OTHER TYPES OF LEAVE. COURT LEAVE 21.01 Leave of absence with pay shall be given to every employee, other than an employee on leave of absence without pay or under suspension, who is required: (a) to serve on a jury and the jury selection process; or (b) by subpoena or summons to attend as a witness in any proceeding held: (i) in or under the authority of a court of justice or before a grand jury; (ii) before a court, judge, justice, magistrate, or coroner; (iii) before the Senate or House of Commons of Canada, or a committee of the Senate or House of Commons, other than in the performance of the duties of his/her position; (iv) before the Executive Council or Legislative Assembly, or any committee thereof that is authorized by law to compel the attendance of witnesses before it; (v) before an arbitrator or umpire or a person or body of persons authorized by law to make an inquiry and to compel the attendance of witnesses before it. (c) by law to attend a proceeding under the Young Offenders Act (Canada) concerning a dependent.

(c) Notwithstanding anything contained in this Article, there shall be deducted from the regular pay of the employee any remuneration received by him as a result of serving on a jury or as a witness, other than remuneration received as an allowance or reimbursement for expenses incurred in such duty. 21.02 An employee shall be granted injury-on-duty leave with pay to a maximum of either special leave credits or sick credits he has accumulated, but not both, where it is determined by a Workers Compensation Board that he is unable to perform his duties because of: (1) (a) personal injury accidentally received in the performance of his duties and not caused by the employee's wilful misconduct; or

OTHER TYPES OF LEAVE. 21.01 Leave of absence without loss of regular pay shall be given to every employee, other than employees on leave of absence without pay, laid off, or on suspension, who is required to serve on a jury and the jury selection process, or to attend as a witness in any judicial, quasi-judicial or legislative proceeding by reason of subpoena compelling attendance. Notwithstanding anything contained in this Article, there may be deducted from the regular pay of the employee any remuneration received by the employee as a result of serving on a jury or as a witness, other than reimbursement for expenses incurred in such duty. 21.02 An employee shall be granted injury-on-duty leave with pay for ninety (90) calendar days or the length of the injury-on-duty leave, whichever is the lesser, where compensation is payable to the employee under the Workers’ Compensation Act (Northwest Territories), if the employee agrees to pay the Employer any Workers’ Compensation benefits received by the employee.

OTHER TYPES OF LEAVE. An Employee may make written request to the Site Manager for a leave of absence without pay for a period not to exceed sixty (60) days. This period may be extended Group Limited -Aerospace Division Gander, Newfoundland and Labrador by mutual consent of the Employer and the Union. Employees will not be required to state the specific reason for the requested leave and shall not engage in other employment without the express consent of the Employer. Leaves will be considered for approval based on operational requirements and such requests shall not be unreasonably denied. While on approved leave of absence, an Employee will retain and continue to accrue seniority and service. An Employee not returning to work immediately without an approved extension on the expiry of a leave will be considered as having resigned and their employment will be terminated. Employees who are required to attend at jury selection or to serve on a jury will be granted leave with pay to attend. Employees who are summoned or subpoenaed to attend, as a witness in any proceeding in which they are not a party will be granted with pay to attend. Employees granted leave under this clause will have deduced from his or her regular pay any remuneration received by him or her other than remuneration received as an allowance for expenses or reimbursement for expenses incurred while performing such service. Employees who are eligible for maternity or parental leave under the Canada Labour Code will be granted such leave in accordance with the Canada Labour Code. (a) When an Employee is absent from work on a regular workday due to a death in that Employee’s immediate family, he or she shall be paid their regular hours for three (3) working days. Eligibility for leave will expire two (2) days following the date of the funeral. The definition of immediate family includes an Employee’s father, step-father, mother, step-mother, brother, step-brother, sister, step-sister, spouse, child, step-child, father-in-law, mother-in-law, son- in-law, brother-in-law, sister-in-law, daughter-in-law, xxxxxxxxxx, grandparent; and any relative of the Employee permanently residing in the Employee’s household or with whom the Employee permanently resides.
