Overtime and Penalties. 15.1 Overtime shall only be done where directed or authorized by the Employer. All overtime shall stand alone. 15.2 The Employer shall solely determine whether overtime is to be worked and how much overtime will be worked. Provided that the working of such overtime (additional hours) is reasonable. 15.3 In determining whether additional hours are reasonable or unreasonable for the purposes of Clause 15 the following must be considered: 15.3.1 any risk to employee health and safety from working the additional hours. 15.3.2 the employee's personal circumstances, including family responsibilities; 15.3.3 the needs of the workplace or employer in which the employee is employed; 15.3.4 the employee is entitled to receive overtime payments or other compensation for, or a level of remuneration that reflects an expectation of, working additional hours; 15.3.5 any notice given by the employer of any request or requirement to work the additional hours. 15.3.6 any notice given by the employee of his or her intention to refuse to work the additional hours; 15.3.7 the usual patterns of work in the industry, or the part of an industry, in which the employee works; 15.3.8 the nature of the employee's role, and the employee's level of responsibility; 15.3.9 whether the additional hours are in accordance with averaging terms included under section 63 in a modern award or enterprise agreement that applies to the employee, or with an averaging arrangement agreed to by the employer and employee under section 64; and 15.3.10 any other relevant matter.
Overtime and Penalties. For the purposes of this Agreement, overtime and/or penalties will be deemed to occur and be payable only under the following circumstances: (a) Work Outside of Ordinary Hours Where work is undertaken outside the ordinary hours, outside of the rostered working hours or more than the agreed roster cycle i.e., an average of 38 hours per week or 190 hours per 5-week cycle), this work shall be considered overtime. In this circumstance, overtime will be paid in accordance with Summary Table in 2.14. For the purposes of this clause, the agreed roster cycle is 5 weeks.
Overtime and Penalties. (a) For full-time employees all hours worked in excess of the normal hours shall be paid at time and a half for the first two hours and double time thereafter. (b) For any hours worked on Saturday the rate of pay will be time and a half for the first two hours and double time thereafter. A minimum of four hours applies. (c) For any hours worked on Sunday the rate of pay will be double time. A minimum of four hours applies. (d) In the calculations of overtime, portions of hours shall be taken to the nearest one tenth of an hour.

All time worked outside ordinary hours as defined in clause 8.1 will be overtime and for part- time Employees, time worked outside of the agreed weekly hours defined in clause 3.2 will be overtime. By mutual agreement between the Employer and permanent Employee, the permanent Employee may be granted time off instead of receiving the overtime payment provided that: 9.4.1. time off will be calculated at the penalty equivalent; 9.4.2. time off must be taken within one calendar month of working of the overtime, or it will be paid out. 9.5. Where an Ordinary Security Employee is required to work during a Night Span, the Ordinary Security Employee will be paid a penalty of 21.7% at the Base Rate of Pay for Ordinary Security Employees, for those hours. 9.6. This overtime clause 9 does not apply to casual Employees.

Overtime and Penalties. (a) Subject to sub clause 15(c) the Employer may require an employee to work reasonable overtime at overtime rates. (b) An employee may refuse to work overtime in circumstances where the working of such overtime would result in the employee working hours which are unreasonable having regard to: (i) any risk to employee health and safety; (ii) the employee's personal circumstances including any family responsibilities; (iii) the needs of the workplace or enterprise; (iv) the notice (if any) given by the Employer of the overtime and by the employee of his or her intention to refuse it; and (v) any other relevant matter. (c) No overtime shall be worked without the prior approval of the Employer. (d) An employee may elect to take time off in lieu of being paid for any overtime worked. All time off in lieu shall be at the penalty equivalent. Such time off in lieu arrangements must be recorded in writing. If time off for overtime that has been worked is not taken within a period of 6 months, or on termination of employment for any reason, the employer must pay the employee for the overtime, in the next pay period following those 6 months or termination of employment, at the overtime rate applicable to the overtime when it was worked. (e) Overtime shall be paid in the following circumstances: (i) when an employee works in excess of: (1) 8 hours in a day; (2) 10 hours in a day, where the employee has mutually agreed to work a 10 hour shift in accordance with clause 13(d) of the Agreement; (3) 37.5 hours in a week; or Monday to Friday - time and a half for the first 2 hours and double time thereafter; (ii) for work performed outside the span of ordinary hours, Monday to Friday - time and a half for the first 2 hours and double time thereafter; (iii) for all work performed on Saturday - time and a half for the first 2 hours and double time thereafter; (iv) for all work performed on Sunday - double time; and (v) for all work performed on a public holiday - double time and a half. (f) The penalty Rates prescribed for work on Saturdays, Sundays and public holidays are applicable to part-time employees.
Overtime and Penalties. 21.1 The Company may require Employees to work a reasonable amount of overtime. 21.2 Subject to the provisions of this clause, where an Employee is directed to work beyond the ordinary hours Monday to Saturday, they will be paid 150% of their Ordinary Hourly Rate for the first 2 hours and 200% thereafter. 21.3 Where an Employee is directed to work on a Sunday they will be paid 200% of their Ordinary Hourly Rate. 21.4 All work performed on public holidays (other than Good Friday or Christmas Day) will be paid 250% of the Employee’s Ordinary Hourly Rate. 21.5 All work performed on Good Friday or Christmas Day will be paid 300% of the Employee’s Ordinary Hourly Rate. 21.6 In computing overtime each day shall stand alone. 21.7 An Employee required to work overtime on a Saturday, Sunday or Public Holidays will be afforded at least 4 hours’ work or be paid for 4 hours at the appropriate rate. 21.8 The Company may withdraw any offer to work overtime, without notice, where threatened or actual industrial activity or action affects Company operations.
