SENIORITY & JOB SECURITY. 9.01 A seniority list of all nurses covered by this Agreement shall be posted in January of each year. For purposes of the initial seniority list, challenges as to the accuracy will be accepted for one (1) month from the date of posting of the list. Thereafter it shall be considered to be accurate.
(a) A full-time nurse shall be on probation for a period of sixty (60) paid tours. Seniority shall then date back to the date of hire.
(b) A part-time nurse shall be on probation for a period of sixty (60) paid tours or five (5) months, whichever occurs first.
(c) Seniority for part- time nurses shall be based on number of tours from January 1, 1976 and reflecting service prior to 1976. The part-time nurse who has the greatest number of tours standing to her credit shall be deemed to be the most senior nurse.
9.03 In all cases of transfer or promotion, the following factors shall be considered:
(a) ability, experience and qualifications;
(b) seniority. Where the factors in (a) are relatively equal, (b) shall govern.
(a) In the event that a reduction of the work force is required due to a decrease in workload, the Employer agrees that lay-offs will be by seniority, so that the nurse with the least seniority will be laid off first [1st] provided the nurses remaining are willing and able to perform the available work. Recall shall be made on the basis of seniority provided those nurses are willing and able to perform the available work. All nurses who are on lay-off will be given job opportunity before any new nurse is hired into the bargaining unit.
(b) No nurse may be laid off until she has been provided with notice of layoff in accordance with the Employment Standards Act, except that in no case will the notice be less than thirty (30) calendar days, or appropriate pay in lieu thereof, and a copy of the notice will be sent to the Association.
(c) In the event of a proposed lay-off of a permanent or long term nature, the Employer will:
i) provide the local Association with notice of such layoff as far in advance as is possible, and in no case less than thirty (30) days' notice;
ii) meet with the Local Association to review the following:
A) the reasons causing the lay-off;
B) the service which the Employer will undertake after the lay- off;
C) the method of implementation, including the areas of cutback and the nurses to be laid off.
9.05 Seniority shall be retained and accumulated when a nurse is absent from work under the following conditions:

9.02 A seniority list of nurses covered by this Agreement, showing seniority, shall be posted by the Employer bi-yearly by December 31st and June 30th, with copies sent to the Union. Two (2) copies of such list will be forwarded to the Secretary of the Local.
(a) A newly hired full-time nurse must complete a probationary period of four hundred and fifty (450) hours worked.
(b) A newly hired regular part-time nurse must complete a probationary period of four hundred and fifty (450) hours worked, or a period of twelve
SENIORITY & JOB SECURITY. 11.01 New employees will be on probation for a period of 450 hours worked. The employment of probationary employees may be terminated at any time at the discretion of the Employer. The Employer will not act in a discriminatory, arbitrary or bad-faith manner in exercising this right. On completion of the probationary period, the employee will be credited with seniority back to the date he or she was hired. With the written consent of the Employer, the probationary nurse and the Bargaining Unit President or designate, such probationary period may be extended. Where the Employer requests an extension of the probationary period, it will provide notice to the Union at least seven (7) calendar days prior to the expected date of expiration of the initial probationary period. It is understood and agreed that any extension to the probationary period will not exceed an additional twenty (20) tours (150 hours) worked and, where requested, the Employer will advise the nurse and the Union of the basis of such extension with recommendations for the nurse’s professional development.
(a) The Employer will keep up-to-date separate seniority lists for both full-time and part-time employees, post the same in a conspicuous place, revise the same semi-annually and supply copies of same to the Union.
(b) The seniority list referred to in (a) above will be calculated for full- time in years and for part-time using paid hours, whether worked or not. For the purpose of the preparation of the initial list, service from the date of employment will be used for the calculation.
(c) The seniority lists referred to in (a) above are combined.
SENIORITY & JOB SECURITY. A. Seniority shall be considered when a vacancy is filled or a request for a transfer is received. A seniority list shall be maintained and upgraded each year by the District with copies given to the Union by January 1st.
B. Definition of Seniority: Regular employees attain their seniority in the following manner: Upon the successful completion of the probationary period and confirmation by the Board of Trustees, the employee’s name shall be added to the seniority list as of the date of their original employment as a regular and continuous employee within the bargaining unit.

9.04 Part-time nurses shall accumulate seniority and service on the basis of 1500 hours paid equals one year of seniority and service. The Union and the Employer agree to abide by the Ontario Human Rights Code.
(a) The following minimums are to observed in the orientation/familiarization of a newly hired nurse;
i) she is to be familiarized with the physical aspects of the building, the applicable policies and procedures of the Employer, and the daily routine of nurses in the Home;
ii) the nurse(s) involved in the orientation/familiarization will confirm that it has been completed, and this will be noted on the newly hired nurse's personnel file, which will be reviewed with such nurse, and the nurse shall also be able to comment.
iii) before assigning a newly hired nurse to be In Charge the Employer will first provide the nurse with any necessary orientation.
SENIORITY & JOB SECURITY. A. School District seniority is defined as service by appointed custodians in the Wallington School District in the collective bargaining unit covered by this Agreement. An appointed Custodian shall lose all accumulated Wallington School District seniority only if he/she:
B. In the event of a work location reduction in force, including reductions caused by the discontinuance of a facility or its relocation, the custodians shall be laid off in the inverse order of seniority of the custodians in the district.
C. In the event that within one year from the date of his/her layoff, a vacancy occurs in the classification of his/her last appointment in the district, a laid-off custodian shall be entitled to recall hereto in the order of his/her departmental seniority.
SENIORITY & JOB SECURITY.
9.01 Seniority is defined as the length of service in the bargaining unit with the Health Centre, except as provided in Article 9.04, for the purposes of determining preference or priority for promotions, transfers, demotions, layoffs and recall, regardless of the department or classification an employee may have been in from time to time. A part-time employee cannot accrue more than 1725 hours of seniority and service in a twelve (12) month period which shall be defined as the calendar year. Temporary part-time and full-time employee’s hours of work shall be credited toward their seniority once they have successfully completed their probationary period pursuant to Article 9.03 providing there has been no termination of their employment prior to being awarded a permanent position. It is understood that a temporary employee’s hours of service will only be credited toward seniority, once she/he becomes permanent, if there is no break in his/her employment between the temporary and the permanent positions. An employee while off on sick leave (short-term disability including the EI portion and long-term disability) or W.S.I.B. will continue to accrue seniority for the duration of the leave. Service for the purposes of vacation and salary progression and other benefits will be retained but will not accumulate during the period of the leave. The terms of Article 11.04 will not apply in this circumstance.
SENIORITY & JOB SECURITY. A. School District seniority is defined as service by appointed custodians in the Wallington School District in the collective bargaining unit covered by this Agreement. An appointed Custodian shall lose all accumulated Wallington School District seniority only if he/she: Resigns or is discharged for cause, irrespective of whether he/she is subsequently rehired by the Wallington School District.
B. In the event of a work location reduction in force, including reductions caused by the discontinuance of a facility or its relocation, the custodians shall be laid off in the inverse order of seniority of the custodians in the district.
C. In the event that within one year from the date of his/her layoff, a vacancy occurs in the classification of his/her last appointment in the district, a laid-off custodian shall be entitled to recall hereto in the order of his/her departmental seniority.
D. Disability Insurance (Custodians) -The board will provide payment up to $600 to each twelvemonth full time custodian/groundskeeper/maintenance person towards the employees securing personal disability insurance policy upon the submission of evidence of purchase of the policy. These payments will be made directly to the provider on a monthly basis in ten (10) equal installments (September – June)for the period of the policy during which the individual is employed by the district, in the amount of $50.00 per month. The board office must be notified of enrollment in the district plan prior to September 1.
SENIORITY & JOB SECURITY. A. School district seniority is defined as service by appointed and contracted employees in the school district in the collective bargaining unit covered by this agreement.
B. In the event of a reduction in force, the principle of seniority is to be used, and those employees with the least time in service will be dismissed first, provided that each retained employee’s evaluations are satisfactory and provided that all retained employees are qualified to perform the full range of duties required and needed by the Board of Education (i.e., mandated positions and special skills individuals such as bilingual aides).
C. Seniority shall not be accumulated during the period of layoff. Upon recall, the appointed employee shall have his/her accumulated seniority to the date of layoff.
D. Recall shall be by seniority, irrespective of the length of layoff. However, in the event that an employee declines a recall, the Board is under no further obligation to later recall that employee.
SENIORITY & JOB SECURITY. 6.1 Seniority, as used in this Agreement, unless otherwise specifically stated, shall mean an employee’s total length of continuous service with the District since his/her last date of hire. An employee shall lose all seniority credit in the event of voluntary or involuntary termination. An employee who is laid off and who is subsequently reinstated, shall have his/her full seniority earned prior to layoff restored, but shall not earn seniority during this layoff status. All authorized paid leaves shall be counted towards seniority while authorized unpaid leaves in excess of one month (20 workdays) will not be counted.
6.1.1 The District shall make available to the Union upon request, copies of any personnel list the employer maintains regarding seniority of the bargaining unit member.
