COMPENSATION FOR INJURY ON DUTY. 27.01 Employees who have been injured while on duty resulting in a time loss from work shall come off payroll from the date and time of injury and shall immediately apply for Workers’ Compensation benefits.
(a) While awaiting approval of WCB the employee will be treated as on regular sick leave for the period said Employee is unable to perform the duties due to injury, which is limited to the existing sick leave credits in the Employee’s sick leave xxxx.Xx the event the employee’s claim is approved, the employee shall reimburse the Employer for the paid sick leave, less the amount owed to the employee pursuant to Article 27.02 (c), and the employee’s sick leave bank will be credited an equivalent amount.
(b) In the event that the Employee’s claim for Workers’ Compensation is not approved the Employee shall be treated as being on regular sick leave for the period said Employee is unable to perform the duties due to injury, which is limited to the existing sick leave credits in the Employee’s sick leave bank.
(c) In the event the Employee’s claim for Workers’ Compensation is approved, the Employer will pay the Employee seventy five percent (75%) of the regular pay for the first two (2) days of an injury or accident, provided the Employee is off for less than five (5) weeks, and provided the Employee has existing sick leave credits. If the Employee remains on Worker’s Compensation benefits for more than five (5) weeks, the Employee shall reimburse the Employer for those two (2) days pay and the Employee’s sick leave bank shall be credited accordingly.
(a) Subject to eligibility requirements in the plan policies and subject to Article 27.03(b), an Employee shall continue participation in the group insurance plan by contributing the share of the plan premiums for a period of six (6) months from the date of injury. Following expiration of this six (6) month period the Employee may choose to continue participation in the plan by paying one hundred percent (100%) of the premium.
(b) In order to be eligible for continued coverage under the group insurance plan, the Employee must be in receipt of temporary wage loss benefits from the Workers’ Compensation Board and group insurance premiums must be provided to the Employer by post-dated cheques at commencement of the leave for each month of coverage.

COMPENSATION FOR INJURY ON DUTY. 27.01 Where an employee is unable to work as a result of a Worker’s compensable injury, the Employer shall pay the employee his regular pay during the waiting period under the Workers’ Compensation Act and shall also top-up the employee’s pay to the maximum level permitted under the Act as per Article 43.01.
27.02 During the time an employee is off work receiving Workers’ Compensation benefits:
(a) the employee shall maintain the employee contributions and the Employer shall maintain its contributions to group benefit plans;
(b) the affected employee shall maintain the employee contributions and the Employer shall maintain its contributions to the pension plan in which the employee is a participant, the contributions to be based upon the maximum compensation level permitted under the Act.
27.03 Where, in connection with a Workers’ Compensation claim, the Employer requires an employee to provide medical certificates or reports, or to be examined by a medical professional it determines, the Employer shall be responsible for paying the costs of such certificates, reports or examinations unless any of such costs are paid by Workers’ Compensation.
27.04 If any of the foregoing conflicts with applicable provisions of the Act, the Act shall prevail.
COMPENSATION FOR INJURY ON DUTY. 26.01 Employees Injured on Duty Employees who have been injured while on duty resulting in a time loss from work shall come off payroll and be considered to be on an unpaid leave of absence from the date and time of injury and shall immediately apply for Workers’ Compensation benefits.
COMPENSATION FOR INJURY ON DUTY. A. Whenever a unit employee is disabled, whether temporarily or permanently, by injury or illness arising out of and in the course of that person’s duties, the unit employee shall become entitled, regardless of that person’s period of service with the City, to “Injury on Duty” (IOD) leave of absence while so disabled. The unit employee shall receive salary continuation pay in lieu of temporary disability payments, or maintenance allowance payments, if any. Salary continuation would be payable for the period of the disability, but not to exceed one (1) year, or until such earlier date as the unit employee is retired on disability pension or would be retired for disability pension if eligible under CalPERS requirements.
B. The injury/illness must be reported to the HR/RM Department immediately through the process as designated by the HR/RM Department.
C. Leave time used as IOD and/or paid as salary continuation will be run concurrently with FMLA/CFRA leave.
D. The amounts of salary continuation will be taxed at the applicable state and federal rates.

COMPENSATION FOR INJURY ON DUTY. (1) An employee who is injured on duty shall immediately report or cause to have reported an injury sustained in the performance of his/her duties to his/her immediate supervisor in such manner or on such form as the Employer may from time to time prescribe.
(2) Injury Pay Provisions When an employee is injured on duty and it is determined by the Nova Scotia Workers' Compensation Board that the employee is unable to perform his/her duties, the Employer shall grant to the employee injury on duty leave with pay at the level of compensation and in the manner prescribed by the Workers' Compensation Act for a period as the Workers’ Compensation Board may specify. The Employer agrees to top-up injury on duty pay to eighty-five percent (85%) of net average earnings, as provided for in Section 49 of the Workers’ Compensation Act.

(b) The process for reporting a workplace injury in various circumstances will be posted by the Employer on the XXXX bulletin board in each 24/7 location and will be inserted in the Employee Handbook. The process shall be reviewed by the XXXX Committee prior to being posted. Where an employee is injured on duty and does not follow the process, and where the Employer is subsequently fined by WCB for failure to report the injury, the employee shall be subject to disciplinary action.

27.3 Subject to eligibility requirements in the plan policies, Employees shall continue participation in the group insurance plan by contributing his/her share of the plan premiums for a period of six (6) months from the date of injury.
