Temporary Nurses. 24 10.9.1 The parties agree that full- and part-time registered nursing staff em- 25 ployed by the Hospital are most likely to provide the desirable level of nursing care, 26 to provide care to patients at an economical cost and to provide the necessary 27 balance in the assignment of shifts. It is understood that hospital employed "Float" 28 and "Casual" nurses are also hospital nursing staff. The Hospital's basic policy 29 shall be to use its registered nursing staff to the exclusion of temporary registered 30 nurses from an outside agency except in unavoidable situations; however, the de- 31 cision to hire temporary nursing staff shall remain solely with the Hospital admin- 32 istration.
1 10.9.2 Such temporary nurses shall be used only as a supplement to and not in 2 lieu of Hospital registered nursing staff. Prior to utilizing a temporary nurse, the 3 Hospital shall take all steps available to cover a shift or partial shift with its own 4 nursing staff. Before making any use of a temporary nurse, the Hospital shall offer 5 each shift or partial shift to the members of its own registered nursing staff who are 6 qualified to perform the work. These offerings shall be made as soon as any 7 scheduled opening is discovered by the Hospital and shall be immediately com- 8 municated to the qualified Hospital nursing staff by written notice posted on the 9 Nursing Services' central bulletin board. A temporary nurse shall be required to 10 have education, prior experience, state licensing and orientation necessary to 11 function on the station unit in the facility to which assigned.
13 10.9.3 The Hospital will attempt to avoid increased assignments of any of its 14 nursing staff to night, evening, holiday or weekend duty as a result of the use of 15 temporary nurse personnel.
17 10.9.4 The Hospital shall promptly take and maintain all necessary steps to re- 18 duce and minimize reliance on temporary registered nurses from outside agencies.

Temporary Nurses. The Hospital agrees that it will be its policy to utilize its own staff for any regular staffing rather than temporary Nurse personnel from the outside sources. Temporary Nurses will be used only as a supplement to and not in lieu of regular nursing staff. The scheduling of temporary Nurses will be limited to those situations where the regular staff Nurses are not available for assignment and no other means of providing nursing staff are available within a reasonable time. The Hospital shall insure that there will not be increased assignment of any of its nursing staff to night, evening, holiday or weekend duty as a result of the use of temporary Nurse personnel. Temporary Nurses shall not be given unit or shift assignment preference over regular staff except where no other reasonable alternative is available to provide needed nursing coverage. The use of temporary Nurses and casual Nurses will be recognized by the parties as a legitimate subject for discussion and/or study through the already established labor management meeting process between the parties set forth in Section 25. 3 of this Agreement.
Temporary Nurses. Nurses hired to work during a period of up to six (6) months when the Employer requires a temporarily augmented work force are classified as temporary nurses. This period shall not be longer than six (6) months in a twelve-month period without the consent of the Union. Temporary nurses are not covered by this collective bargaining agreement.
5.5.1 If a temporary position is filled by a current bargaining unit nurse, that nurse will retain regular status for purposes of this Agreement, during that temporary assignment. The Employer will hold the bargaining unit nurse’s prior position open for four (4) weeks. At that time, if the Employer finds that a need exists to post to fill the position, the Employer will first notify the nurse and give her/him the first opportunity to return to the temporarily-vacated position. If the nurse declines, the Employer may post for and hire into that position. In that case, the nurse would be eligible for the first available position for which that nurse is qualified after completion of the temporary assignment.
5.5.2 If no bargaining unit nurse seeks or is qualified for a particular temporary position, the hours will be offered to a per diem nurse.
5.5.3 If the Union or the nurse feels that she/he is improperly classified, a grievance may be filed to have that issue clarified.

The Employer will outline to the nurse so hired to fill such vacancy the circumstances giving rise to the vacancy and the fact that it is a temporary job only. Newly hired nurses, hired to fill such temporary vacancies, may be released and such release shall not be the subject of grievance or arbitration. Temporary nurses may apply as an internal applicant and, in the event two or more temporary nurses apply for a position and are found to be relatively equal, such nurses’ hours worked with the employer in their current term of employment shall be used as the deciding factor. Should the nurse be subsequently engaged on a permanent basis by the Employer without any break in service of more than thirty (30) calendar days, they will be required to complete the normal probationary period provided for in this agreement, and their seniority shall date from the date of their original temporary replacement should they successfully complete the normal probation period provided for in this Agreement.
