General Personnel Provisions. A. Contractor shall be solely responsible for the satisfactory work performed of all its employees. All Contractor personnel shall maintain a professional, courteous attitude, answering to the best of their ability any passenger questions regarding the provision of service. Discourtesy, rudeness or the use of profanity will not be tolerated and shall be grounds for immediate removal of the offending employee from performing work.
B. Contractor shall be responsible for payment, including any benefits, of all employees and subcontractors.
C. Contractor shall hold harmless the City of Burbank from any liability, damages, claims, costs, and expenses of any nature arising from alleged violations of personnel practices.
D. The City shall be notified of new hires and reassignments of project management personnel and a list of current personnel shall be maintained by contractor.
E. Contractor management personnel shall report all passenger complaints and/or any operational problems to the City within 24 hours, or as soon thereafter as possible.
F. Contractor shall fully investigate all requests and complaints received by Contractor or City and return the results of the investigation to the City and the complainant within five (5) days of receipt of such request or complaint. Contractor's failure to respond to a complaint or written request on time, unless otherwise agreed to by the City, shall result in a penalty to Contractor of twenty-five dollars ($25) per occurrence.
G. Drivers and dispatchers shall accurately complete and submit daily operating reports and any other data requested by the City.
General Personnel Provisions. Section 4.1 SERGEANT PEER INVESTIGATIONS PROHIBITED Lieutenants will investigate Sergeants who initiate pursuits, use of force, traffic collisions and the like, excluding investigations conducted by Internal Affairs. There will no longer be peer-to-peer investigations of sergeants by another Sergeant in such cases; patrol lieutenants are to conduct these investigations.
Section 4.2 TAKE HOME CARS Non-uniformed sergeants take city-assigned vehicles home under current practice as approved by the Chief of Police. The City will continue to permit non-uniformed sergeants to take home City cars under the present practice. The City recognizes that this matter is subject to meet and confer should the City believe a change to the practice is warranted. However, no re-opener is intended hereby.
Section 4.3 SERGEANT CALLED IN FOR WORK MEETING When a Sergeant is called in for a meeting between shifts or on his/her day off, he or she shall receive a minimum of two hours’ pay at the applicable rate. In the event the meeting lasts less than two hours, the Department reserves the right to assign up to two hours’ work.

1. Full-Time Employee A new or re-employed employee employed in a regular or limited-term position shall be placed on a new probation for fifty-two (52) weeks from the date of appointment ending with the first day of the pay period following completion of said period.
2. Part-Time Employee A new or re-employed employee employed in a part-time regular or limited-term position shall be placed on new probation for two thousand eighty (2080) paid hours exclusive of overtime, ending with the first day of the pay period following completion of said period.
B. Promotional Probation
1. Any regular or limited-term employee who is promoted, excluding a temporary promotion, shall be placed on promotional probation except as provided in B.2., below.
a. A full-time employee shall serve a probation period of fifty-two (52) weeks ending with the first day of the pay period following completion of said period. However, an employee who promotes from a class in the Superior Court Supervisory Unit to a class in the same or closely related occupational series shall serve a promotional probation period of twenty-six (26) weeks from the date of promotion ending with the first day of the pay period following completion of said period or the remainder of any uncompleted new probation period, whichever is longer.
a. A part-time employee shall be placed on promotional probation for two thousand eighty (2080) paid hours, exclusive of overtime, ending with the first day of the pay period following completion of said period except that for promotion from a class in the Superior Court Supervisory Unit to a class in the same or closely related occupational series, the promotional probation period shall be one thousand forty (1040) paid hours exclusive of overtime or the remainder of any uncompleted new probation period, whichever is longer.
2. When a regular or limited-term employee is promoted as a result of the employee's position being reclassified to a higher class and the class from which the employee is promoted is subsequently deleted or abolished, the incumbent employee shall not serve a promotional probation period.
3. When an employee who has been on a temporary promotion or a regular employee who was promoted to a limited-term position at the direction of the Superior Court is reduced to a class the employee formerly occupied, the employee shall serve the remainder of any uncompleted probationary period in that class.

General Personnel Provisions. Prior to performing any Services, Provider personnel (including personnel of any Subcontractors) who will access State Data and software shall execute the Parties' agreements and forms concerning access protection and data/software security consistent with the terms and conditions of this Agreement. At all times during the Term, Provider, and its employees, agents, and Subcontractors, shall comply with all State policies and procedures regarding data access and security, including those prohibiting or restricting remote access to State systems and State Data. The State shall authorize, and Provider shall issue, any necessary information-access mechanisms, including access IDs and passwords, and Provider will require that the same shall be used only by the personnel to whom they are issued. Provider shall provide to such personnel only such level of access as is required to perform the tasks and functions for which such personnel are responsible. Provider shall, upon request from the State, but at least quarterly, provide the State with an updated list of those Provider personnel having access to the State's systems, software, and State Data. State Data and software provided by the State or accessed by Provider personnel shall be used by Provider personnel only in connection with Provider's obligations hereunder, and shall not be commercially exploited by Provider in any manner whatsoever. In addition, failure of Provider to comply with the provisions of this Section 13.2 may result in the State restricting offending personnel from access to State computer systems.
