Personal Leave - Sick and Xxxxx’s Leave. 34.1 Where an Employee is: (a) absent from work on account of personal injury; illness; or (b) required to provide care or support to a member of their immediate family or a household member, who requires care or support as they are sick or injured or have an unexpected emergency; any amount of accrued personal leave can be accessed for the purposes of sick and carer’s leave. 34.2 This leave is subject to the following: (a) The Employee shall not be entitled to such leave of absence for any period in respect of which he is entitled to workers’ compensation. (b) The Employee shall, prior to the commencement of such absence, inform Xxxxxxxx of the inability to attend work and, as far as may be practicable, state the nature of the illness or injury and the estimated duration of the absence.

Personal Leave - Sick and Xxxxx’s Leave. 21.1 The parties acknowledge that employees are able to access accrued personal leave where they are unable to attend for duties, due to a personal illness or injury, or to be the primary caregiver for an immediate family member who is suffering from an illness or injury. 21.2 If an employee does not have sufficient personal leave to cover a desired personal leave absence, the employee may, with the approval of the employer, access any other accrued leave, such as TOIL, RDOs, annual leave or long service leave. 21.3 If an employee is absent for more than two consecutive days, the employee is required to furnish a medical certificate to the Council in respect of their illness/injury, or that of the person for whom they were the primary caregiver. 21.4 Notwithstanding the requirement at Clause 21.3, the Council reserves the right to require a medical certificate in respect of single day absences. 21.5 If an employee intends to absent themself from the workplace for personal leave reasons, the employee is required to advise, or make a genuine endeavour to advise, his/her Supervisor (or his/her nominee) before the employee’s usual start time. If this is not possible, the employee must notify his/her supervisor as soon as possible, but no later than 24 hours of the commencement of the absence. 21.6 If an employee does not have sufficient accrued leave entitlements to cover the period of personal leave, and if the circumstances are exceptional, the employee may make application to the CEO for special leave, which may be paid or unpaid. The CEO retains an absolute discretion in relation to such applications.

Personal Leave - Sick and Xxxxx’s Leave. 32.1 Full-time and part-time Employees shall be entitled to personal leave. 32.2 An employee’s minimum entitlement to personal leave shall be in accordance with the National Employment Standards, however this Agreement provides additional entitlements in respect to personal leave. 32.3 Personal leave (sick leave only) is cumulative. 32.4 Any entitlement to personal leave accrued prior to the commencement of this Agreement shall be carried over and is cumulative. 32.5 As soon as practicable after each four (4) week period, the Club shall credit all Employees with a pro rata accrual of personal leave. 32.6 Employees may take credited personal leave because of: 32.6.1 illness or injury; and/or 32.6.2 a necessity to provide care or support to a person(s) of an Employee’s immediate family or household who is ill or injured or who has been involved in an unexpected emergency. 32.6.3 Immediate Family includes (in respect of a particular Employee): a) the employee’s spouse, de facto spouse (living with the employee as husband or wife on a bona fide domestic basis), child (including an adopted child, a stepchild or an ex-nuptial child), parent, grandparent, grandchild or sibling; b) a child (including an adopted child, a stepchild or an ex- nuptial child), parent, grandparent, grandchild or sibling of the employee’s spouse or de facto spouse. 32.7 Employees must notify the Club as soon as reasonably practicable before or after taking personal leave regardless of whether it is paid or unpaid. 32.8 Employees must provide a bona fide medical certificate that has been signed by a registered health practitioner to the Club as soon as reasonably practicable before or after taking personal leave. 32.9 If a bona fide medical certificate cannot be provided by Employees in accordance with Subclause 32.8, Employees must complete and submit a statutory declaration to the Club which clearly states the reason(s) why Employees are taking personal leave. Employee may submit not more than two (2) single days Statutory Declaration per year, unless the Employer elects to exercise its discretion otherwise. 32.10 If Employees have exhausted their entitlement to personal leave for whatever reason, they shall then be entitled to two (2) days unpaid personal (carer’s) leave per occasion. Casual Employees are also entitled to two (2) days unpaid personal (carer’s leave) leave per occasion.
Personal Leave - Sick and Xxxxx’s Leave. 58.1 An Employee shall be entitled to receive one hundred and fourteen (114 hours) (equivalent to fifteen (15) days at seven point six (7.6) hours) Personal Leave per year which will accrue on a monthly basis during the first year of service with the Company. On every anniversary of the Employees commencement with the Company, an Employee shall be entitled to receive a further one hundred and fourteen (114 hours) (equivalent to fifteen (15) days at seven point six (7.6) hours) sick leave. Any unused Personal Leave shall accumulate and accrue to the Employee's credit.
