Review of Personnel Records. Every unit member shall have the right to inspect the materials upon request, with the exception of materials mentioned in the above paragraph. Such review shall take place during normal school hours and the unit member shall be released from duty for this purpose without salary deduction.
Review of Personnel Records. The County shall maintain personnel files for each employee. Employees or their authorized representatives have the right to examine the contents of their master personnel files while off duty. Adverse comments may not be placed in the employees’ master personnel files without the employees’ signature on the face of the document. If an employee refuses to sign a document, the document may be placed in the employee’s master personnel file with a notation that the employee was offered the opportunity to sign the document but refused to do so. Employees may cause to be placed in their master personnel files, with the acknowledgement of the Human Resource Director, or designee, responses to adverse material inserted therein and a correspondence from other sources directly related to their job performance.

At least once every three (3) years, an administrator shall have the right to indicate those documents and/or materials in his/her file, which he/she believes to be obsolete or otherwise inappropriate to retain. Said documents shall be reviewed by the Superintendent or his/her designee and if in fact the Superintendent determines that the documents and/or materials are obsolete or otherwise inappropriate to retain, they shall be destroyed.

Conditions of hiring, changes in status, changes in pay or approval/denial of leaves of absence will be documented in writing and transmitted to the employee in writing. Employees shall have the right to review and comment on letters of warning and performance evaluations currently in their personnel files. Within thirty (30) days of the ratification of this Agreement and then semiannually thereafter, the District shall provide the Association with an Excel spreadsheet attachment to an email listing of all employees covered by this Agreement. The roster shall include name, address, last four digits of Social Security number, employee identification number, telephone number, dates of employment, department, current step and current wage rate. On a monthly basis, the District shall supply to the Association the above information for all nurses who are newly hired, transferred into or out of the bargaining unit, or whose employment was terminated. The Association agrees to use the listed roster information only for Association business and to hold the District harmless from damages resulting from all use of the information.

A member of the Sheriff’s Department will be granted permission to review his/her personnel record anytime during the Sheriff’s regular business hours upon forty-eight (48) hours notice. This review will be in the presence of the Sheriff, as custodian of all personnel records, or his designee, and the time shall be reasonable and at the convenience of the Sheriff.
B. An employee may inspect his/her personnel record to assure that only work-related and factually accurate records are in the employee’s personnel file. Any information which is not accurate or work-related will be removed by the Sheriff upon the employee’s request. If the Sheriff maintains that the information is factually correct and is work-related, that employee has the internal complaint procedure policy to follow or the employee may elect to follow the grievance procedure.
C. Such review shall not include any reports, memoranda or other documents related to pre-employment investigations. Nor shall the identity of an informant or complainant be revealed when the information provided or allegation made against a member of the Sheriff’s Department was confidential in nature or the subject of a written report and was not used as evidence or proof in a department disciplinary action. An employee shall be notified in writing of any derogatory or disciplinary entry placed into his/her personnel file and will be permitted to place in his/her personnel file a response to any material filed therein if in his/her judgment the material is adverse or not justified. It is understood that the personnel file kept by the Sheriff is the official personnel file.

12.7.2 Pursuant to State of New Hampshire RSA 275:56, as amended, if upon inspection of his or her Personnel File(s), an employee feels that a record contained therein should be removed or corrected in writing, he may so request of the Fire Chief. If such request is denied, the employee may submit a written statement for the file(s) explaining his version of the information contained therein, with evidence supporting such version. Such statement shall be maintained as part of the employee’s Personnel Record.
