PERSONAL/XXXXX’S LEAVE AND COMPASSIONATE LEAVE. 31.1 (a) Employees are entitled to personal/carer’s leave and compassionate leave in accordance with the provisions of the NES (refer to Chapter 2, Part 2-2, Division 7 of the Act).
PERSONAL/XXXXX’S LEAVE AND COMPASSIONATE LEAVE. 35.1 Paid personal/xxxxx's leave
35.1.1 The NES provides for an Employee, other than a casual Employee, with 10 days (76 hours) of paid personal/carer's leave per year of service with the Company.
35.1.2 An Employee’s entitlement to paid personal/carer’s leave accrues progressively during a year of service according to the number of ordinary hours worked.
35.1.3 The NES provides that an Employee (other than a casual Employee) who is unable to attend work:
a) on account of personal illness or injury; or
b) because the Employee is required to provide care or support to a member of their immediate family or household who requires care or support because they are sick or injured or has an unexpected emergency; and
c) is entitled to take accrued paid personal/xxxxx's leave subject to meeting the notice and evidence requirements.
PERSONAL/XXXXX’S LEAVE AND COMPASSIONATE LEAVE. The National Employment Standards (NES) apply to all employment contracts as a minimum and the template enterprise agreement contains the NES terms. The Pastoral Award 2020 contains the NES about personal/carer’s leave. The Pastoral Award 2020 applies to all national system employers in the dairy industry for all employees in the classifications set out in the award. (See note 4) Whilst the NES is a minimum, employers may wish to consider offering extra personal/carer’s leave as part of a package. Under the NES, employees (other than casual employees) are entitled to 10 days paid personal/ carer’s leave for each year of service.
PERSONAL/XXXXX’S LEAVE AND COMPASSIONATE LEAVE. (a) Definition of personal/xxxxx’s leave
(i) Personal/xxxxx’s leave is:
(a) Paid leave taken by an employee because of a personal illness or injury of the employee (“sick leave”); or
(b) Paid or unpaid leave (“carer’s leave”) taken by an employee to provide care or support to a member of the employee’s immediate family or household, who requires care and support because of a personal illness or injury; or an unexpected emergency.
PERSONAL/XXXXX’S LEAVE AND COMPASSIONATE LEAVE. 24.1 Amount of paid personal leave
24.1.1 Paid personal leave will be available to an employee when they are absent due to:
24.1.2 The amount of personal leave to which an employee is entitled is as follows:
24.1.3 An employee’s personal leave entitlement is the current year’s personal leave plus any accumulated personal leave available to the employee.
24.1.4 In any year unused personal leave accumulates at the rate of the lesser of:
24.1.5 Personal leave may accumulate from year to year.
24.1.6 If an employee is terminated by the enterprise and is re-engaged by the enterprise within a period of six months then the employee’s unclaimed balance of personal leave will continue from the date of re-engagement. In such a case the employee’s next year of service will commence after a total of twelve months has been served with the enterprise (excluding the period of interruption in service) since either:
PERSONAL/XXXXX’S LEAVE AND COMPASSIONATE LEAVE. Personal/xxxxx’s leave and compassionate leave are provided for in the NES.
PERSONAL/XXXXX’S LEAVE AND COMPASSIONATE LEAVE. (a) In accordance with the NES, permanent Employees are provided with:
(i) Thirteen days of paid personal/xxxxx's leave per annum;
(ii) two days of unpaid carer’s leave for each occasion when a member of the Employee’s immediate family or household requires care or support because of a personal illness, injury, or an unexpected emergency and the Employee does not have any accrued paid xxxxx's leave; and
(iii) Five days of paid compassionate leave when a member of the Employee's immediate family or household dies or sustains a life-threatening illness or injury. Available to Employees on each occasion as per the entitlement in the National Employment Standards.
(b) Casual relief Employees are not entitled to paid personal/carer's or compassionate leave but are entitled to unpaid leave in accordance with the NES.
PERSONAL/XXXXX’S LEAVE AND COMPASSIONATE LEAVE. 27.1 Employees are entitled to personal/xxxxx’s leave and compassionate leave in accordance with the provisions of the NES.
27.2 Casual employees have no entitlement to paid personal/carer’s leave or compassionate leave but do have an entitlement to unpaid leave.
PERSONAL/XXXXX’S LEAVE AND COMPASSIONATE LEAVE. 29.1. Personal/xxxxx’s leave and compassionate leave entitlements are provided for in the NES.
29.2. The minimum entitlement to paid personal/carer’s leave for an Employee (other than a casual Employee) is 10 days per year.
29.3. An Employee’s entitlement to paid personal/carer’s leave accumulates progressively during a year of service.
29.4. Personal/xxxxx’s leave continues to accumulate when an Employee takes a period of paid personal/carer’s leave or paid annual leave. Personal/xxxxx’s leave does not accumulate on unpaid leave unless it is community service leave.
29.5. An Employee may take paid personal/carer’s leave:
(a) if they are unfit for work because of their own personal illness or injury (including pregnancy-related illness); or
(b) to provide care or support to a member of the Employee’s immediate family or household because of a personal illness, injury or unexpected emergency affecting the member.
29.6. A member of the Employee’s immediate family means a spouse, de facto partner, child, parent, grandparent, grandchild, sibling of an Employee and a child, parent, grandparent, grandchild or sibling of the Employee’s spouse or de facto partner.
PERSONAL/XXXXX’S LEAVE AND COMPASSIONATE LEAVE. 36.1 Entitlement to Paid Personal/Carer's Leave
(a) For each year of service with the Employer, an employee is entitled to 10 days of paid personal/xxxxx's leave.
(b) An employee's entitlement to paid personal/xxxxx's leave accrues progressively during a year of service according to the employee's ordinary hours of work, and accumulates from year to year.
