NON-COMPENSABLE LEAVE. Leave accrued by full-time faculty who are not under contract during the Summer Quarter (and previously accrued by certain part-time faculty members). Non-Compensable Leave may be used in addition to Personal Leave in circumstances described in Article 18. Non-Compensable Leave may not be transferred, donated or converted to cash in any circumstance.

NON-COMPENSABLE LEAVE. Section 1 Leaves without pay will be granted in accordance with the specified provisions for each type of such leave as hereinafter provided: Military Service, physical incapacity, child care, and for the purpose of Union representation. Leaves for other purposes may be granted but shall be subject to the consent and approval of the School Administration. Section 2 Employees who have exhausted their accumulated sick days and are placed on a non-compensable sick leave shall upon the effective date of physician's release be placed back to the position and building they had occupied before the leave occurred. This provision will prevail up to a period of no more than one (1) year. However, if it has been reasonably determined that an employee will not return within the year the job may be bid out with the provision that the employee out on sick leave will have the right to return to his/her building, shift and position if he/she returns within the year. Section 3 Employees who have been granted a non-compensable leave (other than sick leave) and are scheduled to return within ninety (90) days shall be placed back to their position and building they had before the leave occurred. During vacated period the job will be filled as in Article 8, Section 14. The Administration will fill the position left vacated by a new hire within ten (10) days after elevations take place. Upon the return of an employee from non-compensable sick leave or ninety (90) day non-compensable leave, all employees will revert back to the former positions they held before the leave occurred within that particular building.

All leaves shall be for a definite period and with a specific termination date. Except for physical incapacity (including maternity) and military service, no leaves shall exceed one (1) year, unless provided for elsewhere in the contract. Employees granted non- compensable leaves shall be required to report for duty upon the expiration of said leave or employment status will be terminated.
NON-COMPENSABLE LEAVE. 16.01: Leaves without pay or benefits for seniority employees will be granted in accordance with the specified provision for each type of such leave as provided in this Agreement, for uniformed service, health-related incapacity, maternity, and union representation. 16.01.01 Leave for other purposes may be granted, but shall be subject to the consent and approval of the Superintendent or designee without recourse to the grievance procedure. Employees granted such leave shall report for duty upon the leave’s termination, or be subject to Section 5.03 and Article 10. 16.01.02 All requests for leave and the approval shall be in writing, and shall provide for the date such leave begins and ends. The employee shall give written notice of request for leave ten (10) days before the actual date such leave begins. In an emergency, the prior notice requirement may be waived. If an employee desires to return to before the leave's expiration date, he/she shall give written notice to the Employer ten (10) days before the desire to return, and the District shall have the option of permitting said return. An employee returning from leave before the requested return date may be placed in a vacant position (at the start of the school year) or return to the previously-vacated position. An employee seeking to return from a leave before the requested date may not displace a bargaining unit employee from a position. 16.02: Subject to the Family and Medical Leave Act, seniority employees who have exhausted their accumulated sick days may be placed on a non-compensable sick leave without fringes which will be effective at the commencement of the next month from the beginning date of the non-compensable leave. 16.02.01: Employees granted such leave shall be required to report for duty upon that leave’s termination. Failure to report will result in dismissal. A leave extension at the discretion of the Superintendent or designee may be granted, providing the employee makes an extension request at least thirty (30) days before termination of the employee's present leave.
NON-COMPENSABLE LEAVE. 1. An unpaid child care leave shall be granted upon request of a teacher. An adoptive parent teacher may Apply for a child care leave under these guidelines. 2. The teacher shall submit a written request to the Superintendent at least forty five (45) days prior to the effective date of the leave except in case of an emergency. Said request shall include specific dates of the leave. 3. Leave for child care shall not exceed one (1) year. However, the Board may act to extend such leaves after reviewing pertinent data as presented by the teacher on leave.
