SENIORITY & JOB SECURITY. 9.01 A seniority list of all nurses covered by this Agreement shall be posted twice annually, in February and August of each year. A copy of the posted seniority list will be provided to the Bargaining Unit President at the time of posting. Challenges as to the accuracy will be accepted for one (1) month from the date of the posting of the list. Thereafter it shall be considered to be accurate.
(a) A full-time nurse shall be on probation for a period of sixty (60) paid tours. Seniority shall then date back to the date of hire.
(b) A part-time nurse shall be on probation for a period of sixty (60) paid tours or five (5) months, whichever occurs first.
(c) Seniority for part time nurses shall be based on the number of tours worked since her most recent date of hire. The nurse who has the most number of tours standing to her credit shall be deemed to be the most senior nurse.
(d) By mutual agreement of the Employer, the Union and the probationary employee, the probationary period may be extended for an additional sixty (60) paid hours. It is agreed there shall only be one extension.
9.03 In all cases of transfer or promotion, the following factors shall be considered:
(a) ability, experience and qualifications;
(b) seniority. Where the factors in (a) are relatively equal, (b) shall govern.
(a) In the event that a reduction of the work force is required due to a decrease in workload, the Employer agrees that lay-offs will be by seniority, so that the nurse with the least seniority will be laid off first [1st] provided the nurses remaining are willing and able to perform the available work. Recall shall be made on the basis of seniority provided those nurses are willing and able to perform the available work. All nurses who are on lay-off will be given job opportunity before any new nurse is hired into the bargaining unit.
(b) No nurse may be laid off until she has been provided with notice of layoff in accordance with the Employment Standards Act, except that in no case will the notice be less than sixty (60) calendar days, or appropriate pay in lieu thereof, and a copy of the notice will be sent to the Union.
(c) In the event of a proposed lay-off of a permanent or long term nature, the Employer will:
i) provide the local Union with notice of such layoff as far in advance as is possible, and in no case less than ninety (90) days notice;
ii) meet with the Local Union to review the following:
A) the reasons causing the lay-off;
B) the service which the Employer...
SENIORITY & JOB SECURITY. 11.01 New employees will be on probation for a period of 450 hours worked. The employment of probationary employees may be terminated at any time at the discretion of the Employer. The Employer will not act in a discriminatory, arbitrary or bad-faith manner in exercising this right. On completion of the probationary period, the employee will be credited with seniority back to the date he or she was hired. With the written consent of the Employer, the probationary nurse and the Bargaining Unit President or designate, such probationary period may be extended. Where the Employer requests an extension of the probationary period, it will provide notice to the Union at least seven (7) calendar days prior to the expected date of expiration of the initial probationary period. It is understood and agreed that any extension to the probationary period will not exceed an additional twenty (20) tours (150 hours) worked and, where requested, the Employer will advise the nurse and the Union of the basis of such extension with recommendations for the nurse’s professional development.
(a) The Employer will keep up-to-date separate seniority lists for both full-time and part-time employees, post the same in a conspicuous place, revise the same semi-annually and supply copies of same to the Union.
(b) The seniority list referred to in (a) above will be calculated for full- time in years and for part-time using paid hours, whether worked or not. For the purpose of the preparation of the initial list, service from the date of employment will be used for the calculation.
(c) The seniority lists referred to in (a) above are combined.

9.04 Part-time nurses shall accumulate seniority and service on the basis of 1500 hours paid equals one year of seniority and service. The Union and the Employer agree to abide by the Ontario Human Rights Code.
(a) The following minimums are to observed in the orientation/familiarization of a newly hired nurse;
i) she is to be familiarized with the physical aspects of the building, the applicable policies and procedures of the Employer, and the daily routine of nurses in the Home;
ii) the nurse(s) involved in the orientation/familiarization will confirm that it has been completed, and this will be noted on the newly hired nurse's personnel file, which will be reviewed with such nurse, and the nurse shall also be able to comment.
iii) before assigning a newly hired nurse to be In Charge the Employer will first provide the nurse with any necessary orientation.
SENIORITY & JOB SECURITY. A. Seniority shall be considered when a vacancy is filled or a request for a transfer is received. A seniority list shall be maintained and upgraded each year by the District with copies given to the Union by January 1st.
B. Definition of Seniority: Regular employees attain their seniority in the following manner: Upon the successful completion of the probationary period and confirmation by the Board of Trustees, the employee’s name shall be added to the seniority list as of the date of their original employment as a regular and continuous employee within the bargaining unit.
SENIORITY & JOB SECURITY. Section 1. School District seniority is defined as service by appointed employees in the School District in the collective bargaining unit covered by this agreement. An appointed employee shall lose all accumulated School District seniority only if he:
a. resigns or is discharged for cause, irrespective of whether he is subsequently rehired by the School District.
b. is laid off for more than thirteen (13) consecutive calendar months.
Section 2. In the event of a department or work location reduction in force, including reductions caused by the discontinuance of a facility or its relocation, the employee shall be laid off in the reverse order of seniority of the employees in the department involved.
a. at least three (3) calendar days before being laid off, an appointed employee shall be informed of all vacancies in any other work locations in his classification in the department in which he holds an appointment, for the purpose of giving him the opportunity, to be exercised with in said three (3) calendar days, to fill such a vacancy. If he requests appointment to such vacancy, he shall be assigned thereto. In the event that vacancies in such classification exist in several work locations, he shall be assigned to the vacancy designated by the department. In the event more than one appointed employee in such classification is laid off, and there are insufficient vacancies for such assignments, then the laid-off employees with the highest seniority shall be first assigned to the vacancies involved.
b. in the event that there is no such vacancy, then the laid-off employee shall, within said three (3) calendar day period, be entitled to displace (bump) the appointed employee with the least seniority in the same departmental category as defined in Schedule A of this contract, provided he is capable of performing the work with the same efficiency as the appointed employee whom he seeks to replace. In the event of such involuntary transfer to a lesser paying job, pay will be frozen at the higher salary for a period of ninety (90) calendar days.
c. The department shall furnish to each laid-off employee, before said three (3) calendar day period, information as to work locations and classifications and lesser classifications the duties of which such employee is capable of performing as above so that he is in a position to promptly exercise his rights under sub-paragraph A above.

SENIORITY & JOB SECURITY. (a) Seniority shall be defined as paid hours accumulated since date of last hire.
SENIORITY & JOB SECURITY. 1. No employee may be dismissed except for just and sufficient cause or to reduce the force. Just and sufficient cause may be interpreted to include repeated offenses against which the employee has been adequately warned. Copies of written disciplinary action will be given to the Guild.
2. An employee shall be probationary for ninety (90) days. The probationary period may be extended for up to ninety (90) days upon mutual agreement between the Employer and the Union. Thereafter, an employee shall be considered to have seniority dating back to the most recent date of hire and, if a seniority employee is terminated for just and sufficient cause, such termination shall be subject to review in the grievance procedure.
3. Seniority is defined as length of continuous service with the Employer and shall entitle employees to those benefits expressly enumerated in this Agreement. An employee who leaves the bargaining unit after June 17, 1984, shall have his or her seniority frozen, for purposes of layoff and recall only, as of the date of leaving the bargaining unit. If that employee returns to the bargaining unit, seniority shall resume upon the date of return to the bargaining unit.
4. Employment shall be deemed continuous unless:
(a) An employee resigns,
(b) An employee retires,
(c) An employee is dismissed for just cause,
(d) An employee refuses to accept a recall to the classification from which the employee was dismissed,
(e) An employee remains dismissed for a period of time equal to the employee’s seniority at the time of dismissal, up to a maximum of eighteen
SENIORITY & JOB SECURITY. 6.1 Seniority, as used in this Agreement, unless otherwise specifically stated, shall mean an employee’s total length of continuous service with the District since his/her last date of hire. An employee shall lose all seniority credit in the event of voluntary or involuntary termination. An employee who is laid off and who is subsequently reinstated, shall have his/her full seniority earned prior to layoff restored, but shall not earn seniority during this layoff status. All authorized paid leaves shall be counted towards seniority while authorized unpaid leaves in excess of one month (20 workdays) will not be counted.
6.1.1 The District shall make available to the Union upon request, copies of any personnel list the employer maintains regarding seniority of the bargaining unit member.
SENIORITY & JOB SECURITY. A. School District seniority is defined as service by appointed custodians in the Wallington School District in the collective bargaining unit covered by this Agreement. An appointed Custodian shall lose all accumulated Wallington School District seniority only if he/she:
B. In the event of a work location reduction in force, including reductions caused by the discontinuance of a facility or its relocation, the custodians shall be laid off in the inverse order of seniority of the custodians in the district.
C. In the event that within one year from the date of his/her layoff, a vacancy occurs in the classification of his/her last appointment in the district, a laid-off custodian shall be entitled to recall hereto in the order of his/her departmental seniority.
