LEAVE OF ABSENCE WITH OR WITHOUT PAY. 17.8.1 The Board, in its sole discretion, may grant a leave of absence with or without pay to an Employee.
17.8.2 The Employee shall inform his/her immediate supervisor in writing, of the intention to return or resign, six (6) months prior to the expiry of the leave.
17.8.3 The Employee may elect to pay one hundred percent (100%) of all normal benefits premiums during a Leave of Absence without pay.
17.8.4 An Employee granted a leave of absence with or without pay shall retain his/her position and seniority upon return from the leave.

19 26.1 Leaves of absence may be paid or unpaid, depending upon the 20 circumstances of the leave and whether the employee has accrued 21 applicable paid leave available. Four categories of leaves of absence are 22 described herein.

LEAVE OF ABSENCE WITH OR WITHOUT PAY. A. An Administrator may apply for a leave of absence with or without pay. The leave shall be granted only by the Board of Education. The leave will be considered only upon a written application to the Superintendent of Schools setting forth the reasons for which the leave is sought. When an application for a leave is filed, the Superintendent of Schools will promptly submit a recommendation to the Board of Education approving or disapproving the application and setting forth:
(1) The results of his investigation of the facts set forth in the application;
(2) The number of other members of the school staff on leave;
(3) The reasons for his approval or disapproval of the application and a copy of these reasons forwarded to the applicant; and
(4) Whether the leave is to be with or without pay.
B. All benefits to which an Administrator was entitled at the time his/her leave of absence commenced, including unused accumulated sick leave, shall be restored to him/her upon his/her return.

28 26.2 Leave Request Procedure: 29 Employees are expected to be familiar with and are required to follow the 30 leave procedures as outlined in this Article. Leave requests for less than 31 one (1) full pay period should be requested with a Leave Request Form 1 (LRF). Employees may be required to daily or otherwise report on his/her 2 status and intention to return to work and may be subject to loss of benefits 3 and/or discipline for failure to do so.
LEAVE OF ABSENCE WITH OR WITHOUT PAY. All Permanent Part-time Employees who have worked six (6) months, shall be entitled to the same Bereavement Leave, Maternity and Parental Leave, Adoption Leave and Jury-Witness Duty provisions to which Permanent Full-time Employees are entitled on a pro-rated basis, but if having opted for the percentage in lieu of all other benefits, shall not be paid such percentage when on unpaid leave of absence.

LEAVE OF ABSENCE WITH OR WITHOUT PAY. 10.1. The College may either reassign the employee to non-sensitive, interim duties at the employee’s regular rate of pay or place the employee on Leave of Absence With Pay for a limited period of time when (1) allegations of misconduct against the employee are related to the employee’s duties and responsibilities and require an internal investigation; or (2) the nature of the allegations warrants the removal of the employee from the work site.
10.2. In circumstances where an employee’s behavior results in a criminal charge but in the judgment of the President does not warrant immediate removal as detailed in Article V.
LEAVE OF ABSENCE WITH OR WITHOUT PAY.
54:01 This leave shall be utilized when all other leave benefits have been exhausted.
54:02 A leave of absence with or without pay may be granted upon written request setting out the reasons for the leave, date of commencement and date of return to the immediate supervisor and Human Resources. An employee shall give four (4) weeks’ notice except in an emergency. MCFS shall notify the employee of approval or denial of the leave of absence request within one (1) week of the receipt of the request. Such requests shall not be unreasonably denied.
54:03 An employee who is granted a leave of absence for ten (10) weeks or less, will be returned to his/her former position upon his/her return at his/her former increment step.
54:04 An employee, who is granted leave of absence between ten (10) and twenty-six (26) weeks, will be returned to his/her former classification at his/her former increment step.
54:05 An employee who is granted a leave of absence for a period of over twenty-six (26) weeks, and unless the Employer makes a specific commitment as to the conditions under which an employee who is granted such leave of absence will be employed on his/her return, shall be required to compete for any vacant positions, and if successful be credited with the length of service accumulated at the time of their leave for the purposes of sick leave and vacation entitlement benefits, as defined in this Agreement.
54:06 In the event of serious family illness/crisis and when the affected employee has exhausted all other leave avenues, the employee may request leave of absence without pay and such a request shall not be unreasonably denied. Further, the employee shall be guaranteed the right to return to their former position within the first three (3) months of the commencement of the leave. For the following six (6)
54:07 The employee may be eligible for the continuation of group benefits while on leave of absence without pay to a maximum period as defined in the plan text for disability coverage, subject to the approval of Human Resources. If granted, the employee is responsible for one hundred percent (100%) of the group benefit premiums while off on leave. An agreement for the payment of premiums shall be signed by the employee prior to taking the leave.
