Operations Personnel. Personnel performing the actual day-to-day business and operations of the Refining Subs at the refinery or operating level will be employed by the Refining Subs, and the Refining Subs will bear all Personnel Costs or other costs relating to such personnel.
Operations Personnel. Owner shall provide appropriately qualified, competent, and, where necessary, licensed operators for training when required by Contractor and to support commissioning, initial operation of the Facility and all Performance Tests.
Operations Personnel. The transportation of school children is a unique and specialized professional service. It is of essence that the students be transported to and from school regularly, promptly, safely and without interruption or incident and that the safety of the children in such transportation shall take precedence over the interests of either Contractor and its drivers or District. It shall be a primary obligation of Contractor to operate its affairs so that District will be assured of this continuous and reliable service. Contractor shall submit its personnel and hiring policies, rules and regulations to District for review. Contractor shall amend such policies, rules and regulations to conform them to the specific terms and/or objectives of this contract upon notice from District that any such policy, rule or regulation is in conflict the specific terms and/or objectives of this contract. The responsibility for hiring and discharging personnel shall rest with Contractor. Contractor shall not enter into any agreement or arrangement with any employee, person, group or organization which will in any way interfere with Contractor’s ability to comply with the terms of this contract. District shall have the right to reject any driver without cause by sending a written notice of driver rejection to Contractor, upon which Contractor shall immediately act. Contractor shall furnish to District the following information relative to each driver that will be used in the implementation of the contract and Contractor shall be responsible for keeping such information current: • Name of driver, to include first name, middle initial and last name; • Driver’s permit and license number; • Normal route assignment; and • Normal bus assignment. All drivers are subject to the current state and federal laws and regulations pertaining to the operation of school buses and to any regulations set forth by District. Drivers must be fully licensed in accordance with all state and federal laws, rules and regulations. Contractor shall provide all drivers with periodic in-service training relative to all facets of the driver’s job and shall make certain that all drivers shall have successfully completed an approved first aid course prior to operating a bus under this contract. Contractor shall comply with the provisions of 625 ILCS 5/6-106.1 and shall insure that District is in compliance with respect to Contractor’s bus drivers.
Operations Personnel. (a) Upon initial Closing, Xx. Xxxxxxx Xxxxxxx shall serve as the initial designated General Manager of Dairy on a consulting basis and shall serve Bion as a consultant, pursuant to an agreement between each of Bion and Dairy and Bright Capital, Ltd. Xx. Xxxxxxx will coordinate and supervise the activities of Dairy, and assist Bion in connection with the matters set forth in paragraph 1.5 above and such other matters as shall be requested from time to time by the officers of Dairy and/or Bion. (b) It is currently anticipated that initially most of the activities of Dairy will be carried out by Bion's core technical and engineering staff (including, without limitation, Xxxx Xxxxxxxx, Technical Director, Xxxxx Xxxxxx, Chief Technical Officer, and Xxxxxx Xxxxx, the Chief Operating Officer of BionTech) and third party contractors; provided, however, that in the event that the Bion Conditions (set forth at Schedule D to the Promissory Notes) have not been satisfied by December 31, 2003, i) all of Bion's key employees/consultants shall become direct employees/consultants of Dairy (on identical compensation terms as each had with Bion), ii) all of the Bion options of each employee/consultant shall be cancelled and Dairy shall grant/issue to each employee/consultant (effective January 1, 2004) Dairy options for a number of shares of Dairy Stock equal to the cancelled Bion options with equivalent terms as to exercise price, exercise term, etc., and iii) the number of options/warrants at paragraph 1. 7 a) ii) shall be reduced by the number of such cancelled Bion options which had been granted as of the Initial Closing Date.
Operations Personnel. DRIVERS / MAINTENANCE / SUPPORT 15.1 Contractor shall employ a sufficient number of qualified drivers, maintenance, and support personnel to assure County of continuous, reliable, safe, and on-time service. 15.2 Excessive absenteeism or prolonged position vacancies for key personnel including management personnel, supervisors, drivers, dispatchers, mechanics, and service workers shall be avoided and addressed by Contractor. 15.3 Contractor shall not permit its personnel to smoke inside County facilities or on buses, to drink any intoxicating beverage, or to be under the influence of drugs or alcohol while operating any bus OR while performing any safety-sensitive function. 15.4 Contractor shall be responsible for hiring and discharging personnel employed by Contractor to perform its obligations hereunder; provide, however, that County shall have the right to request Contractor to remove from service to the County any employee who, in County’s sole discretion, is deemed unsuitable for the performance of transportation services for County. 15.5 Contractor shall provide qualified driver/trainers and qualified drivers, trained and licensed in accordance with applicable laws and the rules and regulations of County. Contractor will, to the extent such requirements do not conflict with state or federal laws, implement such requirements identified in the RFP into its hiring and training programs for drivers servicing County’s operations. Contractor agrees that each driver shall: 15.5.1 Drivers shall satisfy minimum requirements as identified in County’s Request for Proposals 18-057. 15.5.2 Possess a valid license or permit issues by this State authorizing such person to operate a vehicle of the type being operated. 15.5.3 Be certified by a duly licensed medical practitioner as medical qualified and free of medical or physical conditions, which, absent reasonable accommodation, would limit the safe operation of a bus. The physical examination shall be conducted prior to employment and periodically hereafter as permitted by law. 15.5.4 Possess a satisfactory driving record and criminal history record, after reviewing of such records prior to employment and periodically thereafter to the extent permitted or available by law. 15.5.5 Prior to employment and from time-to-time thereafter, to the extent permitted by law, undergo such tests as may reveal, within a reasonable degree of medical or scientific certainty, the presence or absence of drugs or controlled substance...
Operations Personnel. Owner shall provide, or cause Operator to provide, operations personnel as described in Exhibit T, for the purposes set forth therein.
Operations Personnel. The following operating personnel: Control Room Operator, Waste Control Operator and Auxiliary Operator will accrue job seniority in each of these listed classifications. Progression will be made as shown in Schedule "A" & "B". Demotions and layoffs will be in the reverse order even though the employee demoted or laid off from a higher classification may not have job seniority in the lower classification. Each unit is a separate group in determining seniority. Seniority is not transferable from one unit to another but remains where earned. If for any reason the senior employee in an Operator classification is not promoted, he waives his seniority rights to the next qualified employee in line of seniority, and in so doing, in case of future promotions or demotions, he will be considered as having less seniority in the job which he is performing or will perform than the employee previously promoted. Upon promotion in any operating classification, personnel will be entitled to time accrued on a temporary basis in the higher classification in determining the rate of pay within the classification. Such accrued time will not be used in determining seniority for permanent promotion purposes.
Operations Personnel. To be eligible for promotion to Control Room Operator, the employee must obtain and maintain an NRC Reactor Operator License. To be eligible for promotion to Waste Control Operator, the employee must complete Waste Control Operator qualifications. To be eligible for promotion to Auxiliary Operator, the employee must complete Auxiliary Operator qualifications. To aid in determining fitness and ability, management may evaluate potential Reactor Operator candidates prior to selection for RO class, as necessary, to determine probability of successfully completing the RO training program. Management has the right to make final selection of RO candidates based on previous work and training records, subject to the Grievance Procedure. If the Company does not receive enough volunteers to enter into RO training, the Company may assign the desired number of Waste Control Operators to RO class based on Article 11. XX candidates, who have not successfully completed RO class on their first attempt, may or may not be allowed to attend RO class again, at the discretion of management. An RO candidate who has not successfully completed a second RO class may, at the discretion of management, be transferred to another classification or department, subject to the Grievance Procedure. Management may consider Reactor Operator experience for filling a shift vacancy or shift staffing. Employees who are entering Reactor Operator positions and obtain a Nuclear Regulatory Commission reactor operator license shall be restricted from transferring to any vacancy or new job, except of higher classification, until the applicable unit completes two (2) operating cycles following receipt of the Nuclear Regulatory Commission reactor operator license.
Operations Personnel. The Contractor shall employ only qualified and licensed drivers who shall be required at all times to exercise the highest degree of care and to observe and comply with all laws, ordinances, rules and regulations, and Board policies pertaining to the operation of vehicles and the transportation of students. Contractor shall not provide any drivers who have been convicted or pled guilty of any driving-related crime. The Board shall have the right to require the removal and/or reassignment of any person or driver being utilized by Contractor to fulfill this Contract. Any request by the Board to remove or transfer a particular Contractor employee from a route shall be honored immediately. The Contractor shall furnish to the Board the following information relative to each driver that will be used in the implementation of this Agreement and be responsible for keeping current information: a. Name of driver, to include first name, middle initial and last name; b. Driver’s school bus permit and commercial driver’s license numbers and expiration dates; and c. Telephone numbers for all drivers.
Operations Personnel. The CONTRACTOR shall provide, either directly or through approved subcontractors, all management, supervision, training, drivers, dispatchers, clerks, service workers, mobility management, telephone information operators, and such other personnel necessary to responsibly operate the SAGE STAGE public transit system. For purposes of this AGREEMENT, the terms “employee(s)” and “personnel” shall include individuals employed by subcontractors that perform any of the SAGE STAGE vehicle operations functions.
