Transfers Out of the Bargaining Unit. 20.01 Employees who are or have been appointed or selected for a supervisory position, or for any position not subject to the provisions of this Agreement, will not be covered by the provisions of this Agreement. However, an employee transferred out of a bargaining unit and who is later transferred by the Employer back to a position which is covered by this Agreement will be credited with the seniority the employee had accumulated immediately prior to transfer out of the bargaining unit. If the transfer of an employee back into the bargaining unit necessitates an employee with less seniority being displaced, the employee with the least seniority shall be displaced.
20.02 Employees having been employed only in positions outside the bargaining unit, if subsequently transferred to a bargaining unit position, will be considered new employees for the purpose of seniority.
Transfers Out of the Bargaining Unit. Employees shall not be transferred or promoted out of the bargaining unit without their consent. Such employees shall retain the seniority they have acquired up to the date of leaving the unit but shall not continue to accumulate seniority for periods of service outside the unit. Employees transferred or promoted out of the bargaining unit may be returned to the bargaining unit, provided that no more than twenty (20) months have passed, they meet the requirements of Article 16 and subject to an agreeable payment of back union dues.
Transfers Out of the Bargaining Unit. Employees shall not be transferred or promoted out of the bargaining unit without their consent. Employees who are transferred or promoted out of the bargaining unit shall retain the seniority they acquired up to the date of leaving the unit, but shall not continue to accumulate seniority for periods of service outside the unit. When an employee is transferred or promoted out of the bargaining unit, the employee shall retain the right to return, subject to the following conditions:
(i) Members of the bargaining unit who accept a temporary transfer or promotion for a period not exceeding (12) months shall have the right to return to their previous position or a position equal to that previous position. The twelve (12) months referred to in (i) above may be extended by mutual agreement;
(ii) Members of the bargaining unit who accept a permanent transfer or promotion out of the bargaining unit, may be returned to the bargaining unit subject to the following:
(a) No regular employee within the bargaining unit shall be displaced or laid off due to the return of the employee;
(b) The posting process may be suspended by mutual agreement to allow placement of a returning employee into an existing vacancy. The Union's agreement will not be unreasonably withheld;
(c) Employees permanently transferred or promoted out of the bargaining unit shall be returned to the bargaining unit, subject to a mutually agreeable payment of back union dues.
Transfers Out of the Bargaining Unit. An employee transferring out of the bargaining unit will continue to accumulate departmental seniority rights for sixty (60) calendar days following the transfer, after which time they shall have no bargaining unit rights.
Transfers Out of the Bargaining Unit. A Nurse who is transferred to a position outside the bargaining unit but within the Municipality, shall retain but not accumulate seniority while in that position for a period of up to twelve (12) months. If a Nurse returns to her previous position prior to the end of the twelve (12) months, she will be entitled to all the rights of the Collective Agreement upon the date of return. In the event the nurse does not return to the bargaining unit, all seniority will be lost.
Transfers Out of the Bargaining Unit. A. If an employee transfers to a position under the Employer which is not included in the bargaining unit or to one of the Van Buren County bargaining units or other court units and thereafter within 9sixty (60) calendar days transfers back to a position within the bargaining unit, he shall have accumulated seniority while working in the position to which he transferred. It is understood that an employee who transfers out of the bargaining unit shall be prohibited from holding a Union office in the bargaining unit from which he/she transferred until such time he/she returns to said bargaining units.
B. Employees transferred or promoted to positions outside the bargaining unit under the Employer shall have their accumulated bargaining unit seniority frozen while working in the position to which the employee has transferred.
C. Employees returning to the bargaining unit from a position under the Employer as a result of a transfer or employer layoff, displacement or recall shall be returned with only that seniority earned in the bargaining unit.
Transfers Out of the Bargaining Unit. An employee who accepts a position under the jurisdiction of the Employer (as defined herein) not included in this bargaining unit shall maintain all accumulated seniority to the date of classification change for a period of one year. There is no guarantee that a former employee will be able to regain his/her previous position during the first year or at any future date unless a vacancy occurs within the position classification from which the employee left. If a vacancy occurs in the eligible classification at any time in the future, and the former employee indicates in writing that he/she desires the position back, the Employer reserves the right to determine if the former employee continues to have the qualifications for the existing position. Based upon the qualifications factor, the Employer will or will not rehire the person. It will be the former employee's responsibility to make themselves aware of position vacancies.
Transfers Out of the Bargaining Unit. The Union will be notified in writing of all transfers out of the bargaining unit and returns of Nurses to the bargaining unit. Such notice will include the current seniority for the Nurses for purposes of placement on the seniority list.
(a) A Nurse who is transferred to a position outside of the bargaining unit for a period of not more than three (3) months, shall not suffer any loss of seniority, service or benefits. A Nurse who is transferred to a position outside of the bargaining unit for a period of more than three (3) months, but not more than eighteen (18) months shall retain, but not accumulate, her or his seniority held at the time of the transfer. In the event the Nurse is returned to a position in the bargaining unit, she or he shall be credited with seniority held at the time of transfer and resume accumulation from the date of her or his return to the bargaining unit. A Nurse must remain in the bargaining unit for a period of at least three

For further clarity, this does not apply to Dual Rate Supervisors. If the transfer of an employee back into the bargaining unit necessitates an employee with less seniority being displaced, the employee in that classification with the least seniority shall be displaced.
20.02 Employees having been employed only in positions outside the bargaining unit, if subsequently transferred to a bargaining unit position, will be considered new employees for the purpose of seniority.
Transfers Out of the Bargaining Unit. (a) An employee may substitutes temporarily in a position outside the bargaining unit for up to fifteen (15) months from the date of the assignment. Bargaining unit employees shall be given the first opportunity to fill the resulting vacancy. The employee shall have the right to return to her or his bargaining unit position prior to the expiry of the fifteen (15) month period by giving the Employer six (6) weeks notice. Where an employee is backfilling outside of the bargaining unit for purposes of pregnancy and/or parental leave, the period of time will be extended up to nineteen (19) months from the date of the assignment. An employee who remains outside of the bargaining unit beyond the period covered by this article shall lose all seniority. When the employee returns to the bargaining unit, all other employee(s) shall revert to their previous positions. An employee must remain in the bargaining unit for a period of at least three (3) months before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer unless the parties agree otherwise.
(b) An employee who accepts a transfer under (a) above will not be required to pay union dues for any complete calendar month during which no bargaining unit work is performed.
(c) An employee who accepts a permanent position outside of the bargaining unit will lose all seniority held at the time of the transfer.
(d) The Employer will advise the Union of the names of any employees pursuant to Article 9.13 (a) or (b).
