Supplier’s Personnel. 6.1 The Supplier shall employ sufficient persons to ensure that the Services are provided at all times and in all respects in accordance with this Agreement.
6.2 The Supplier's personnel employed in and about the provision of the Services shall be properly and sufficiently qualified, competent, skilled, honest, and experienced and shall at all times exercise due care in the execution of their duties. The Supplier shall ensure that such persons are properly and sufficiently instructed and supervised with regard to the provision of the Services and in particular:
6.2.1 the task or tasks such person has to perform,
6.2.2 all relevant provisions hereof,
6.2.3 all relevant policies, rules, procedures and standards of the Company, and
6.2.4 all relevant rules, procedures and statutory requirements concerning health and safety, including the Company's health and safety policy which shall be provided to the Supplier and if not so provided shall be requested by it.
6.3 The Company’s Representative shall, upon giving notice in writing, have the power to require the Supplier to remove from the provision of the Services any personnel of the Supplier specified in such notice including the Supplier’s Representative. The Supplier shall forthwith remove such personnel from the provision of the Services and shall unless the Company determines otherwise immediately provide a replacement who shall be satisfactory to the Company.
6.4 The Company shall in no circumstances be liable either to the Supplier or to such personnel in respect of any cost, expense, liability loss, or damage occasioned by such removal and the Supplier shall fully indemnify the Company in respect of any claim made by such personnel.
6.5 The Supplier shall provide and shall ensure that its personnel at all times when engaged in the provision of the Services at any premises owned, occupied or controlled by the Company wear such identification (including photographic identification) as may be specified by the Company, and shall ensure that when requested to do so any personnel of the Supplier shall disclose his identity and status as personnel of the Supplier and shall not attempt to avoid so doing.

Supplier’s Personnel. 3.1 All persons providing Services under this Agreement are collectively referred to herein as “Supplier’s Personnel”. If requested by Company, Supplier shall list the names of all Supplier’s Personnel in Schedule A GE-Hitachi MSA Template, Rev.3 August 21, 2015 hereto, indicating the relationship between Supplier and any person who is not Supplier’s full-time employee. Without Company’s prior written approval, Supplier shall not use any person to render Services who is not listed on Schedule A and/or who has been employed by Supplier less than six (6) months prior to the start date of such person’s performance under this Agreement. Company shall have the right to approve each such Supplier’s Personnel before assignment to any effort to be undertaken by Supplier, the granting of access to any Company facility and the disclosure of any Company information. All Supplier’s Personnel participating in the furnishing of any Services shall sign a copy of Schedule B hereto, Secrecy and Inventions Agreement, which shall be forwarded to Company by Supplier to the address listed on such document. Supplier shall not employ any Supplier Personnel that Company may object to for any reason. All subcontractors who are engaged as part of Supplier Personnel shall meet all qualifications of Company’s approved Suppliers and be approved by Company. Supplier shall provide a list of subcontractors before engaging in any Services or providing any Deliverables for such approval. To the extent that Company approves a subcontractor, such subcontractor shall be engaged to do so under written contracts with Supplier with terms and conditions that are no less restrictive than the terms and conditions of this Agreement. Supplier Personnel shall not include any competitors of GE, without GE’s written permission. In no event, shall Supplier be relieved of its obligations hereunder because of the use of subcontractors. Company has the right, but not the obligation, to require Environment, Health and Safety (“EHS”) prequalification of all Supplier Personnel before they may be deployed to any Company or Owner site. When required by Company, Supplier shall successfully complete EHS prequalification managed through Company’s third-party provider (e.g., ComplyWorks). Supplier’s Personnel. The Supplier shall select, employ, train, furnish and deploy in and about the performance of the Order only such persons as are of good character and who are appropriately skilled and experienced. The Contractor shall comply with the requirements in relation to the recruitment of ex-offenders and disclosures under the Police Act 1997. The Contractor shall ensure that all employees, servants or agents engaged by him in the discharge of his obligations under this contract who may be required to work within school premises, or other sites occupied by children and/or vulnerable adults shall be appropriately checked by the Criminal Records Bureau and shall upon request by a Pro5 member or Member Authority, produce evidence of such satisfactory disclosure. The Supplier and the Supplier’s sub-contractors, staff and agents shall comply with all reasonable requirements of the Customer at the Premises. The Supplier shall use reasonable endeavours to ensure that its sub-contractors are subject to the provisions of Clauses 12.1, 12.2 and 12.3 above. The Supplier, its agents, sub-contractors and suppliers shall employ sufficient staff to ensure that the Equipment is supplied and the Associated Services are provided at all times and in accordance with the Agreement. Without prejudice to the generality of this obligation, it shall be the duty of the Supplier to ensure that a sufficient reserve of staff is available to supply the Equipment and provide the Associated Services in accordance with the Agreement during staff holidays or absence through sickness or any other cause. The Customer, acting reasonably, shall have the right to refuse access to the Premises at any time to any employee of the Supplier, its agents, sub-contractors or suppliers. The exercise of this right shall not diminish the Supplier's obligation of performance arising under the Agreement.
Supplier’s Personnel. 6.1 The Supplier shall take the steps reasonably required by the Purchaser to prevent unauthorised persons being admitted to the Premises. If the Purchaser gives the Supplier notice that any person is not to be admitted to or is to be removed from the Premises or is not to become involved in or is to be removed from involvement in the performance of the Contract, the Supplier shall take all reasonable steps to comply with such notice and if required by the Purchaser the Supplier shall replace any person removed under this Condition with another suitably qualified person and procure that any pass issued to the person removed is surrendered.
6.2 If and when instructed by the Purchaser, the Supplier shall give to the Purchaser a list of names and addresses of all persons who are or may be at any time involved with the Services or any part of them, specifying the capacities in which they are so involved, and giving such other particulars and evidence of identity and other supporting evidence as the Purchaser may reasonably require.
6.3 The decision of the Purchaser shall be final and conclusive as to whether any person is to be admitted to or is to be removed from the Premises or is not to become involved in or is to be removed from involvement in the performance of the Contract and as to whether the Supplier has furnished the information or taken the steps required of the Supplier by this Condition.
6.4 The Supplier shall bear the cost of any notice, instruction or decision of the Purchaser under this Condition.
Supplier’s Personnel a) The Supplier’s personnel executing the Supply and/or Agreement shall, at all times, be deemed to be the personnel of the Supplier and the Supplier agrees to indemnify, hold harmless and defend the Purchaser, its parent, subsidiary and affiliated companies against any consequences of the Purchaser being held at any time to be the employer and/or for being responsible for making compulsory deductions and/or payments for income taxes, social security premiums and (alternative) private insurance premiums, pension fund contributions etc., whether this is due to the failure of the Supplier to properly and timely deduct and/or make those payments, or otherwise.
b) Whenever the Purchaser is of the opinion that there is reasonable doubt as to the Supplier’s proper compliance with one or more of the following obligations: making compulsory deductions and/or payments for income taxes, paying social security premiums and (alternative) private insurance premiums, and making pension fund contributions, then the Purchaser has the right, and the Supplier the obligation, to provide security in a form and manner which is satisfactory to Purchaser to safeguard the proper remedy of the omission and the performance thereafter. In addition or alternatively, as the Purchaser may reasonably determine at its sole discretion in view of the seriousness of the situation, the Purchaser shall be entitled to withhold further payment of any money to the Supplier until the Supplier has remedied the situation to the Purchaser’s satisfaction, or to retain from further payments a sum of up to 50% of all money paid to date to the Supplier under the relevant Supply and/or Agreement.
c) If and when applicable, the Purchaser reserves the right to pay the Supplier the amount for the social security premiums and wage taxes owed by the Supplier in relation to the Agreement, for which he is severally liable pursuant to the Dutch Sequential Liability Act (=Wet Ketenaansprakelijkheid), by deposit on his blocked account as referred to in the Sequential Liability Act. Without prejudice to the provisions of the preceding sentence, the Purchaser shall at all times be entitled to withhold the above-mentioned amounts of social security premiums and wage taxes from the Supply and/or the Agreement price and pay it on behalf of the Supplier directly to the receiver of direct taxes. Supplier’s Personnel.
(a) The Supplier must ensure that all of its Personnel engaged or employed by the Supplier in carrying out the Supplier's Activities:
(i) are aware of, and comply with, the Supplier's obligations under this Agreement as if they were the Supplier;
(ii) prior to carrying out any part of the Supplier's Activities, are properly trained and qualified and have the requisite competencies, skills, qualifications and experience to:
A. perform the duties allocated to them; and
B. understand the Supplier's obligations under this Agreement, including with respect to privacy, security, confidentiality and safety; and
(iii) are provided with regular training to ensure that the Supplier's Personnel's skills and qualifications are maintained in accordance with all applicable Best Industry Practice.
(b) On the Customer's request or as part of any audit conducted pursuant to clause 37.2, the Supplier must promptly provide the Customer or its nominee with evidence that the obligations under this clause 11.3 have been complied with (including with respect to the training of the Supplier's Personnel).
(c) The Supplier must ensure that all of its Personnel, when on the Customer’s premises or when accessing Customer Data or the Customer's systems, equipment or facilities, comply with the reasonable requirements and directions of the Customer (including with regard to the Customer's safety and security requirements).
(d) The Supplier must ensure that its Personnel when entering any Site comply with any conditions of entry or other Site specific requirements as specified in the Order Documents or notified by the Customer to the Supplier from time to time.
(e) The Customer may, acting reasonably and in its discretion, give notice in writing requiring the Supplier to remove any of its Personnel (including Nominated Personnel) from work in respect of this Agreement, together with its reasons for removal. The Supplier must promptly arrange for the removal of such Personnel and their replacement with Supplier Personnel reasonably acceptable to the Customer.
(f) The Supplier must ensure that it (and where appropriate, its outgoing Personnel) effects a process that:
(i) minimises any adverse impact on, or delay in, the performance of the Supplier's Activities; and
(ii) effects a smooth transition between the outgoing and replacement Personnel, including by identifying and recording:
A. any processes and systems in place (or proposed) to manage the provision of the Supplier's Activiti...
Supplier’s Personnel. 12.1 The Supplier shall employ a sufficient number of skilled, qualified and experienced employees in order to provide the Work in an efficient and professional manner.
12.2 The Supplier shall comply with all rules and regulations with respect to the employment of its personnel, including without limitation, any employment related laws and regulations.
12.3 The Supplier shall ensure the safety and wellbeing of any of its personnel or anyone else working on its behalf, and the Supplier shall be solely responsible for any damage or harm incurred thereto.
Supplier’s Personnel. 5.1 The Supplier must engage all personnel necessary for the supply of the Goods and/or Services under this Agreement.
5.2 The Supplier must employ or cause to be employed only personnel that are trained, skilled and experienced to the degree ordinarily expected of personnel engaged in the supply of goods and/or services similar to the Goods and/or Services.
5.3 No Supplier’s Personnel may commence work on Site unless she/he has attended the induction courses required by the Principal to be attended by all persons engaged at the Site.
5.4 To the extent permitted by Legislation, during the Term and extending for a period of 6 months after the End Date, the Principal’s Personnel are not to be engaged or offered employment by the Supplier, without prior written approval of the Principal.
Supplier’s Personnel. 6.1 The Supplier shall use all reasonable endeavours to prevent unauthorised persons from entering the Premises. The Client may give notice to the Supplier that a person is not to be admitted, or is to be removed from the Premises. The Supplier shall use reasonable endeavours to comply with any such notice. The Supplier shall replace any person removed under this Condition with another suitably qualified person and ensure that any access pass to the Premises issued to the person is surrendered.
6.2 The Supplier shall at the request of the Client provide a list of names and addresses of all persons who may provide or be concerned with the provision of the Services. The Supplier shall specify the capacities and give such other particulars and evidence of identity and other supporting evidence as the Client may reasonably require. Any such information will be provided in accordance with the provisions set out in Condition 15.
6.3 Any decision of the Client to admit or remove Personnel from the Premises is final.
Supplier’s Personnel. 6.1. In relation to the Supplier’s personnel, the Supplier shall ensure that all personnel:
6.1.1. who attend any Voyage Care site in connection with any Order have undergone a DBS check within the last three years from the date of attendance on site;
6.1.2. have the necessary skills and experience to enable them to perform the tasks assigned to them, and that such personnel are in sufficient number to enable the Supplier to fulfil its obligations under this agreement;
