shall not alter any of the specific provisions of this Agreement; nor shall they be used to discriminate against any member of the Association or bargaining unit.

MANAGEMENT'S RIGHTS CLAUSE. The Employer is a public body established under and with powers provided by the statutes of the Commonwealth of Massachusetts and nothing in this Agreement shall derogate from the powers and responsibilities of the Employer under said statutes or the rules and regulations of agencies of the Commonwealth. MANAGEMENT'S RIGHTS CLAUSE. Not Subject to Grievance or Arbitration The authority reserved to the management and direction of the governmental unit shall not be subject to grievance or arbitration except as it affects wages, hours, terms and conditions of employment, and continuation, modification and/or deletion of an existing provision of this agreement.
MANAGEMENT'S RIGHTS CLAUSE. The County Board and the Sheriff on their own behalf and on behalf of their Electors, hereby retain and reserve unto themselves, all powers, rights, authority, duties and responsibilities conferred upon and vested in them by the laws and the Constitution of the State of Michigan and of the United States. Further, all rights which ordinarily vested in and are exercised by Employers except such as are specifically relinquished herein are reserved to and remain vested in the County, including, but without limiting the generality of the foregoing, the Right: (a) to determine the size of the work force and increase or decrease its size; (b) to hire new employees, to assign and lay off employees, to change the length of time of any work week or work day; (c) to direct the work force, to assign the type and location of work operations; (d) to establish and change work schedules, work standards, and the methods, processes, and procedures by which such work is to be performed; (e) to select employees for promotion or transfer to supervisory or other positions and to determine the work; (f) to establish training requirements for purposes of maintaining or improving professional skills of employees and for purposes of advancement; (g) to schedule the work days and the hours of work. The County reserves the foregoing rights except such as are specifically relinquished or modified by the terms of this Agreement. It is agreed that these enumerations of management prerogatives shall not be deemed to exclude other prerogatives not enumerated, and except as specifically abridged, delegated, modified, or granted by this Agreement, all of the rights, powers, and authority the County had prior to the signing of this Agreement are retained by the County and remain within the rights of the County, whether or not such rights have been exercised in the past.
MANAGEMENT'S RIGHTS CLAUSE. The Management of the Company and the direction of the working force, will include the following rights: to plan, direct and control plant operations; to schedule and assign work to employees; to determine the means, methods, processes, materials, and schedules of production; to determine the products to be manufactured; to choose the location of its plants and the continuance of its operating department; to establish production standards and to maintain the efficiency of employees; to establish and require employees to observe Company work and safety rules and regulations; to hire, layoff or relieve employees from duties; to contract or subcontract work and services from any source so long as it does not cause layoff of bargaining unit employees; io transfer employees; to promote employees; to judge the qualifications of employees; to determine the quality which the customer desires; to establish work classifications; to maintain order and to suspend, demote, discipline and discharge employees for cause. All of which are recognized and reserved rights of the Company. The foregoing enumeration of Management’s rights shall not be deemed to exclude other rights of Management not specifically set forth, the Company therefore retaining all rights not otherwise specifically restricted by this agreement.
